3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  476.49  Siting of wind energy
2conversion facilities.
   31.  A wind energy conversion facility installed on or after
4the effective date of this Act which has a nameplate capacity
5of five hundred kilowatts or greater shall be sited no less
6than two thousand five hundred feet from any residential
7property abutting the wind energy conversion property on which
8such facility is located.
   92.  For purposes of this section:
   10a.  “Wind energy conversion facility” means the same as
11defined in section 476C.1.
   12b.  “Wind energy conversion property” means the same as
13defined in section 427B.26.
14EXPLANATION
15The inclusion of this explanation does not constitute agreement with
16the explanation’s substance by the members of the general assembly.
   17This bill requires wind energy conversion facilities
18installed on or after the effective date of the bill which have
19a nameplate capacity of 500 kilowatts or greater to be sited
20no less than 2,500 feet from any residential property abutting
21the wind energy conversion property on which the facility is
22located. The bill defines “wind energy conversion facility”
23to mean a wind energy conversion system in Iowa that collects
24and converts wind into energy to generate electricity. “Wind
25energy conversion property” is defined as the entire wind
26plant, including but not limited to a wind charger, windmill,
27wind turbine, tower and electrical equipment, pad mount
28transformers, power lines, and substation.
