4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2FY 2019-2020
3APPROPRIATIONS
4   Section 1.  DEPARTMENT OF JUSTICE.
   51.  There is appropriated from the general fund of the state
6to the department of justice for the fiscal year beginning July
71, 2019, and ending June 30, 2020, the following amounts, or
8so much thereof as is necessary, to be used for the purposes
9designated:
   10a.  For the general office of attorney general for salaries,
11support, maintenance, and miscellaneous purposes, including
12the prosecuting attorneys training program, matching funds
13for federal violence against women grant programs, victim
14assistance grants, office of drug control policy prosecuting
15attorney program, and odometer fraud enforcement:

   17As a condition of receiving the appropriation provided
18in this lettered paragraph, the department of justice shall
19maintain a record of the estimated time incurred representing
20each agency or department.
   21b.  For victim assistance grants:

   23The moneys appropriated in this lettered paragraph shall be
24used to provide grants to care providers providing services to
25crime victims of domestic abuse or to crime victims of rape and
26sexual assault.
   27The balance of the victim compensation fund established
28in section 915.94 may be used to provide salary and support
29of not more than 24.00 full-time equivalent positions and to
30provide maintenance for the victim compensation functions
31of the department of justice. In addition to the full-time
32equivalent positions authorized pursuant to this paragraph,
335.00 full-time equivalent positions are authorized and shall
34be used by the department of justice to employ one accountant
35and four program planners. The department of justice may
-1-1employ the additional 5.00 full-time equivalent positions
2authorized pursuant to this paragraph that are in excess of the
3number of full-time equivalent positions authorized only if
4the department of justice receives sufficient federal moneys
5to maintain employment for the additional full-time equivalent
6positions during the fiscal year beginning July 1, 2019. The
7department of justice shall only employ the additional 5.00
8full-time equivalent positions in succeeding fiscal years if
9sufficient federal moneys are received during each of those
10succeeding fiscal years.
   11The department of justice shall transfer at least $150,000
12from the victim compensation fund established in section 915.94
13to the victim assistance grant program.
   14Notwithstanding section 8.33, moneys appropriated in this
15paragraph “b” that remain unencumbered or unobligated at the
16close of the fiscal year shall not revert but shall remain
17available for expenditure for the purposes designated until the
18close of the succeeding fiscal year.
   19c.  For legal services for persons in poverty grants as
20provided in section 13.34:

   22d.  The general office of attorney general may temporarily
23exceed and draw more than the amount appropriated in this
24subsection and incur a negative cash balance as long as there
25are receivables equal to or greater than the negative balance
26and the amount appropriated in this subsection is not exceeded
27at the close of the fiscal year.
   282.  a.  The department of justice, in submitting budget
29estimates for the fiscal year commencing July 1, 2020, pursuant
30to section 8.23, shall include a report of funding from sources
31other than amounts appropriated directly from the general fund
32of the state to the department of justice or to the office of
33consumer advocate. These funding sources shall include but
34are not limited to reimbursements from other state agencies,
35commissions, boards, or similar entities, and reimbursements
-2-1from special funds or internal accounts within the department
2of justice. The department of justice shall also report actual
3reimbursements for the fiscal year commencing July 1, 2019,
4and actual and expected reimbursements for the fiscal year
5commencing July 1, 2020.
   6b.  The department of justice shall include the report
7required under paragraph “a”, as well as information regarding
8any revisions occurring as a result of reimbursements actually
9received or expected at a later date, in a report to the
10co-chairpersons and ranking members of the joint appropriations
11subcommittee on the justice system and the legislative services
12agency. The department of justice shall submit the report on
13or before January 15, 2021.
   143.  a.  The department of justice shall fully reimburse
15the costs and necessary related expenses incurred by the Iowa
16law enforcement academy to continue to employ one additional
17instructor position who shall provide training for human
18trafficking-related issues throughout the state.
   19b.  The department of justice shall obtain the moneys
20necessary to reimburse the Iowa law enforcement academy to
21employ such an instructor from unrestricted moneys from either
22the victim compensation fund established in section 915.94, the
23human trafficking victim fund established in section 915.95, or
24the human trafficking enforcement fund established in 2015 Iowa
25Acts, chapter 138, section 141.
26   Sec. 2.  OFFICE OF CONSUMER ADVOCATE.  There is appropriated
27from the department of commerce revolving fund created in
28section 546.12 to the office of consumer advocate of the
29department of justice for the fiscal year beginning July 1,
302019, and ending June 30, 2020, the following amount, or so
31much thereof as is necessary, to be used for the purposes
32designated:

6facility, including salaries, support, maintenance, and
7miscellaneous purposes:

   202.  The department of corrections shall use moneys
21appropriated in subsection 1 to continue to contract for the
22services of a Muslim imam and a Native American spiritual
23leader.
24   Sec. 4.  DEPARTMENT OF CORRECTIONS — ADMINISTRATION.
   25There is appropriated from the general fund of the state to the
26department of corrections for the fiscal year beginning July
271, 2019, and ending June 30, 2020, the following amounts, or
28so much thereof as is necessary, to be used for the purposes
29designated:
   301.  For general administration, including salaries and the
31adjustment of salaries throughout the department, support,
32maintenance, employment of an education director to administer
33a centralized education program for the correctional system,
34and miscellaneous purposes:

   1a.  It is the intent of the general assembly that each
2lease negotiated by the department of corrections with a
3private corporation for the purpose of providing private
4industry employment of inmates in a correctional institution
5shall prohibit the private corporation from utilizing inmate
6labor for partisan political purposes for any person seeking
7election to public office in this state and that a violation
8of this requirement shall result in a termination of the lease
9agreement.
   10b.  It is the intent of the general assembly that as a
11condition of receiving the appropriation provided in this
12subsection the department of corrections shall not enter into
13a lease or contractual agreement pursuant to section 904.809
14with a private corporation for the use of building space for
15the purpose of providing inmate employment without providing
16that the terms of the lease or contract establish safeguards to
17restrict, to the greatest extent feasible, access by inmates
18working for the private corporation to personal identifying
19information of citizens.
   202.  For educational programs for inmates at state penal
21institutions:

   23a.  To maximize the funding for educational programs,
24the department shall establish guidelines and procedures to
25prioritize the availability of educational and vocational
26training for inmates based upon the goal of facilitating an
27inmate’s successful release from the correctional institution.
   28b.  The director of the department of corrections may
29transfer moneys from Iowa prison industries and the canteen
30operating funds established pursuant to section 904.310, for
31use in educational programs for inmates.
   32c.  Notwithstanding section 8.33, moneys appropriated in
33this subsection that remain unobligated or unexpended at the
34close of the fiscal year shall not revert but shall remain
35available to be used only for the purposes designated in this
-6-1subsection until the close of the succeeding fiscal year.
   23.  For the development and operation of the Iowa corrections
3offender network (ICON) data system:

8   Sec. 5.  JUDICIAL DISTRICT DEPARTMENTS OF CORRECTIONAL
9SERVICES.
   101.  There is appropriated from the general fund of the state
11to the department of corrections for the fiscal year beginning
12July 1, 2019, and ending June 30, 2020, for salaries, support,
13maintenance, and miscellaneous purposes, the following amounts,
14or so much thereof as is necessary, to be used for the purposes
15designated:
   16a.  For the first judicial district department of
17correctional services:

   19It is the intent of the general assembly that the first
20judicial district department of correctional services maintain
21the drug courts operated by the district department.

4judicial district department of correctional services maintain
5the drug court operated by the district department.
   6f.  For the sixth judicial district department of
7correctional services:

   9It is the intent of the general assembly that the sixth
10judicial district department of correctional services maintain
11the drug court operated by the district department.
   12g.  For the seventh judicial district department of
13correctional services:

   15It is the intent of the general assembly that the seventh
16judicial district department of correctional services maintain
17the drug court operated by the district department.
   18h.  For the eighth judicial district department of
19correctional services:

   212.  Each judicial district department of correctional
22services, within the funding available, shall continue programs
23and plans established within that district to provide for
24intensive supervision, sex offender treatment, diversion of
25low-risk offenders to the least restrictive sanction available,
26job development, and expanded use of intermediate criminal
27sanctions.
   283.  Each judicial district department of correctional
29services shall provide alternatives to prison consistent with
30chapter 901B. The alternatives to prison shall ensure public
31safety while providing maximum rehabilitation to the offender.
32A judicial district department of correctional services may
33also establish a day program.
   344.  The governor’s office of drug control policy shall
35consider federal grants made to the department of corrections
-8-1for the benefit of each of the eight judicial district
2departments of correctional services as local government
3grants, as defined pursuant to federal regulations.
   45.  The department of corrections shall continue to contract
5with a judicial district department of correctional services to
6provide for the rental of electronic monitoring equipment which
7shall be available statewide.
8   Sec. 6.  DEPARTMENT OF CORRECTIONS — REALLOCATION OF
9APPROPRIATIONS.
  Notwithstanding section 8.39, within the
10moneys appropriated in this division of this Act to the
11department of corrections, the department may reallocate the
12moneys appropriated and allocated as necessary to best fulfill
13the needs of the correctional institutions, administration
14of the department, and the judicial district departments of
15correctional services. However, in addition to complying with
16the requirements of sections 904.116 and 905.8 and providing
17notice to the legislative services agency, the department
18of corrections shall also provide notice to the department
19of management, prior to the effective date of the revision
20or reallocation of an appropriation made pursuant to this
21section. The department of corrections shall not reallocate an
22appropriation or allocation for the purpose of eliminating any
23program.
24   Sec. 7.  INTENT — REPORTS.
   251.  The department of corrections in cooperation with
26townships, the Iowa cemetery associations, and other nonprofit
27or governmental entities may use inmate labor during the
28fiscal year beginning July 1, 2019, to restore or preserve
29rural cemeteries and historical landmarks. The department in
30cooperation with the counties may also use inmate labor to
31clean up roads, major water sources, and other water sources
32around the state.
   332.  On a quarterly basis the department shall provide a
34status report regarding private-sector employment to the
35legislative services agency beginning on July 1, 2019. The
-9-1report shall include the number of offenders employed in the
2private sector, the combined number of hours worked by the
3offenders, the total amount of allowances, and the distribution
4of allowances pursuant to section 904.702, including any moneys
5deposited in the general fund of the state.
6   Sec. 8.  ELECTRONIC MONITORING REPORT.  The department of
7corrections shall submit a report on electronic monitoring to
8the general assembly, to the co-chairpersons and the ranking
9members of the joint appropriations subcommittee on the justice
10system, and to the legislative services agency by January
1115, 2020. The report shall specifically address the number
12of persons being electronically monitored and break down the
13number of persons being electronically monitored by offense
14committed. The report shall also include a comparison of any
15data from the prior fiscal year with the current year.
16   Sec. 9.  STATE AGENCY PURCHASES FROM PRISON INDUSTRIES.
   171.  As used in this section, unless the context otherwise
18requires, “state agency” means the government of the state
19of Iowa, including but not limited to all executive branch
20departments, agencies, boards, bureaus, and commissions, the
21judicial branch, the general assembly and all legislative
22agencies, institutions within the purview of the state board of
23regents, and any corporation whose primary function is to act
24as an instrumentality of the state.
   252.  State agencies are encouraged to purchase products from
26Iowa state industries, as defined in section 904.802, when
27purchases are required and the products are available from
28Iowa state industries. State agencies shall obtain bids from
29Iowa state industries for purchases of office furniture during
30the fiscal year beginning July 1, 2019, exceeding $5,000 or
31in accordance with applicable administrative rules related to
32purchases for the agency.
33   Sec. 10.  IOWA LAW ENFORCEMENT ACADEMY.
   341.  There is appropriated from the general fund of the
35state to the Iowa law enforcement academy for the fiscal year
-10-1beginning July 1, 2019, and ending June 30, 2020, the following
2amount, or so much thereof as is necessary, to be used for the
3purposes designated:
   4a.  (1)  For salaries, support, maintenance, and
5miscellaneous purposes, including jailer training and technical
6assistance:

   8(2)  For the costs associated with temporary relocation of
9the Iowa law enforcement academy:

   11b.  The Iowa law enforcement academy may temporarily exceed
12and draw more than the amount appropriated in this subsection
13and incur a negative cash balance as long as there are
14receivables equal to or greater than the negative balance and
15the amount appropriated in this subsection is not exceeded at
16the close of the fiscal year.
   172.  The Iowa law enforcement academy may select at least
18five automobiles of the department of public safety, division
19of state patrol, prior to turning over the automobiles to
20the department of administrative services to be disposed
21of by public auction, and the Iowa law enforcement academy
22may exchange any automobile owned by the academy for each
23automobile selected if the selected automobile is used in
24training law enforcement officers at the academy. However, any
25automobile exchanged by the academy shall be substituted for
26the selected vehicle of the department of public safety and
27sold by public auction with the receipts being deposited in the
28depreciation fund to the credit of the department of public
29safety, division of state patrol.
   303.  The Iowa law enforcement academy shall provide training
31for domestic abuse and human trafficking-related issues
32throughout the state. The training shall be offered at no
33cost to the attendees and the training shall not replace any
34existing domestic abuse or human trafficking training offered
35by the academy.

3defender of the department of inspections and appeals for the
4fiscal year beginning July 1, 2019, and ending June 30, 2020,

5to the department of homeland security and emergency management
6for the fiscal year beginning July 1, 2019, and ending June
730, 2020, the following amounts, or so much thereof as is
8necessary, to be used for the purposes designated:
   9a.  For salaries, support, maintenance, and miscellaneous
10purposes:

   152.  The department of homeland security and emergency
16management may temporarily exceed and draw more than the amount

19greater than the negative balance and the amount appropriated
20in this section is not exceeded at the close of the fiscal
21year.
22   Sec. 15.  DEPARTMENT OF PUBLIC SAFETY.  There is appropriated
23from the general fund of the state to the department of public
24safety for the fiscal year beginning July 1, 2019, and ending
25June 30, 2020, the following amounts, or so much thereof as is
26necessary, to be used for the purposes designated:
   271.  For administrative functions, including salaries and
28the adjustment of salaries, throughout the department and the
29criminal justice information system:

   312.  For the division of criminal investigation, including
32the state’s contribution to the peace officers’ retirement,
33accident, and disability system provided in chapter 97A in the
34amount of the state’s normal contribution rate, as defined in

   3a.  As a condition of the appropriation in this subsection,
4the division of criminal investigation shall expend up to
5$200,000 to employ 3.00 full-time equivalent positions to
6assist in expediting the processing and analysis of DNA
7samples.
   8b.  The division of criminal investigation may employ two of
9the three full-time equivalent positions authorized pursuant to
10paragraph “a” only if the division of criminal investigation
11receives sufficient federal moneys to maintain employment for
12the 2.00 full-time equivalent positions during the current
13fiscal year. The division of criminal investigation shall only
14employ the 2.00 full-time equivalent positions in succeeding
15fiscal years if sufficient federal moneys are received during
16each of those succeeding fiscal years.
   173.  For the criminalistics laboratory fund created in
18section 691.9:

26the state’s contribution to the peace officers’ retirement,
27accident, and disability system provided in chapter 97A in the
28amount of the state’s normal contribution rate, as defined in
29section 97A.8, multiplied by the salaries for which the moneys
30are appropriated, to meet federal fund matching requirements:

   32The division of narcotics enforcement may employ 1.00
33full-time equivalent position only if the division of narcotics
34enforcement receives sufficient federal moneys to maintain
35employment for the full-time equivalent position during the

3succeeding fiscal years if sufficient federal moneys are
4received during each of those succeeding fiscal years.
   5b.  For the division of narcotics enforcement for undercover

31receive benefits for accrued sick leave under the collective
32bargaining agreement:

   2a.  Notwithstanding section 8.33, moneys appropriated in
3this subsection that remain unencumbered or unobligated at the
4close of the fiscal year shall not revert but shall remain
5available for expenditure only for the purpose designated in
6this subsection until the close of the succeeding fiscal year.
   7b.  Notwithstanding section 8.39, the department of public
8safety may reallocate moneys appropriated in this section
9as necessary to best fulfill the needs provided for in the
10appropriation. However, the department shall not reallocate
11moneys appropriated to the department in this section unless
12notice of the reallocation is given to the legislative services
13agency and the department of management prior to the effective
14date of the reallocation. The notice shall include information
15regarding the rationale for reallocating the moneys. The
16department shall not reallocate moneys appropriated in this
17section for the purpose of eliminating any program.
   189.  For the public safety interoperable and broadband
19communications fund established in section 80.44:

25   Sec. 16.  GAMING ENFORCEMENT.
   261.  There is appropriated from the gaming enforcement
27revolving fund created in section 80.43 to the department of
28public safety for the fiscal year beginning July 1, 2019, and
29ending June 30, 2020, the following amount, or so much thereof
30as is necessary, to be used for the purposes designated:
   31For any direct support costs for agents and officers of
32the division of criminal investigation’s excursion gambling
33boat, gambling structure, and racetrack enclosure enforcement
34activities, including salaries, support, maintenance, and
35miscellaneous purposes:

   22.  For each additional license to conduct gambling games on
3an excursion gambling boat, gambling structure, or racetrack
4enclosure issued during the fiscal year beginning July 1, 2019,
5there is appropriated from the gaming enforcement fund to the
6department of public safety for the fiscal year beginning July
71, 2019, and ending June 30, 2020, an additional amount of
8not more than $300,000 to be used for full-time equivalent
9positions.
   103.  The department of public safety, with the approval of the

16and four program planners. The department of justice may
17employ the additional 5.00 full-time equivalent positions
18authorized pursuant to this paragraph that are in excess of the
19number of full-time equivalent positions authorized only if
20the department of justice receives sufficient federal moneys
21to maintain employment for the additional full-time equivalent
22positions during the fiscal year beginning July 1, 2020. The
23department of justice shall only employ the additional 5.00
24full-time equivalent positions in succeeding fiscal years if
25sufficient federal moneys are received during each of those
26succeeding fiscal years.
   27The department of justice shall transfer at least $150,000
28from the victim compensation fund established in section 915.94
29to the victim assistance grant program.
   30Notwithstanding section 8.33, moneys appropriated in this
31paragraph “b” that remain unencumbered or unobligated at the

14consumer advocate. These funding sources shall include but
15are not limited to reimbursements from other state agencies,
16commissions, boards, or similar entities, and reimbursements
17from special funds or internal accounts within the department
18of justice. The department of justice shall also report actual
19reimbursements for the fiscal year commencing July 1, 2020,
20and actual and expected reimbursements for the fiscal year
21commencing July 1, 2021.
   22b.  The department of justice shall include the report
23required under paragraph “a”, as well as information regarding
24any revisions occurring as a result of reimbursements actually
25received or expected at a later date, in a report to the
26co-chairpersons and ranking members of the joint appropriations
27subcommittee on the justice system and the legislative services
28agency. The department of justice shall submit the report on
29or before January 15, 2022.
   303.  a.  The department of justice shall fully reimburse
31the costs and necessary related expenses incurred by the Iowa
32law enforcement academy to continue to employ one additional
33instructor position who shall provide training for human
34trafficking-related issues throughout the state.
   35b.  The department of justice shall obtain the moneys

2employ such an instructor from unrestricted moneys from either
3the victim compensation fund established in section 915.94, the

19private corporation for the purpose of providing private

23election to public office in this state and that a violation
24of this requirement shall result in a termination of the lease
25agreement.
   26b.  It is the intent of the general assembly that as a
27condition of receiving the appropriation provided in this
28subsection the department of corrections shall not enter into
29a lease or contractual agreement pursuant to section 904.809
30with a private corporation for the use of building space for
31the purpose of providing inmate employment without providing
32that the terms of the lease or contract establish safeguards to
33restrict, to the greatest extent feasible, access by inmates
34working for the private corporation to personal identifying
35information of citizens.

   103.  Each judicial district department of correctional
11services shall provide alternatives to prison consistent with
12chapter 901B. The alternatives to prison shall ensure public
13safety while providing maximum rehabilitation to the offender.
14A judicial district department of correctional services may
15also establish a day program.
   164.  The governor’s office of drug control policy shall
17consider federal grants made to the department of corrections
18for the benefit of each of the eight judicial district
19departments of correctional services as local government
20grants, as defined pursuant to federal regulations.
   215.  The department of corrections shall continue to contract
22with a judicial district department of correctional services to
23provide for the rental of electronic monitoring equipment which
24shall be available statewide.
25   Sec. 26.  DEPARTMENT OF CORRECTIONS — REALLOCATION OF
26APPROPRIATIONS.
  Notwithstanding section 8.39, within the
27moneys appropriated in this division of this Act to the
28department of corrections, the department may reallocate the
29moneys appropriated and allocated as necessary to best fulfill
30the needs of the correctional institutions, administration
31of the department, and the judicial district departments of
32correctional services. However, in addition to complying with
33the requirements of sections 904.116 and 905.8 and providing
34notice to the legislative services agency, the department
35of corrections shall also provide notice to the department
-27-1of management, prior to the effective date of the revision
2or reallocation of an appropriation made pursuant to this
3section. The department of corrections shall not reallocate an
4appropriation or allocation for the purpose of eliminating any
5program.
6   Sec. 27.  INTENT — REPORTS.
   71.  The department of corrections in cooperation with
8townships, the Iowa cemetery associations, and other nonprofit
9or governmental entities may use inmate labor during the
10fiscal year beginning July 1, 2020, to restore or preserve
11rural cemeteries and historical landmarks. The department in
12cooperation with the counties may also use inmate labor to
13clean up roads, major water sources, and other water sources
14around the state.
   152.  On a quarterly basis the department shall provide a
16status report regarding private-sector employment to the
17legislative services agency beginning on July 1, 2020. The
18report shall include the number of offenders employed in the
19private sector, the combined number of hours worked by the
20offenders, the total amount of allowances, and the distribution
21of allowances pursuant to section 904.702, including any moneys
22deposited in the general fund of the state.
23   Sec. 28.  ELECTRONIC MONITORING REPORT.  The department of
24corrections shall submit a report on electronic monitoring to
25the general assembly, to the co-chairpersons and the ranking
26members of the joint appropriations subcommittee on the justice
27system, and to the legislative services agency by January
2815, 2021. The report shall specifically address the number
29of persons being electronically monitored and break down the
30number of persons being electronically monitored by offense
31committed. The report shall also include a comparison of any
32data from the prior fiscal year with the current year.
33   Sec. 29.  STATE AGENCY PURCHASES FROM PRISON INDUSTRIES.
   341.  As used in this section, unless the context otherwise
35requires, “state agency” means the government of the state
-28-1of Iowa, including but not limited to all executive branch
2departments, agencies, boards, bureaus, and commissions, the
3judicial branch, the general assembly and all legislative
4agencies, institutions within the purview of the state board of
5regents, and any corporation whose primary function is to act
6as an instrumentality of the state.
   72.  State agencies are encouraged to purchase products from
8Iowa state industries, as defined in section 904.802, when
9purchases are required and the products are available from
10Iowa state industries. State agencies shall obtain bids from
11Iowa state industries for purchases of office furniture during
12the fiscal year beginning July 1, 2020, exceeding $5,000 or
13in accordance with applicable administrative rules related to
14purchases for the agency.
15   Sec. 30.  IOWA LAW ENFORCEMENT ACADEMY.
   161.  There is appropriated from the general fund of the
17state to the Iowa law enforcement academy for the fiscal year
18beginning July 1, 2020, and ending June 30, 2021, the following
19amount, or so much thereof as is necessary, to be used for the
20purposes designated:
   21a.  (1)  For salaries, support, maintenance, and
22miscellaneous purposes, including jailer training and technical

35five automobiles of the department of public safety, division

2the department of administrative services to be disposed
3of by public auction, and the Iowa law enforcement academy
4may exchange any automobile owned by the academy for each
5automobile selected if the selected automobile is used in
6training law enforcement officers at the academy. However, any
7automobile exchanged by the academy shall be substituted for
8the selected vehicle of the department of public safety and
9sold by public auction with the receipts being deposited in the
10depreciation fund to the credit of the department of public
11safety, division of state patrol.
   123.  The Iowa law enforcement academy shall provide training
13for domestic abuse and human trafficking-related issues
14throughout the state. The training shall be offered at no
15cost to the attendees and the training shall not replace any
16existing domestic abuse or human trafficking training offered
17by the academy.
18   Sec. 31.  STATE PUBLIC DEFENDER.  There is appropriated from
19the general fund of the state to the office of the state public
20defender of the department of inspections and appeals for the

   24b.  Notwithstanding section 8.39, the department of public
25safety may reallocate moneys appropriated in this section
26as necessary to best fulfill the needs provided for in the

28moneys appropriated to the department in this section unless
29notice of the reallocation is given to the legislative services

31date of the reallocation. The notice shall include information

21FIRE SERVICE TRAINING REVOLVING FUND
22   Sec. 44.  Section 100B.4, Code 2019, is amended to read as
23follows:
   24100B.4  Fees — retention — use — fund.
   251.  Fees assessed pursuant to this chapter shall be retained
26by the division of state fire marshal and such repayments
27received shall be used exclusively to offset the cost of
28fire service training. Fees charged by regional emergency
29response training centers for fire service training programs as
30described in section 100B.6 shall not be greater than the fee
31schedule established by rule by the state fire marshal.
   322.  Notwithstanding section 8.33, repayment receipts
33collected by the division of state fire marshal for the fire
34service training bureau that remain unencumbered or unobligated
35at the close of the fiscal year shall not revert but shall
-38-1remain available for expenditure for the purposes designated
2until the close of the succeeding fiscal year.
   33.  A fire service training revolving fund is created in the
4state treasury under the control of the department of public
5safety. The fund shall consist of fees assessed pursuant to
6this section, and deposited into the fire service training
7revolving fund. All moneys in the fund are appropriated to
8the department of public safety for purposes of fire service
9training and shall be under the control of the state fire
10marshal. Notwithstanding section 8.33, moneys in the fund
11that remain unencumbered or unobligated at the close of a
12fiscal year shall not revert but shall remain available for
13expenditures for the purposes designated until the close of
14the succeeding fiscal year. Notwithstanding section 12C.7,
15subsection 2, interest or earnings on moneys in the fund shall
16be credited to the fund.
17   Sec. 45.  EFFECTIVE DATE.  This division of this Act, being
18deemed of immediate importance, takes effect upon enactment.
19   Sec. 46.  RETROACTIVE APPLICABILITY.  This division of this
20Act applies retroactively to July 1, 2018.
21DIVISION V
22DEPARTMENT OF CORRECTIONS
23   Sec. 47.  DEPARTMENT OF CORRECTIONS.  Notwithstanding
24sections 8.33 and 8.39, the department of corrections may use
25any general fund resources appropriated to the department
26for the fiscal year beginning July 1, 2018, and ending June
2730, 2019, for the resolution of the settlement agreement
28with the division of labor services to the amended citation
29P1582-1281728 dated October 18, 2018; requiring the department
30to remedy citation 1(a) by providing adequate means of
31communication for employees to summon assistance during violent
32attacks, which must be abated by March 1, 2019.
33   Sec. 48.  EFFECTIVE DATE.  This division of this Act, being
34deemed of immediate importance, takes effect upon enactment.

   3This bill relates to and makes appropriations to the justice
4system. The bill is organized by divisions.
   5FY 2019-2020 APPROPRIATIONS. The bill makes appropriations
6from the general fund of the state for fiscal year 2019-2020 to
7the departments of justice, corrections, public defense, public
8safety, and homeland security and emergency management, and
9the Iowa law enforcement academy, office of the state public
10defender, board of parole, Iowa state civil rights commission,
11and the criminal and juvenile justice planning division of the
12department of human rights.
   13The bill appropriates moneys from the consumer education and
14litigation fund to the department of justice for farm mediation
15services for fiscal year 2019-2020.
   16The bill appropriates moneys from the department of commerce
17revolving fund to the office of consumer advocate of the
18department of justice for fiscal year 2019-2020.
   19The bill also appropriates moneys from the gaming
20enforcement revolving fund to the department of public safety
21for fiscal year 2019-2020.
   22The bill appropriates moneys from the wireless E911
23emergency communications fund to the department of homeland
24security and emergency management for fiscal year 2019-2020.
   25The bill provides that moneys appropriated to the veterans
26trust fund established in Code section 35A.13 may be used, upon
27a majority vote of the commission of veterans affairs, for
28expenses related to survivor outreach supported by the Iowa
29department of public defense.
   30FY 2020-2021 APPROPRIATIONS. The bill makes appropriations
31from the general fund of the state for fiscal year 2020-2021 to
32the departments of justice, corrections, public defense, public
33safety, and homeland security and emergency management, and
34the Iowa law enforcement academy, office of the state public
35defender, board of parole, Iowa state civil rights commission,

2department of human rights.
   3The bill appropriates moneys from the department of commerce
4revolving fund to the office of consumer advocate of the
5department of justice for fiscal year 2020-2021.
   6The bill also appropriates moneys from the gaming

8for fiscal year 2020-2021.
   9The bill appropriates moneys from the wireless E911

19appropriates moneys to the state public defender and the Iowa
