2emissions from a diesel-powered motor vehicle, and providing
3penalties.
4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  321.371A  Discharge of visible
2particulate emissions prohibited.
   3A person operating a diesel-powered motor vehicle on
4a highway shall not knowingly or intentionally cause the
5vehicle to discharge noticeably visible smoke, soot, or other
6particulate emissions onto another motor vehicle, a person
7riding a bicycle, or a pedestrian. This section does not
8apply to a diesel-powered motor vehicle with a gross weight
9of ten thousand pounds or more, a commercial motor vehicle,
10a construction vehicle operating at a construction site, a
11self-propelled implement of husbandry, or a farm tractor,
12or when the discharge of smoke, soot, or other particulate
13emissions is the result of normal acceleration or towing.
14   Sec. 2.  Section 805.8A, subsection 14, Code 2019, is amended
15by adding the following new paragraph:
16   NEW PARAGRAPH.  m.  Discharge of visible particulate emissions
17violations.
  For violations under section 321.371A, the
18scheduled fine is one hundred dollars.
19EXPLANATION
20The inclusion of this explanation does not constitute agreement with
21the explanation’s substance by the members of the general assembly.
   22This bill prohibits a person operating a diesel-powered
23motor vehicle from knowingly or intentionally causing the
24vehicle to discharge noticeably visible smoke, soot, or other
25particulate emissions onto another motor vehicle, a person
26riding a bicycle, or a pedestrian. The bill does not apply to
27a diesel-powered motor vehicle with a gross weight of 10,000
28pounds or more, a commercial motor vehicle, a construction
29vehicle operating at a construction site, a self-propelled
30implement of husbandry, or a farm tractor, or when the
31discharge of smoke, soot, or other particulate emissions is the
32result of normal acceleration or towing. A violation of the
33bill is punishable by a scheduled fine of $100.
