3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 455B.172, Code 2019, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  2A.  The department shall prohibit the
4addition of hydrofluorosilicic acid or any other fluoride-based
5additive in all public water supply systems.
6   Sec. 2.  Section 455B.172, subsection 3, Code 2019, is
7amended to read as follows:
   83.  a.  Each county board of health shall adopt standards for
9private water supplies and private sewage disposal facilities.
10These standards shall be at least as stringent but consistent
11with the standards adopted by the commission. If a county
12board of health has not adopted standards for private water
13supplies and private sewage disposal facilities, the standards
14adopted by the commission shall be applied and enforced within
15the county by the county board of health.
   16b.  Each county board of health shall prohibit the addition
17of hydrofluorosilicic acid or any other fluoride-based additive
18in a private water supply. Standards adopted pursuant to
19paragraph “a” of this subsection shall not allow for an amount
20of hydrofluorosilicic acid or any other fluoride-based compound
21that is higher than ambient background levels.
22   Sec. 3.  Section 455B.173, subsection 5, Code 2019, is
23amended to read as follows:
   245.  Establish, modify, or repeal rules relating to
25drinking water standards for public water supply systems.
26Such standards shall specify maximum contaminant levels or
27treatment techniques necessary to protect the public health and
28welfare. Standards adopted pursuant to this subsection shall
29not allow for an amount of hydrofluorosilicic acid or another
30fluoride-based compound that is higher than ambient background
31levels.
The drinking water standards must assure compliance
32with federal drinking water standards adopted pursuant to the
33federal Safe Drinking Water Act.
34EXPLANATION
35The inclusion of this explanation does not constitute agreement with

   2This bill prohibits the addition of hydrofluorosilicic acid
3or any other fluoride-based additive into public and private
4drinking water supply systems. The bill requires county boards
5of health to adopt standards for private drinking water supply
6systems that do not allow for an amount of hydrofluorosilicic
7acid or any other fluoride-based compound that is higher
8than ambient background levels. The bill also requires the
9environmental protection commission to adopt standards for
10public drinking water supply systems that do not allow for an
11amount of hydrofluorosilicic acid or any other fluoride-based
12compound that is higher than ambient background levels.
