3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  144F.1  Withdrawal of
2life-sustaining procedures from minor child — court
3intervention.
   4A court of law or equity shall not have the authority to
5require the withdrawal of life-sustaining procedures from a
6minor child over the objection of the minor child’s parent or
7guardian, unless there is conclusive medical evidence that
8the minor child has died and any electronic brain, heart, or
9respiratory monitoring activity exhibited to the contrary
10is a false artifact. For the purposes of this section,
11“life-sustaining procedure” means the same as defined in section
12144A.2.
13EXPLANATION
14The inclusion of this explanation does not constitute agreement with
15the explanation’s substance by the members of the general assembly.
   16This bill provides that a court of law or equity shall not
17have the authority to require the withdrawal of life-sustaining
18procedures from a minor child over the objection of the minor
19child’s parent or guardian, unless there is conclusive medical
20evidence that the minor child has died and any electronic
21brain, heart, or respiratory monitoring activity exhibited to
22the contrary is a false artifact. For the purposes of the
23bill, “life-sustaining procedure” means the same as under the
24life-sustaining procedures Act (Code chapter 144A).
