4BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1   Section 1.  NEW SECTION.  256E.13  Extracurricular athletic
2activities.
   31.  If a charter school established pursuant to this chapter
4does not offer a particular extracurricular athletic activity,
5a student enrolled in the charter school may participate in the
6extracurricular athletic activity provided by the student’s
7school district of residence as a member of a team from the
8student’s school district of residence.
   92.  If a student participates in an extracurricular athletic
10activity provided by the student’s school district of residence
11pursuant to this section, the student shall be included in the
12school district’s basic enrollment under section 257.6 and
13shall be counted as one-tenth of one pupil for purposes of
14section 257.6.
   153.  The state board may adopt rules pursuant to chapter 17A
16to administer this section.
17   Sec. 2.  Section 257.6, subsection 1, paragraph a, Code 2023,
18is amended by adding the following new subparagraph:
19   NEW SUBPARAGRAPH.  (10)  In addition to subparagraph (9),
20resident pupils enrolled in a charter school under chapter 256E
21who participate in extracurricular athletic activities pursuant
22to section 256E.13 shall be counted as one-tenth of one pupil.
23EXPLANATION
24The inclusion of this explanation does not constitute agreement with
25the explanation’s substance by the members of the general assembly.
   26This bill authorizes students enrolled in charter schools
27to participate in extracurricular athletic activities provided
28by the student’s school district of residence as a member of
29a team from the student’s school district of residence if the
30charter school does not offer the extracurricular athletic
31activity. The bill provides that such students shall be
32included in the school district’s basic enrollment and shall be
33counted as one-tenth of one pupil for school funding purposes.
34The bill also authorizes the state board of education to adopt
35rules to administer this provision.
