2BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 142D.2, Code 2019, is amended by adding
2the following new subsections:
3 NEW SUBSECTION. 9A. “Gambling game” means the same as
4defined in section 99F.1.
5 NEW SUBSECTION. 9B. “Gaming floor” means the same as
6defined in section 99F.1.
7 Sec. 2. Section 142D.4, subsection 10, Code 2019, is amended
8to read as follows:
910. Only the portion of the gaming floor of a premises
10licensed pursuant to chapter 99F where smoking is allowed,
11 exclusive of any bar or restaurant located within the gaming
12floor which is an enclosed area and subject to the prohibitions
13of section 142D.3, if the gaming floor is apportioned to
14provide an equal quantity of the type of gambling game
15authorized by the state racing and gaming commission for the
16licensed premises in both an area where smoking is allowed and
17an area where smoking is prohibited, and if smoke from the area
18where smoking is allowed does not infiltrate into the area
19where smoking is prohibited.
20EXPLANATION
21The inclusion of this explanation does not constitute agreement with
22the explanation’s substance by the members of the general assembly.
23This bill relates to smoking on gaming floors. The bill
24amends the exception under the smokefree air Act allowing
25smoking on the gaming floors of the premises licensed
26pursuant to Code chapter 99F (gambling structures, excursion
27gambling boats, and racetracks) to provide that smoking
28is not prohibited only on the portion of the gaming floor
29where smoking is allowed, if the gaming floor is apportioned
30to provide an equal quantity of the type of gambling game
31authorized by the state racing and gaming commission for the
32licensed premises in both an area where smoking is allowed and
33an area where smoking is prohibited, and if smoke from the area
34where smoking is allowed does not infiltrate into the area
35where smoking is prohibited.
