1 1 Amend Senate File 2326 as follows:
1 2 #1. Page 1, by inserting before line 1 the
1 3 following:
1 4 "Section 1. Section 455B.301, Code 1999, is
1 5 amended by adding the following new subsection:
1 6 NEW SUBSECTION. 21. "Transfer station" means a
1 7 fixed or mobile intermediate sanitary disposal project
1 8 for transferring loads of solid waste, with or without
1 9 reduction of volume, to another transportation unit.
1 10 "Transfer station" does not include facilities which
1 11 exclusively perform recycling activities as defined in
1 12 section 455D.1, subsection 6.
1 13 Sec. . Section 455B.305A, subsection 1,
1 14 unnumbered paragraph 1, Code 1999, is amended to read
1 15 as follows:
1 16 Prior to the siting of a proposed, new sanitary
1 17 landfill, transfer station, incinerator, or infectious
1 18 medical waste incinerator, a city, county, or private
1 19 agency, shall submit a request for local siting
1 20 approval to the city council or county board of
1 21 supervisors which governs the city or county in which
1 22 the proposed site is to be located. The requirements
1 23 of this section do not apply to the expansion of an
1 24 existing sanitary landfill owned by a private agency
1 25 which disposes of waste which the agency generates on
1 26 property owned by the agency. The city council or
1 27 county board of supervisors shall approve or
1 28 disapprove the site for each sanitary landfill,
1 29 transfer station, or incinerator, or infectious
1 30 medical waste incinerator.
1 31 Sec. . Section 455B.305A, subsection 2,
1 32 unnumbered paragraph 1, Code 1999, is amended to read
1 33 as follows:
1 34 An applicant for siting approval shall submit
1 35 information to the city council or county board of
1 36 supervisors to demonstrate compliance with the
1 37 requirements prescribed by this chapter regarding a
1 38 sanitary landfill, transfer station, or infectious
1 39 waste incinerator. Siting approval shall be granted
1 40 only if the proposed project meets all of the
1 41 following criteria:"
1 42 #2. Title page, line 1, by inserting after the
1 43 words "relating to" the following: "solid waste
1 44 transfer stations and"
1 45 #3. By renumbering as necessary.
