3BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.194, subsection 2, paragraph a,
2subparagraph (2), subparagraph divisions (a) and (b), Code
32019, are amended to read as follows:
   4(a)  Over the most direct and accessible route between
5the licensee’s residence and schools of enrollment or the
6closest school bus stop or public transportation service, and
7between schools of enrollment, for the purpose of attending
8duly scheduled courses of instruction and extracurricular
9activities, provided the driving distance between the point of
10origin and the destination is no more than twenty-five fifty
11 miles.
   12(b)  Over the most direct and accessible route between
13the licensee’s residence or school of enrollment and a site,
14facility, or school that is not the licensee’s school of
15enrollment, for the purpose of participating in extracurricular
16activities conducted at a site, facility, or school designated
17by the licensee’s school of enrollment for the accommodation of
18the school’s extracurricular activities, provided the driving
19distance between the point of origin and the destination is no
20more than twenty-five fifty miles.
21   Sec. 2.  Section 321.194, subsection 3, paragraph f, Code
222019, is amended to read as follows:
   23f.  The driver’s license shall not be issued for purposes
24of attending an accredited nonpublic school if the driving
25distance between the school and the residence of the parent or
26guardian of the student is more than twenty-five fifty miles.
27EXPLANATION
28The inclusion of this explanation does not constitute agreement with
29the explanation’s substance by the members of the general assembly.
   30This bill relates to operating restrictions on, and the
31issuance of, special minor’s driver’s licenses for students
32attending accredited nonpublic schools. Under Code section
33321.194, a special minor’s driver’s license may be issued to
34a student between the ages of 14 and 18 years if the student’s
35school has certified to the department of transportation that
-1-1the student has a special need for the license. A violation of
2Code section 321.194 is punishable by a scheduled fine of $50.
   3OPERATING RESTRICTIONS. For students attending accredited
4nonpublic schools, Code section 321.194 currently limits
5students to operating motor vehicles during the hours of 5:00
6a.m.to 10:00 p.m.over the most direct and accessible route
7between the student’s residence and schools of enrollment
8or the closest school bus stop or public transportation
9service, and between schools of enrollment, for the purpose of
10attending courses and extracurricular activities, and between
11the student’s residence or school of enrollment and a site,
12facility, or school that is not the student’s school, for
13the purpose of participating in extracurricular activities,
14provided the driving distance between the point of origin and
15the destination is no more than 25 miles. The bill increases
16this limitation to no more than 50 miles.
   17LICENSE ISSUANCE. Code section 321.194 prohibits a special
18minor’s driver’s license from being issued to a student for
19purposes of attending an accredited nonpublic school if the
20driving distance between the school and the residence of the
21parent or guardian of the student is more than 25 miles. The
22bill increases this prohibition to more than 50 miles.
