3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 8A.311, subsection 10, paragraph a, Code
22019, is amended to read as follows:
   3a.  The director shall adopt rules providing that any state
4agency may, upon request and approval by the department,
5purchase directly from a vendor if the direct purchasing is
6more economical than purchasing through the department, if the
7agency shows that direct purchasing by the state agency would
8be in the best interests of the state due to an immediate or
9emergency need, or if the purchase will not exceed ten thousand
10dollars
 an amount, not to exceed twenty-five thousand dollars,
11determined by the department by rule
and the purchase would
12contribute to the agency complying with the targeted small
13business procurement goals under sections 73.15 through 73.21.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill concerns state purchasing requirements relating to
18targeted small business procurement goals. The bill provides
19that any state agency, with approval by the department of
20administrative services, may purchase directly from a vendor if
21the direct purchasing would contribute to the agency complying
22with the targeted small business procurement goals and will
23not exceed an amount, not to exceed $25,000, determined by the
24department by rule. Current law allows the direct purchase to
25comply with targeted small business procurement goals if the
26amount does not exceed $10,000.
