Senate Study Bill 3055 - IntroducedA Bill ForAn Act 1requiring that lists of subcontractors working on
2certain public improvement projects be provided to the labor
3commissioner and including applicability provisions.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  73A.29  Contractors for public
2improvement projects — list of subcontractors.
   3A contractor, after being awarded a contract for a
4public improvement project and prior to performing work as a
5contractor on the public improvement project, shall provide to
6the labor commissioner a list of each tier of subcontractors
7who will perform work on the project to ensure compliance with
8sections 91C.2, 91C.3, 91C.4, and 91C.7 and rules adopted to
9implement those sections.
10   Sec. 2.  APPLICABILITY.  This Act applies to contracts for
11public improvement projects awarded on or after January 1,
122021.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill requires that a contractor provide the labor
17commissioner with a list of each tier of subcontractors who
18will perform work on a public improvement project after being
19awarded a contract for a public improvement project and prior
20to performing work as a contractor on the public improvement
21project to ensure compliance with statutory provisions
22relating to registration, registration fees, bonding, workers’
23compensation, and unemployment insurance.
   24Current Code defines “public improvement” as any building or
25construction work which is constructed, repaired, remodeled,
26or demolished under the control of a governmental entity and
27is paid for in whole or in part with funds of the governmental
28entity, including a building or improvement constructed or
29operated jointly with any other public or private agency.
   30The bill applies to contracts for public improvement
31projects awarded on or after January 1, 2021.
