1 1 Amend the amendment, S-5437, to Senate File 2293,
1 2 as follows:
1 3 #1. By striking page 1, line 4 through page 54,
1 4 line 1, and inserting the following:
1 5 "Section 1. Section 441.21, Code Supplement 2001,
1 6 is amended by adding the following new subsection:
1 7 NEW SUBSECTION. 12. Beginning with valuations
1 8 established on or after January 1, 2003, an animal
1 9 feeding operation structure which is part of a
1 10 confinement feeding operation other than a small
1 11 animal feeding operation, as provided in chapter 455B,
1 12 shall be assessed as an agricultural commercial
1 13 building and valued at an amount equal to the market
1 14 value of the structure times the agricultural
1 15 productivity factor, as determined by the county
1 16 assessor for the assessment year, for the county where
1 17 the structure is located. The value determined under
1 18 this subsection shall not be included in the aggregate
1 19 whole value calculated according to the agricultural
1 20 productivity formula for agricultural realty.
1 21 Sec. 2. APPLICABILITY. Section 1 of this Act
1 22 applies to assessment years beginning on or after
1 23 January 1, 2003."
1 24 #2. Page 54, by striking lines 2 through 6, and
1 25 inserting following:
1 26 "# . Title page, line 1, by inserting after the
1 27 word "agriculture" the following: "and providing for
1 28 the assessment of agricultural feeding operation
1 29 structures for purposes of property taxation and for
1 30 the applicability of the assessment"."
1 31 #3. By renumbering as necessary.
