3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  915.36A  Minor prosecuting witness
2— pretrial contact.
   3A prosecuting witness who is a minor, as defined in section
4599.1, in a criminal case involving a public offense or a
5delinquent act, other than a simple misdemeanor, shall have the
6right to refuse a pretrial interview, pretrial deposition, or
7any other discovery request involving direct contact with the
8defendant.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill relates to pretrial contact between a prosecuting
13witness who is a minor and the defendant.
   14The bill provides that a prosecuting witness who is a
15minor, as defined in Code section 599.1, in a criminal case
16involving a public offense or a delinquent act, other than a
17simple misdemeanor, shall have the right to refuse a pretrial
18interview, pretrial deposition, or any other discovery request
19involving direct contact with the defendant.
