2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 622.69, subsection 1, Code 2019, is
2amended to read as follows:
   31.  Witnesses shall receive ten dollars for each full day’s
4attendance, and five dollars for each attendance less than a
5full day, and mileage expenses pursuant to section 602.1509
6reimbursement for actual and necessary expenses incurred for
7each mile actually traveled in the performance of duties, not
8to exceed a maximum rate established by the supreme court
.
 9The supreme court shall prescribe procedures to establish the
10maximum rate, terms, and conditions for reimbursement of the
11expenses.

12   Sec. 2.  Section 819.3, unnumbered paragraph 1, Code 2019,
13is amended to read as follows:
   14A witness named in an order described in section 819.2 is
15entitled to ten cents per mile reimbursement of the actual
16and necessary expenses incurred
for each mile traveled by the
17most direct route to and from the proceedings the witness is
18required to attend, not to exceed a maximum rate established
19by the supreme court,
and is also entitled to ten dollars per
20day for each day spent in such travel or in attending the
21proceedings as a witness. The supreme court shall prescribe
22procedures to establish the maximum rate, terms, and conditions
23for reimbursement of the expenses.

24EXPLANATION
25The inclusion of this explanation does not constitute agreement with
26the explanation’s substance by the members of the general assembly.
   27This bill relates to reimbursement of witness mileage
28expenses. The bill amends Code section 622.69 (witness fees)
29to provide that a witness no longer receives mileage expenses
30pursuant to Code section 602.1509, but instead receives
31reimbursement for actual and necessary expenses incurred for
32each mile actually traveled in the performance of duties, not
33to exceed a maximum rate established by the supreme court. The
34bill provides that the supreme court shall prescribe procedures
35to establish the maximum rate, terms, and conditions for

   2The bill also amends Code section 819.3 (fees and
3enforcement of order) to provide that a witness named in an
4order described in Code section 819.2 (witnesses from another
5state required to testify in this state) is no longer entitled
6to 10 cents per mile but rather to reimbursement of the actual
7and necessary expenses incurred for each mile traveled by the
8most direct route to and from the proceeding the witness is
9required to attend, not to exceed the maximum rate established
10by the supreme court. Additionally, the bill provides that
11the supreme court shall prescribe procedures to establish the
12maximum rate, terms, and conditions for reimbursement of the
13expenses.
