3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 481A.78, Code 2019, is amended by
2striking the section and inserting in lieu thereof the
3following:
4481A.78 Stocking private water.
5The commission shall not stock a private pond or lake.
6However, the commission may stock a creek or stream flowing
7through private property.
8 Sec. 2. NEW SECTION. 483A.6C Fishing license not required
9on private pond.
10No fishing license is required to fish on an entirely
11land-locked private pond that is not located on a natural
12stream channel or otherwise connected via surface waters to
13waters of the state.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
17This bill prohibits the environmental protection commission
18from stocking a private lake or pond. Current law allows the
19commission to stock private waters with permission of the owner
20under certain conditions.
21The bill also allows a person to fish without a license on
22an entirely land-locked private pond that is not located on
23a natural stream channel or otherwise connected via surface
24waters to waters of the state.
