5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 162.2A, subsection 3, paragraph d, Code
22019, is amended by striking the paragraph.
3EXPLANATION
4The inclusion of this explanation does not constitute agreement with
5the explanation’s substance by the members of the general assembly.
   6BILL’S PROVISION. This bill amends a provision in Code
7chapter 162 which regulates the sale, purchase, housing,
8care, handling, treatment, and transportation of certain
9nonagricultural animals in commercial establishments by the
10department of agriculture and land stewardship (Code section
11162.1). The bill eliminates a requirement that an application
12form for the issuance or renewal of an authorization to
13operate a commercial establishment include the applicant’s
14identification number, which may be a tax identification number
15(Code section 162.2A).
   16BACKGROUND. A commercial establishment includes an animal
17shelter, pound, or research facility operated by a person
18issued a certificate of registration (Code sections 162.3,
19162.4, and 162.4A); a pet shop, boarding kennel, or commercial
20kennel operated by a person issued a state license (Code
21sections 162.5, 162.5A, and 162.6); or a dealer, commercial
22breeder, or public auction operated by a person who is either
23issued a state license or a permit. A permit is issued if the
24person is licensed under the federal Animal Welfare Act (7
25U.S.C. ch.54) by the United States department of agriculture
26(Code sections 162.7, 162.8, and 162.9A).
