  1  4 RELATING TO EXCLUDING FROM CONFINEMENT DOGS USED BY POLICE OR 
  1  5    CORRECTIONAL OFFICERS.

  1  7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA:
  1  8 
  1  9    Section 1.  Section 351.39, Code 2001, is amended to read
  1 10 as follows:
  1 11    351.39  CONFINEMENT.
  1 12    When If a local board of health receives information that
  1 13 any person has been bitten by an animal has bitten a person or
  1 14 that a dog or animal is suspected of having rabies, it the
  1 15 board shall order the owner to confine such animal in the
  1 16 manner it directs.  If the owner fails to confine such animal
  1 17 in the manner directed, the animal shall be apprehended and
  1 18 impounded by such board, and after two weeks ten days the
  1 19 board may humanely destroy the animal.  If such animal is
  1 20 returned to its owner, the owner shall pay the cost of
  1 21 impoundment.  This section shall not apply to a police service
  1 22 dog or a horse used by a law enforcement agency, that is
  1 23 acting in the performance of its duties which has bitten a
  1 24 person.
