  1 14    #2.  By striking page 3, line 11, through page 12,

  1 19    Sec.    .  Section 284.5, subsection 1, Code
  1 20 Supplement 2001, is amended to read as follows:
  1 21    1.  A beginning teacher mentoring and induction
  1 22 program is created to promote excellence in teaching,
  1 23 enhance student achievement, build a supportive
  1 24 environment within school districts, increase the
  1 25 retention of promising beginning teachers, and promote
  1 26 the personal and professional well-being of classroom
  1 27 teachers.  Prior to the completion of the 2001-2002
  1 28 school year If the general assembly appropriates
  1 29 moneys for purposes of implementing a statewide
  1 30 beginning teacher mentoring and induction program, a
  1 31 school district shall, at a minimum, provide an
  1 32 approved beginning teacher mentoring and induction
  1 33 program for all classroom teachers who are beginning
  1 34 teachers.
  1 35    Sec.    .  Section 284.5, subsection 3, Code
  1 36 Supplement 2001, is amended by striking the
  1 37 subsection.
  1 38    Sec.    .  Section 284.5, subsection 6, Code
  1 39 Supplement 2001, is amended to read as follows:
  1 40    6.  Upon completion of the program, the beginning
  1 41 teacher shall be comprehensively evaluated to
  1 42 determine if the teacher meets school district
  1 43 expectations to move to the career level for a
  1 44 classroom teacher.  The school district shall
  1 45 recommend a beginning teacher who has successfully
  1 46 completed the program for an educational license.  A
  1 47 school district may offer a teacher a third year of
  1 48 participation in the program if, after conducting a
  1 49 comprehensive an evaluation, the school district
  1 50 determines that the teacher is likely to successfully
  2  1 complete the mentoring and induction program by the
  2  2 end of the third year of eligibility.  A teacher
  2  3 granted a third year of eligibility shall develop a
  2  4 teacher's mentoring and induction program plan in
  2  5 accordance with this chapter and shall undergo a
  2  6 comprehensive an evaluation at the end of the third
  2  7 year.  The board of educational examiners shall grant
  2  8 a one-year extension of the beginning teacher's
  2  9 provisional license upon notification by the school
  2 10 district that the teacher will participate in a third
  2 11 year of the school district's program.
  2 12    Sec.    .  Section 284.6, Code Supplement 2001, is
  2 13 amended by striking the section and inserting in lieu
  2 14 thereof the following:
  2 15    284.6  BEGINNING TEACHER MENTORING AND INDUCTION –
  2 16 AWARD – STATE SUBSIDY.
  2 17    1.  A mentor in a beginning teacher mentoring and
  2 18 induction program approved under this chapter shall be
  2 19 eligible for an award of one thousand dollars per
  2 20 semester, at a minimum, for participation in the
  2 21 program, which shall be paid from moneys received
  2 22 pursuant to this chapter by the school district.
  2 23    2.  Moneys received by a school district pursuant
  2 24 to this chapter shall be expended to provide mentors
  2 25 with awards in accordance with subsection 1, to
  2 26 implement the plan, to provide for a stipend for the
  2 27 district facilitator, and to pay any applicable costs
  2 28 of the employer's share of contributions to federal
  2 29 social security and the Iowa public employees'
  2 30 retirement system or a pension and annuity retirement
  2 31 system established under chapter 294, for such amounts
  2 32 paid by the district.
  2 33    3.  Moneys received by a school district under this
  2 34 chapter are miscellaneous income for purposes of
  2 35 chapter 257 or are considered encumbered.  A school
  2 36 district shall maintain a separate listing within its
  2 37 budget for payments received and expenditures made
  2 38 pursuant to this section.
  2 39    Sec.    .  Section 294A.14, unnumbered paragraph 3,
  2 40 Code Supplement 2001, is amended to read as follows:
  2 41    A plan shall be developed using the procedure
  2 42 specified under section 294A.15.  The plan shall
  2 43 provide for the establishment of a performance-based
  2 44 pay plan, a supplemental pay plan, a combination of
  2 45 the two pay plans, or comprehensive school
  2 46 transformation programs, and shall include a budget
  2 47 for the cost of implementing the plan.  In addition to
  2 48 the costs of providing additional salary for teachers
  2 49 and the amount required to pay the employers' share of
  2 50 the federal social security and Iowa public employees'
  3  1 retirement system, or a pension and annuity retirement
  3  2 system established under chapter 294, and payments on
  3  3 the additional salary, the budget may include costs
  3  4 associated with providing specialized or general
  3  5 training.  Moneys received under phase III shall not
  3  6 be used to employ additional employees of a school
  3  7 district, except that phase III moneys may be used to
  3  8 employ substitute teachers, part-time teachers, and
  3  9 other employees needed to implement plans that provide
  3 10 innovative staffing patterns, or require that a
  3 11 teacher employed on a full-time basis be absent from
  3 12 the classroom for specified periods for fulfilling
  3 13 other instructional duties or to participate on a peer
  3 14 review team or in peer coaching efforts.  However, all
  3 15 teachers employed are eligible to receive additional
  3 16 salary under an approved plan.
  3 17    Sec.    .  Sections 272.28, 284.1, 284.3, 284.4,
  3 18 and 284.7 through 284.13, Code Supplement 2001, are
  3 19 repealed.
  3 20    Sec.    .  2001 Iowa Acts, chapter 161, section 21,
  3 21 is repealed.
  3 22    Sec.    .  EFFECTIVE DATE.  The provision of this
  3 23 Act repealing 2001 Iowa Acts, chapter 161, section 21,
  3 24 being deemed of immediate importance, takes effect
  3 25 upon enactment."
  3 26    #3.  Title page, line 2, by striking the word
  3 27 "amending" and inserting the following:
  3 28 "eliminating".
  3 29    #4.  Title page, line 3, by inserting before the
  3 30 word "language" the following:  "amending".
