2fireworks, and making penalties applicable.
3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 100.19, subsection 4, paragraph c, Code
22019, is amended by striking the paragraph.
3   Sec. 2.  Section 100.19, Code 2019, is amended by adding the
4following new subsection:
5   NEW SUBSECTION.  4A.  A retailer or community group issued
6a license pursuant to this section shall only sell consumer
7fireworks, as described in APA 87-1, chapter 3, within the two
8calendar weeks immediately preceding the date on which the use
9of consumer fireworks is permitted, whether pursuant to the
10dates specified in section 727.2, subsection 4, paragraph “a”,
11or, if applicable, the dates specified by a county or city
12in an ordinance or resolution adopted under section 331.301,
13subsection 17, or section 364.2, subsection 6.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17Current law allows a consumer fireworks seller license
18holder to sell consumer fireworks between June 1 and July 8
19and between December 10 and January 3 each year at a permanent
20building, and between June 13 and July 8 each year at a
21temporary structure.
   22This bill removes the dates allowed for consumer fireworks
23sales and instead provides that a consumer fireworks seller
24license holder shall only sell consumer fireworks within the
25two calendar weeks immediately preceding the date on which the
26use of consumer fireworks is permitted, whether pursuant to
27the dates specified in the Code or, if applicable, the dates
28specified by a county or city in an ordinance or resolution.
   29Under current law, a person who violates the bill is guilty
30of a simple misdemeanor. A simple misdemeanor is punishable by
31confinement for no more than 30 days or a fine of at least $65
32but not more than $625 or by both.
