4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 453A.3, Code 2019, is amended by adding
2the following new subsection:
3   NEW SUBSECTION.  3.  The court records of a person for
4a violation of section 453A.2, subsection 2, shall be
5confidential and are not public records, but may be disclosed
6in the same manner as juvenile court records are pursuant to
7section 232.147, subsection 3.
8EXPLANATION
9The inclusion of this explanation does not constitute agreement with
10the explanation’s substance by the members of the general assembly.
   11This bill relates to the confidentiality of court records of
12persons under legal age for cigarette and tobacco violations.
   13Under current law, a person under 18 years of age may not
14smoke, use, possess, purchase, or attempt to purchase any
15tobacco, tobacco products, alternative nicotine products, vapor
16products, or cigarettes. The bill provides that the court
17records of a person who violates this law are confidential and
18are not public records, but may be disclosed in the same manner
19as juvenile court records are pursuant Code section 232.147(3).
20This includes but is not limited to the following: a judge and
21professional staff; the child and child’s counsel; the child’s
22parent, guardian, or custodian; a county attorney; an agency,
23individual, association, facility, or institution responsible
24for the care, treatment, or supervision of the child; persons
25involved in connection with the preparation of a presentence
26report; the state public defender; the department of human
27services; and the department of corrections.
