Senate File 62 - IntroducedA Bill ForAn Act 1relating to the expiration of a person’s driver’s
2license or nonoperator’s identification card on the
3person’s twenty-first birthday anniversary, and including
4applicability provisions.
5BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  Section 321.189, subsection 6, Code 2019, is
2amended to read as follows:
   36.  Licenses issued to persons under age twenty-one.  A
4driver’s license issued to a person under eighteen years of
5age shall contain the same information as any other driver’s
6license except that the words “under eighteen” shall appear
7prominently on the face of the license. A driver’s license
8issued to a person eighteen years of age or older but less than
9twenty-one years of age shall contain the same information
10as any other driver’s license except that the words “under
11twenty-one” shall appear prominently on the face of the
12license. Upon attaining the age of eighteen or upon attaining
13the age of twenty-one, and upon payment of a ten dollar fee,
14the person shall be entitled to a new driver’s license or
15nonoperator’s identification card for the unexpired months, if
16any,
of the driver’s license or card. An instruction permit or
17intermediate license issued under section 321.180B, subsection
181 or 2, shall include a distinctive color bar. An intermediate
19license issued under section 321.180B, subsection 2, shall
20include the words “intermediate license” printed prominently on
21the face of the license.
22   Sec. 2.  Section 321.190, subsection 1, paragraph d, Code
232019, is amended to read as follows:
   24d.  The fee for a nonoperator’s identification card shall be
25eight dollars and the card shall be valid for a period of eight
26years from the date of issuance, except the card shall be valid
27until the applicant’s twenty-first birthday anniversary if the
28applicant is thirteen years of age or older, but less than
29twenty-one years of age
. If an applicant for a nonoperator’s
30identification card is a foreign national who is temporarily
31present in this state, the nonoperator’s identification card
32shall be issued only for the length of time the foreign
33national is authorized to be present as determined by the
34department, not to exceed two years. An issuance fee shall
35not be charged for a person whose driver’s license or driving
-1-1privilege has been suspended under section 321.210, subsection
21, paragraph “a”, subparagraph (3), or voluntarily surrendered
3by the person in lieu of suspension under section 321.210,
4subsection 1, paragraph “a”.
5   Sec. 3.  Section 321.196, subsection 1, Code 2019, is amended
6to read as follows:
   71.  Except as otherwise provided, if the licensee is between
8the ages of seventeen
 twenty-one years eleven months and of
9age or older, but less than
seventy-two years of age, on the
10date of issuance of the license, a driver’s license, other
11than an instruction permit, chauffeur’s instruction permit,
12or commercial learner’s permit issued under section 321.180,
13expires eight years from the licensee’s birthday anniversary
14occurring in the year of issuance, but not to exceed the
15licensee’s seventy-fourth birthday. If the licensee is under
16the age of seventeen
 less than nineteen years eleven months of
17age
or age seventy-two years of age or over older, the license
18is effective for a period of two years from the licensee’s
19birthday anniversary occurring in the year of issuance. If
20the licensee is nineteen years of age or older, but less than
21twenty-one years of age, the license is effective until the
22licensee’s twenty-first birthday anniversary.
A licensee
23whose license is restricted due to vision or other physical
24deficiencies may be required to renew the license every two
25years. If a licensee is a foreign national who is temporarily
26present in this state, the license shall be issued only for the
27length of time the foreign national is authorized to be present
28as verified by the department, not to exceed two years.
29   Sec. 4.  Section 321.196, subsection 4, paragraph c, Code
302019, is amended to read as follows:
   31c.  The applicant is eligible for license renewal
32electronically, pursuant to rules adopted by the department.
33An applicant shall not be eligible for electronic renewal of
34a driver’s license if the most recent previous renewal of
35the applicant’s driver’s license occurred electronically.
-2- 1However, an applicant whose driver’s license expired or will
2expire on the applicant’s twenty-first birthday anniversary
3shall be eligible for electronic renewal of a driver’s license
4regardless of whether the most recent previous renewal of the
5applicant’s driver’s license occurred electronically.

6   Sec. 5.  APPLICABILITY.  This Act applies to driver’s
7licences and nonoperator’s identification cards issued on or
8after July 1, 2019.
9EXPLANATION
10The inclusion of this explanation does not constitute agreement with
11the explanation’s substance by the members of the general assembly.
   12This bill requires the expiration of a person’s driver’s
13license or nonoperator’s identification card on the person’s
1421st birthday anniversary. The bill specifies that an
15applicant whose driver’s license expired or will expire on
16the applicant’s 21st birthday anniversary is eligible for
17electronic renewal of a driver’s license regardless of whether
18the most recent previous renewal of the applicant’s driver’s
19license occurred electronically. The bill applies to driver’s
20licenses and nonoperator’s identification cards issued on or
21after July 1, 2019. The bill does not alter the periods of
22validity for instruction permits, commercial learner’s permits,
23and chauffeur’s instruction permits under Code section 321.180.
24Operating a motor vehicle with an expired driver’s license is
25punishable by a scheduled fine of $50. However, Code section
26321.196 provides that a person shall not be considered to be
27driving with an invalid license during a period of 60 days
28following the license expiration date.
