3in a newborn child’s body and child in need of assistance
4proceedings.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  135.133  Newborn umbilical cord drug
2and alcohol testing.
   31.  For the purposes of this section, unless the context
4otherwise requires, “hospital” means a private or public
5hospital licensed pursuant to chapter 135B.
   62.  Each newborn child born in a hospital shall be tested
7for the presence of an illegal drug or alcohol in the child’s
8body. The test shall be conducted utilizing umbilical cord
9testing. The department shall report positive test results to
10the department of human services.
   113.  The department shall adopt rules as necessary for the
12administration of this section pursuant to chapter 17A.
13   Sec. 2.  Section 232.2, subsection 6, Code 2019, is amended
14by adding the following new paragraph:
15   NEW PARAGRAPH.  0p.  Who is a newborn in whose body there
16is an illegal drug or alcohol present at the time of birth.
17The presence of the drug or alcohol shall be determined in
18accordance with umbilical cord testing pursuant to section
19135B.7.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
   23This bill relates to requiring hospitals to provide
24umbilical cord testing for the presence of an illegal drug
25or alcohol in a newborn child’s body and a child in need of
26assistance proceeding.
   27The bill provides each newborn child born in a hospital
28is required to be tested for the presence of an illegal drug
29or alcohol in the child’s body. The test shall be conducted
30utilizing umbilical cord testing. The department of public
31health shall report positive test results to the department of
32human services. The bill directs the department to adopt rules
33as necessary to administer the provisions of the bill pursuant
34to Code chapter 17A.
   35The bill provides that a newborn with an illegal drug

2birth provides grounds for the filing of a child in need of
3assistance complaint pursuant to Code section 232.81.
