5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 321J.4B, subsection 11, paragraph a,
2subparagraph (2), Code 2019, is amended to read as follows:
3(2) A person convicted of an offense under subsection 2
4shall not purchase or register any motor vehicle during the
5period of impoundment, immobilization, or license revocation,
6unless the person holds a valid temporary restricted license
7issued pursuant to section 321.215 or 321J.20.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
11Under current law, if a person operates a motor vehicle in
12violation of Code section 321J.2 (operating while intoxicated),
13and if convicted, the conviction would be a second or
14subsequent offense, or if a person operates a motor vehicle
15while that person’s driver’s license has been suspended,
16denied, revoked, or barred due to a violation of Code section
17321J.2, the motor vehicle operated by the person may be subject
18to impoundment or immobilization. A person convicted of such
19an offense is prohibited from purchasing or registering any
20motor vehicle during the period of impoundment, immobilization,
21or license revocation. This bill allows a person convicted
22of such an offense to purchase or register any motor vehicle
23during the period of impoundment, immobilization, or license
24revocation, if the person holds a valid temporary restricted
25license.
26By operation of law, a violation of this provision is a
27serious misdemeanor punishable by a fine of at least $315 but
28not to exceed $1,875 and imprisonment not to exceed one year.
