Senate Study Bill 1264 - IntroducedA Bill ForAn Act 1relating to and making appropriations to state

7BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
1DIVISION I
2rebuild iowa infrastructure fund
3 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —
4APPROPRIATIONS. There is appropriated from the rebuild Iowa
5infrastructure fund to the following departments and agencies
6for the following fiscal years, the following amounts, or so
7much thereof as is necessary, to be used for the purposes
8designated:
91. DEPARTMENT OF ADMINISTRATIVE SERVICES
10For costs associated with the placement of a monument to
11Martin Treptow on the capitol complex grounds:

142. DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP
15a. (1) For deposit in the water quality initiative fund
16created in section 466B.45 for purposes of supporting the
17water quality initiative administered by the division of soil
18conservation and water quality as provided in section 466B.42,
19including salaries, support, maintenance, and miscellaneous
20purposes, notwithstanding section 8.57, subsection 5, paragraph
21“c”:

24(2) (a) The moneys appropriated in this lettered
25paragraph shall be used to support demonstration projects in
26subwatersheds as designated by the department that are part
27of high-priority watersheds identified by the water resources
28coordinating council.
29(b) The moneys appropriated in this lettered paragraph
30shall be used to support demonstration projects in watersheds
31generally, including regional watersheds, as designated by the
32division and high-priority watersheds identified by the water
33resources coordinating council.
34(3) In supporting projects in watersheds and subwatersheds
35as provided in subparagraph (2), all of the following shall

2(a) The demonstration projects shall utilize water quality
3practices as described in the latest revision of the document
4entitled “Iowa Nutrient Reduction Strategy” initially presented
5in November 2012 by the department of agriculture and land
6stewardship, the department of natural resources, and Iowa
7state university of science and technology.
8(b) The division shall implement demonstration projects
9as provided in subparagraph division (a) by providing
10for participation by persons who hold a legal interest in
11agricultural land used in farming. To every extent practical,
12the division shall provide for collaborative participation by
13such persons who hold a legal interest in agricultural land
14located within the same subwatershed.
15(c) The division shall implement demonstration projects on
16a cost-share basis as determined by the division. Except for
17edge-of-field practices, the state’s share of the amount shall
18not exceed 50 percent of the estimated cost of establishing the
19practice as determined by the division or 50 percent of the
20actual cost of establishing the practice, whichever is less.
21(d) The demonstration projects shall be used to educate
22other persons about the feasibility and value of establishing
23similar water quality practices. The division shall promote
24field day events for purposes of allowing interested persons to
25establish water quality practices on their agricultural land.
26(e) The division shall conduct water quality evaluations
27within supported subwatersheds. Within a reasonable period
28after accumulating information from such evaluations, the
29division shall create an aggregated database of water quality
30practices. Any information identifying a person holding a
31legal interest in agricultural land or specific agricultural
32land shall be a confidential record.
33(4) The moneys appropriated in this lettered paragraph
34shall be used to support education and outreach in a manner
35that encourages persons who hold a legal interest in
-2-1agricultural land used for farming to implement water quality
2practices, including the establishment of such practices in
3watersheds generally, and not limited to subwatersheds or
4high-priority watersheds.
5(5) The moneys appropriated in this lettered paragraph
6may be used to contract with persons to coordinate the
7implementation of efforts provided in this paragraph.
8(6) The moneys appropriated in this lettered paragraph
9may be used by the department to support urban soil and water
10conservation efforts, which may include but are not limited
11to management practices related to bioretention, landscaping,
12the use of permeable or pervious pavement, and soil quality
13restoration. The moneys shall be allocated on a cost-share
14basis as provided in chapter 161A.
15(7) Notwithstanding any other provision of law to the
16contrary, the department may use moneys appropriated in
17this lettered paragraph to carry out the provisions of this
18paragraph on a cost-share basis in combination with other
19moneys available to the department from a state or federal
20source.
21(8) Not more than 10 percent of the moneys appropriated in
22this lettered paragraph may be used for costs of administration
23and implementation of the water quality initiative administered
24by the soil conservation division.
25b. For deposit in the renewable fuels infrastructure fund
26created in section 159A.16 for renewable fuel infrastructure

25miscellaneous provisions
26 Sec. 12. Section 8.57C, subsection 3, Code 2021, is amended
27by adding the following new paragraph:
28 NEW PARAGRAPH. j. There is appropriated from the rebuild
29Iowa infrastructure fund for the fiscal year beginning July 1,
302021, and ending June 30, 2022, the sum of seventeen million
31five hundred thousand dollars to the technology reinvestment
32fund, notwithstanding section 8.57, subsection 5, paragraph
33“c”.
34 Sec. 13. Section 15.261, Code 2021, is amended to read as
35follows:
-15- 115.261 Vacant state buildings demolition fund.
21. A vacant state buildings demolition fund is created in
3the state treasury under the control of the authority. The
4fund shall consist of all moneys appropriated to the fund.
52. Moneys in the vacant state buildings demolition fund
6are appropriated to the authority for purposes of funding a
7grant program for the demolition of vacant buildings owned by
8the state or by a county that has purchased real property from
9the federal government which are no longer used for a state
10or federal purpose. The authority shall give preference to
11applicants that have not previously been awarded money from
12this fund.
133. Notwithstanding section 12C.7, subsection 2, interest
14or earnings on moneys deposited in the vacant state buildings
15demolition fund shall be credited to the vacant state buildings
16demolition fund. Notwithstanding section 8.33, moneys credited
17to the vacant state buildings demolition fund shall not revert
18at the close of a fiscal year.
19 Sec. 14. Section 15.262, Code 2021, is amended to read as
20follows:
2115.262 Vacant state buildings rehabilitation fund.
221. A vacant state buildings rehabilitation fund is created
23in the state treasury under the control of the authority. The
24fund shall consist of all moneys appropriated to the fund.
252. Moneys in the vacant state buildings rehabilitation fund
26are appropriated to the authority for purposes of funding a
27loan program for the rehabilitation or redevelopment of vacant
28buildings owned by the state or by a county that has purchased
29real property from the federal government which are no longer
30used for a state or federal purpose. The authority shall give
31preference to applicants that have not previously been awarded
32money from this fund.
333. Notwithstanding section 12C.7, subsection 2, interest
34or earnings on moneys deposited in the vacant state buildings
35rehabilitation fund shall be credited to the vacant state
-16-1 buildings rehabilitation fund. Notwithstanding section 8.33,
2moneys credited to the vacant state buildings rehabilitation
3fund shall not revert at the close of a fiscal year.
4 Sec. 15. ROUTINE MAINTENANCE FUND. Notwithstanding the
5standing appropriation in section 8A.330, there is appropriated
6from the rebuild Iowa infrastructure fund to the department of
7administrative services for deposit in the routine maintenance
8fund established in section 8A.330 for the fiscal year
9beginning July 1, 2021, the sum of one million dollars.
10DIVISION V
11autism support fund
12 Sec. 16. AUTISM SUPPORT FUND — APPROPRIATION. There is
13appropriated from the autism support fund created in section
14225D.2 to the rebuild Iowa infrastructure fund created in
15section 8.57, for the fiscal year beginning July 1, 2021, and
16ending June 30, 2022, the sum of seven hundred fifty thousand
17dollars, notwithstanding any provision of section 225D.2 to the
18contrary.
19DIVISION VI
20sports tourism program
21 Sec. 17. Section 15F.401, subsection 1, paragraph a, Code
222021, is amended to read as follows:
23a. The authority shall establish, and, at the direction of
24the board, shall administer a sports tourism program to provide
25financial assistance for projects that promote sporting events
26for organizations of accredited colleges and universities,
27professional sporting events, and other sporting events in the
28state.
29 Sec. 18. Section 15F.401, subsection 1, paragraph b,
30subparagraph (3), Code 2021, is amended to read as follows:
31(3) “Organization” means a corporation, conference,
32association, or other organization which has as one of
33its primary purposes the sponsoring or administration
34of extracurricular intercollegiate athletic contests or
35competitions, or professional sporting events.
-17-1 Sec. 19. Section 15F.401, subsection 1, paragraph b, Code
22021, is amended by adding the following new subparagraph:
3 NEW SUBPARAGRAPH. (4) “Professional sporting events” means
4any sporting events for which the competing athletes receive
5payment for their participation in such sporting event.
6 Sec. 20. Section 15F.401, subsection 2, paragraph a, Code
72021, is amended to read as follows:
8a. A city or county in the state or a public entity,
9including a convention and visitors bureau or a district,
10may apply to the authority for financial assistance for a
11project that actively and directly promotes sporting events for
12accredited colleges and universities, professional sporting
13events, and other sporting events in the area served by the

27This bill relates to and makes appropriations to state
28departments and agencies from the rebuild Iowa infrastructure
29fund and the technology reinvestment fund, and provides for
30related matters. The bill is organized by divisions.
31DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
32division appropriates project funding for FY 2021-2022 from
33the rebuild Iowa infrastructure fund for projects for the
34departments of administrative services, agriculture and land
35stewardship, blind, cultural affairs, human services, public
-18-1safety, transportation, and veterans affairs, and for the
2economic development authority, board of regents, and treasurer
3of state. The division also appropriates project funding from
4the rebuild Iowa infrastructure fund for multiple fiscal years
5to the departments of corrections, public defense, and natural
6resources.
7DIVISION II — TECHNOLOGY REINVESTMENT FUND. This
8division appropriates project funding for FY 2021-2022
9from the technology reinvestment fund for the departments
10of corrections, education, homeland security and emergency
11management, human rights, human services, inspections and
12appeals, management, public defense, public safety, revenue,
13and veterans affairs, and for the judicial branch, the office
14of the chief information officer, and for the ethics and
15campaign disclosure board.
16DIVISION III — CHANGES TO PRIOR APPROPRIATIONS. This
17division makes a change to moneys appropriated from the rebuild
18Iowa infrastructure fund to the department of administrative
19services for major maintenance projects, the economic
20development authority for the vacant state buildings demolition
21and rehabilitation funds, the board of regents for projects
22at the Iowa state university of science and technology, and
23the judicial branch for furniture and equipment at certain
24justice centers. The division also makes a change to the
25reversion provision for moneys appropriated from the rebuild
26Iowa infrastructure fund to the department of cultural affairs
27for maintenance projects for the state historical building in
28FY 2017-2018. The division takes effect upon enactment.
29DIVISION IV — MISCELLANEOUS PROVISIONS. Code section
308.57C, concerning the technology reinvestment fund, is amended
31to provide for an appropriation to the fund from the rebuild
32Iowa infrastructure fund for the fiscal year beginning July 1,
332021, of $17.5 million.
34Code section 15.261, concerning the vacant state buildings
35demolition fund, is amended to allow moneys in the fund to be
-19-1used for demolition of vacant buildings purchased by a county
2from the federal government. The Code section is also amended
3to give preference to applicants who have not previously been
4awarded money from the fund.
5Code section 15.262, concerning the vacant state buildings
6rehabilitation fund, is amended to allow moneys in the fund
7to be used for rehabilitation of vacant buildings purchased
8by a county from the federal government. The Code section is
9also amended to give preference to applicants who have not
10previously been awarded money from the fund.
11The bill reduces the standing appropriation from the rebuild
12Iowa infrastructure fund to the routine maintenance fund
13created in Code section 8A.330 for the fiscal year beginning
14July 1, 2021, from $2 million to $1 million.
15DIVISION V — AUTISM SUPPORT FUND. This division
16appropriates moneys from the autism support fund to the rebuild
17Iowa infrastructure fund for FY 2021-2022.
18DIVISION VI — SPORTS TOURISM PROGRAM. Code section
1915F.401, creating the sports tourism program, is amended to
20provide that the program is authorized to provide financial
21assistance for projects that promote professional sporting
22events. The bill further appropriates moneys to the economic
23development authority for the sports tourism program for FY
242021-2022 from the sports wagering receipts fund created in
25Code section 8.57, subsection 6.

34(3) In supporting projects in watersheds and subwatersheds
35as provided in subparagraph (2), all of the following shall

2(a) The demonstration projects shall utilize water quality
3practices as described in the latest revision of the document
4entitled “Iowa Nutrient Reduction Strategy” initially presented
5in November 2012 by the department of agriculture and land
6stewardship, the department of natural resources, and Iowa
7state university of science and technology.
8(b) The division shall implement demonstration projects
9as provided in subparagraph division (a) by providing
10for participation by persons who hold a legal interest in
11agricultural land used in farming. To every extent practical,
12the division shall provide for collaborative participation by
13such persons who hold a legal interest in agricultural land
14located within the same subwatershed.
15(c) The division shall implement demonstration projects on
16a cost-share basis as determined by the division. Except for
17edge-of-field practices, the state’s share of the amount shall
18not exceed 50 percent of the estimated cost of establishing the
19practice as determined by the division or 50 percent of the
20actual cost of establishing the practice, whichever is less.
21(d) The demonstration projects shall be used to educate
22other persons about the feasibility and value of establishing
23similar water quality practices. The division shall promote
24field day events for purposes of allowing interested persons to
25establish water quality practices on their agricultural land.
26(e) The division shall conduct water quality evaluations
27within supported subwatersheds. Within a reasonable period
28after accumulating information from such evaluations, the
29division shall create an aggregated database of water quality
30practices. Any information identifying a person holding a
31legal interest in agricultural land or specific agricultural
32land shall be a confidential record.
33(4) The moneys appropriated in this lettered paragraph
34shall be used to support education and outreach in a manner
35that encourages persons who hold a legal interest in
-2-1agricultural land used for farming to implement water quality
2practices, including the establishment of such practices in
3watersheds generally, and not limited to subwatersheds or
4high-priority watersheds.
5(5) The moneys appropriated in this lettered paragraph
6may be used to contract with persons to coordinate the
7implementation of efforts provided in this paragraph.
8(6) The moneys appropriated in this lettered paragraph
9may be used by the department to support urban soil and water
10conservation efforts, which may include but are not limited
11to management practices related to bioretention, landscaping,
12the use of permeable or pervious pavement, and soil quality
13restoration. The moneys shall be allocated on a cost-share
14basis as provided in chapter 161A.
15(7) Notwithstanding any other provision of law to the
16contrary, the department may use moneys appropriated in
17this lettered paragraph to carry out the provisions of this
18paragraph on a cost-share basis in combination with other
19moneys available to the department from a state or federal
20source.
21(8) Not more than 10 percent of the moneys appropriated in
22this lettered paragraph may be used for costs of administration
23and implementation of the water quality initiative administered

25miscellaneous provisions
26 Sec. 12. Section 8.57C, subsection 3, Code 2021, is amended
27by adding the following new paragraph:
28 NEW PARAGRAPH. j. There is appropriated from the rebuild
29Iowa infrastructure fund for the fiscal year beginning July 1,
302021, and ending June 30, 2022, the sum of seventeen million
31five hundred thousand dollars to the technology reinvestment
32fund, notwithstanding section 8.57, subsection 5, paragraph
33“c”.
34 Sec. 13. Section 15.261, Code 2021, is amended to read as
35follows:
-15- 115.261 Vacant state buildings demolition fund.
21. A vacant state buildings demolition fund is created in
3the state treasury under the control of the authority. The
4fund shall consist of all moneys appropriated to the fund.
52. Moneys in the vacant state buildings demolition fund
6are appropriated to the authority for purposes of funding a
7grant program for the demolition of vacant buildings owned by
8the state or by a county that has purchased real property from
9the federal government which are no longer used for a state
10or federal purpose. The authority shall give preference to
11applicants that have not previously been awarded money from
12this fund.
133. Notwithstanding section 12C.7, subsection 2, interest
14or earnings on moneys deposited in the vacant state buildings
15demolition fund shall be credited to the vacant state buildings
16demolition fund. Notwithstanding section 8.33, moneys credited
17to the vacant state buildings demolition fund shall not revert
18at the close of a fiscal year.
19 Sec. 14. Section 15.262, Code 2021, is amended to read as
20follows:
2115.262 Vacant state buildings rehabilitation fund.
221. A vacant state buildings rehabilitation fund is created
23in the state treasury under the control of the authority. The
24fund shall consist of all moneys appropriated to the fund.
252. Moneys in the vacant state buildings rehabilitation fund
26are appropriated to the authority for purposes of funding a
27loan program for the rehabilitation or redevelopment of vacant
28buildings owned by the state or by a county that has purchased

333. Notwithstanding section 12C.7, subsection 2, interest
34or earnings on moneys deposited in the vacant state buildings
35rehabilitation fund shall be credited to the vacant state

2moneys credited to the vacant state buildings rehabilitation
3fund shall not revert at the close of a fiscal year.
4 Sec. 15. ROUTINE MAINTENANCE FUND. Notwithstanding the
5standing appropriation in section 8A.330, there is appropriated
6from the rebuild Iowa infrastructure fund to the department of
7administrative services for deposit in the routine maintenance
8fund established in section 8A.330 for the fiscal year
9beginning July 1, 2021, the sum of one million dollars.
10DIVISION V
11autism support fund
12 Sec. 16. AUTISM SUPPORT FUND — APPROPRIATION. There is
13appropriated from the autism support fund created in section
14225D.2 to the rebuild Iowa infrastructure fund created in
15section 8.57, for the fiscal year beginning July 1, 2021, and
16ending June 30, 2022, the sum of seven hundred fifty thousand
17dollars, notwithstanding any provision of section 225D.2 to the
18contrary.
19DIVISION VI
20sports tourism program
21 Sec. 17. Section 15F.401, subsection 1, paragraph a, Code
222021, is amended to read as follows:
23a. The authority shall establish, and, at the direction of
24the board, shall administer a sports tourism program to provide
25financial assistance for projects that promote sporting events
26for organizations of accredited colleges and universities,
27professional sporting events, and other sporting events in the
28state.
29 Sec. 18. Section 15F.401, subsection 1, paragraph b,
30subparagraph (3), Code 2021, is amended to read as follows:
31(3) “Organization” means a corporation, conference,
32association, or other organization which has as one of
33its primary purposes the sponsoring or administration
34of extracurricular intercollegiate athletic contests or
35competitions, or professional sporting events.
-17-1 Sec. 19. Section 15F.401, subsection 1, paragraph b, Code
22021, is amended by adding the following new subparagraph:
3 NEW SUBPARAGRAPH. (4) “Professional sporting events” means
4any sporting events for which the competing athletes receive
5payment for their participation in such sporting event.
6 Sec. 20. Section 15F.401, subsection 2, paragraph a, Code
72021, is amended to read as follows:
8a. A city or county in the state or a public entity,
9including a convention and visitors bureau or a district,
10may apply to the authority for financial assistance for a
11project that actively and directly promotes sporting events for
12accredited colleges and universities, professional sporting
13events, and other sporting events in the area served by the
14city, county, or public entity.
15 Sec. 21. SPORTS TOURISM PROGRAM — SPORTS WAGERING RECEIPTS
16FUND. There is appropriated from the sports wagering receipts
17fund created in section 8.57, subsection 6, to the economic
18development authority for the fiscal year beginning July 1,
192021, and ending June 30, 2022, the following amount, or so
20much thereof as is necessary, to be used for the purposes
21designated:

24EXPLANATION
25The inclusion of this explanation does not constitute agreement with
26the explanation’s substance by the members of the general assembly.
27This bill relates to and makes appropriations to state
28departments and agencies from the rebuild Iowa infrastructure
29fund and the technology reinvestment fund, and provides for
30related matters. The bill is organized by divisions.
31DIVISION I — REBUILD IOWA INFRASTRUCTURE FUND. This
32division appropriates project funding for FY 2021-2022 from
33the rebuild Iowa infrastructure fund for projects for the
34departments of administrative services, agriculture and land
35stewardship, blind, cultural affairs, human services, public
-18-1safety, transportation, and veterans affairs, and for the
2economic development authority, board of regents, and treasurer
3of state. The division also appropriates project funding from
4the rebuild Iowa infrastructure fund for multiple fiscal years
5to the departments of corrections, public defense, and natural
6resources.
7DIVISION II — TECHNOLOGY REINVESTMENT FUND. This
8division appropriates project funding for FY 2021-2022
9from the technology reinvestment fund for the departments
10of corrections, education, homeland security and emergency
11management, human rights, human services, inspections and
12appeals, management, public defense, public safety, revenue,
13and veterans affairs, and for the judicial branch, the office
14of the chief information officer, and for the ethics and
15campaign disclosure board.
16DIVISION III — CHANGES TO PRIOR APPROPRIATIONS. This
17division makes a change to moneys appropriated from the rebuild
18Iowa infrastructure fund to the department of administrative
19services for major maintenance projects, the economic
20development authority for the vacant state buildings demolition
21and rehabilitation funds, the board of regents for projects
22at the Iowa state university of science and technology, and
23the judicial branch for furniture and equipment at certain
24justice centers. The division also makes a change to the
25reversion provision for moneys appropriated from the rebuild
26Iowa infrastructure fund to the department of cultural affairs
27for maintenance projects for the state historical building in
28FY 2017-2018. The division takes effect upon enactment.
29DIVISION IV — MISCELLANEOUS PROVISIONS. Code section
308.57C, concerning the technology reinvestment fund, is amended
31to provide for an appropriation to the fund from the rebuild
32Iowa infrastructure fund for the fiscal year beginning July 1,
332021, of $17.5 million.
34Code section 15.261, concerning the vacant state buildings
35demolition fund, is amended to allow moneys in the fund to be
-19-1used for demolition of vacant buildings purchased by a county
2from the federal government. The Code section is also amended
3to give preference to applicants who have not previously been
4awarded money from the fund.
5Code section 15.262, concerning the vacant state buildings
6rehabilitation fund, is amended to allow moneys in the fund
7to be used for rehabilitation of vacant buildings purchased
8by a county from the federal government. The Code section is
9also amended to give preference to applicants who have not
10previously been awarded money from the fund.
11The bill reduces the standing appropriation from the rebuild
12Iowa infrastructure fund to the routine maintenance fund
13created in Code section 8A.330 for the fiscal year beginning
14July 1, 2021, from $2 million to $1 million.
15DIVISION V — AUTISM SUPPORT FUND. This division
16appropriates moneys from the autism support fund to the rebuild
17Iowa infrastructure fund for FY 2021-2022.
18DIVISION VI — SPORTS TOURISM PROGRAM. Code section
1915F.401, creating the sports tourism program, is amended to
20provide that the program is authorized to provide financial
21assistance for projects that promote professional sporting
22events. The bill further appropriates moneys to the economic
23development authority for the sports tourism program for FY
242021-2022 from the sports wagering receipts fund created in
25Code section 8.57, subsection 6.
