  1  1    Amend Senate File 2311 as follows:
  1  2    #1.  Page 1, by inserting before line 1 the
  1  3 following:
  1  4    "Section 1.  Section 455B.301, Code 1999, is
  1  5 amended by adding the following new subsection:
  1  6    NEW SUBSECTION.  21.  "Transfer station" means a
  1  7 fixed or mobile intermediate sanitary disposal project
  1  8 for transferring loads of solid waste, with or without
  1  9 reduction of volume, to another transportation unit.
  1 10 "Transfer station" does not include facilities which
  1 11 exclusively performs recycling activities as defined
  1 12 in section 455D.1, subsection 6."
  1 13    #2.  Page 1, by inserting after line 2 the
  1 14 following:
  1 15    "Sec.    .  Section 455B.305A, subsection 1,
  1 16 unnumbered paragraph 1, Code 1999, is amended to read
  1 17 as follows:
  1 18    Prior to the siting of a proposed, new sanitary
  1 19 landfill, transfer station, incinerator, or infectious
  1 20 medical waste incinerator, a city, county, or private
  1 21 agency, shall submit a request for local siting
  1 22 approval to the city council or county board of
  1 23 supervisors which governs the city or county in which
  1 24 the proposed site is to be located.  The requirements
  1 25 of this section do not apply to the expansion of an
  1 26 existing sanitary landfill owned by a private agency
  1 27 which disposes of waste which the agency generates on
  1 28 property owned by the agency.  The city council or
  1 29 county board of supervisors shall approve or
  1 30 disapprove the site for each sanitary landfill,
  1 31 transfer station, or incinerator, or infectious
  1 32 medical waste incinerator.
  1 33    Sec.    .  Section 455B.305A, subsection 2,
  1 34 unnumbered paragraph 1, Code 1999, is amended to read
  1 35 as follows:
  1 36    An applicant for siting approval shall submit
  1 37 information to the city council or county board of
  1 38 supervisors to demonstrate compliance with the
  1 39 requirements prescribed by this chapter regarding a
  1 40 sanitary landfill, transfer station, or infectious
  1 41 waste incinerator.  Siting approval shall be granted
  1 42 only if the proposed project meets all of the
  1 43 following criteria:"
  1 44    #3.  Title page, line 1, by inserting after the
  1 45 word "Act" the following:  "relating to solid waste
  1 46 transfer stations and".
  1 47    #4.  By renumbering as necessary.
