PAG LIN 1 1 Section 1. Section 321.463, subsection 4, paragraph b, 1 2 Code Supplement 1999, is amended by striking the paragraph and 1 3 inserting in lieu thereof the following: 1 4 b. (1) Notwithstanding any provision of this section to 1 5 the contrary, the weight on any one axle of a fence-line 1 6 feeder, grain cart, or tank wagon operated on the highways of 1 7 this state shall not exceed twenty-four thousand pounds from 1 8 February 1 through May 31 or twenty-eight thousand pounds from 1 9 June 1 through January 31, provided, however, that the maximum 1 10 gross vehicle weight of the fence-line feeder, grain cart, or 1 11 tank wagon shall not exceed ninety-six thousand pounds. 1 12 A fence-line feeder, grain cart, or tank wagon shall comply 1 13 with the other provisions of this section and chapter when 1 14 operated over a bridge in this state. A local authority may 1 15 issue a special permit, based on a statewide standard 1 16 developed by the department, allowing the operation over a 1 17 bridge within its jurisdiction of a fence-line feeder, grain 1 18 cart, or tank wagon with a weight in excess of the weights 1 19 allowed under this chapter. 1 20 (2) For purposes of this paragraph "b", "highway" does not 1 21 include a road over a bridge. 1 22 For purposes of this paragraph "b", "fence-line feeder, 1 23 grain cart, or tank wagon" means all of the following: 1 24 (a) A fence-line feeder, grain cart, or tank wagon 1 25 manufactured on or after July 1, 2001. 1 26 (b) After July 1, 2005, any fence-line feeder, grain cart, 1 27 or tank wagon. 1 28 The year of manufacture of a fence-line feeder, grain cart, 1 29 or tank wagon manufactured on or after July 1, 2001, shall be 1 30 permanently made a part of the identification plate on the 1 31 vehicle. Fraudulently altering or defacing or attempting to 1 32 fraudulently alter or deface the year of manufacture or other 1 33 product identification number on a fence-line feeder, grain 1 34 cart, or tank wagon is a violation of section 321.92. 1 35 Sec. 2. IMPLEMENTS OF HUSBANDRY STUDY. The state 2 1 department of transportation shall, in consultation with 2 2 manufacturers and distributors of implements of husbandry, 2 3 agricultural associations, and the Iowa state association of 2 4 counties, complete the study described in 1999 Iowa Acts, 2 5 chapter 108, section 12, as it pertains to tracked vehicles. 2 6 The department shall report its findings and recommendations 2 7 to the general assembly by December 1, 2000. 2 8 EXPLANATION 2 9 This bill amends Code section 321.463, relating to the 2 10 maximum gross weight allowed for vehicles operated on the 2 11 highways of this state, by modifying the weight restrictions 2 12 enacted by the 1999 Session of the General Assembly relating 2 13 to fence-line feeders, grain carts, and tank wagons 2 14 manufactured on or after July 1, 2001, and, after July 1, 2 15 2005, to all such vehicles. The bill eliminates a provision 2 16 allowing a 20 percent tolerance over the maximum weight 2 17 restrictions otherwise allowed by Code chapter 321 for fence- 2 18 line feeders, grain carts, and tank wagons, replacing it with 2 19 set weight restrictions. The bill provides that the weight on 2 20 any one axle of a fence-line feeder, grain cart, or tank wagon 2 21 shall not exceed 24,000 pounds from February 1 through May 31 2 22 or 28,000 pounds from June 1 through January 31, provided, 2 23 however, that the maximum gross vehicle weight of the vehicle 2 24 shall not exceed 96,000 pounds. 2 25 The bill provides that a fence-line feeder, grain cart, or 2 26 tank wagon shall comply with the weight restrictions for other 2 27 vehicles over bridges. A local authority may issue a special 2 28 permit, based on a statewide standard developed by the state 2 29 department of transportation, for the operation of a fence- 2 30 line feeder, grain cart, or tank wagon over a bridge within 2 31 its jurisdiction. 2 32 The bill also directs the state department of 2 33 transportation to continue the implements of husbandry study 2 34 required by the 1999 Session of the General Assembly, as the 2 35 study pertains to tracked vehicles.
