1 1 Section 1. MEDICAL ASSISTANCE – PERSONAL NEEDS ALLOWANCE.
1 2 The department of human services shall adopt rules which
1 3 provide that the personal needs allowance under the medical
1 4 assistance program, which is retained by a resident of a
1 5 health care facility, is forty dollars per month beginning
1 6 July 1, 2001, and is fifty dollars per month beginning July 1,
1 7 2002, unless a greater amount is allowed under state or
1 8 federal law.
1 9 EXPLANATION
1 10 This bill directs the department of human services to adopt
1 11 rules to allow residents of health care facilities
1 12 participating in the medical assistance program to retain a
1 13 personal needs allowance of $40 per month beginning July 1,
1 14 2001, and $50 per month beginning July 1, 2002, unless a
1 15 greater amount is allowed to be retained under state or
1 16 federal law. The current personal needs allowance is $30 per
1 17 month.
