House Study Bill 507 - IntroducedA Bill ForAn Act 1relating to the exercise of eminent domain for carbon

4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1 Section 1. Section 6A.22, Code 2026, is amended by adding
2the following new subsection:
3 NEW SUBSECTION. 3. Notwithstanding any other provision of
4law, a person shall not exercise the power of eminent domain to
5acquire right-of-way for, construct, or operate a pipeline for
6the primary purpose of transporting carbon oxide.
7 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate
8importance, takes effect upon enactment.
9 Sec. 3. APPLICABILITY. This Act applies to condemnation
10proceedings for which the application filed under section 6B.3
11is filed on or after the effective date of this Act.
12EXPLANATION
13The inclusion of this explanation does not constitute agreement with
14the explanation’s substance by the members of the general assembly.
15This bill prohibits exercising the power of eminent domain
16for acquiring right-of-way for, constructing, or operating a
17pipeline that has the primary purpose of transporting carbon
18oxide.
19The bill takes effect upon enactment and applies to all
20condemnation proceedings instituted on or after that date.
