  1  4 RELATING TO DISSOLUTION OF MARRIAGE INCLUDING CERTAIN
  1  5    FINANCIAL STATEMENT INFORMATION FILED BY THE PARTIES AND
  1  6    PARTICIPATION IN A COURT-APPROVED COURSE PRIOR TO THE
  1  7    GRANTING OF A FINAL DISSOLUTION OF MARRIAGE DECREE OR THE
  1  8    ENTERING OF A FINAL CUSTODY ORDER.

  1 10 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1 11 
  1 12    Section 1.  Section 598.13, Code 2001, is amended to read
  1 13 as follows:
  1 14    598.13  FINANCIAL STATEMENTS FILED.
  1 15    1.  Both parties shall disclose their financial status.  A
  1 16 showing of special circumstances shall not be required before
  1 17 the disclosure is ordered.  A statement of net worth set forth
  1 18 by affidavit on a form prescribed by the supreme court and
  1 19 furnished without charge by the clerk of the district court
  1 20 shall be filed by each party prior to the dissolution hearing.
  1 21 However, the parties may waive this requirement upon
  1 22 application of both parties and approval by the court.
  1 23    Failure to comply with the requirements of this section
  1 24 subsection constitutes failure to make discovery as provided
  1 25 in rule of civil procedure 134.
  1 26    2.  The court may, in its discretion, order a trustee to
  1 27 provide, on behalf of a trust, information including but not
  1 28 limited to, trust documents and financial statements relating
  1 29 to any beneficial interest a party to the pending action may
  1 30 have in the trust.
  1 31    Sec. 2.  Section 598.19A, subsections 1 and 3, Code 2001,
  1 32 are amended to read as follows:
  1 33    1.  The court shall order the parties to any action which
  1 34 involves the issues of child custody or visitation to
  1 35 participate in a court-approved course to educate and
  2  1 sensitize the parties to the needs of any child or party
  2  2 during and subsequent to the proceeding within forty-five days
  2  3 of the service of notice and petition for the action or within
  2  4 forty-five days of the service of notice and application for
  2  5 modification of an order.  Participation in the course may be
  2  6 waived or delayed by the court for good cause including, but
  2  7 not limited to, a default by any of the parties or a showing
  2  8 that the parties have previously participated in a court-
  2  9 approved course or its equivalent.  Participation in the
  2 10 course is not required if the proceeding involves termination
  2 11 of parental rights of any of the parties.  A final decree
  2 12 shall not be granted or a final order shall not be entered
  2 13 until the parties have complied with this section, unless
  2 14 participation in the course is waived or delayed for good
  2 15 cause or is otherwise not required under this subsection.
  2 16    3.  Each party shall submit certification of completion of
  2 17 the course to the court prior to the granting of a final
  2 18 decree or the entry of an order, unless participation in the
  2 19 course is waived or delayed for good cause or is otherwise not
  2 20 required under subsection 1.
  2 21    Sec. 3.  Section 598.19A, Code 2001, is amended by adding
  2 22 the following new subsection:
  2 23    NEW SUBSECTION.  3A.  If participation in the court-
  2 24 approved course is waived or delayed for good cause or is
  2 25 otherwise not required under this section, the court may order
  2 26 that the parties receive the information described in
  2 27 subsection 4 through an alternative format.
