  1  1    Section 1.  Section 35C.3, Code Supplement 1999, is amended
  1  2 to read as follows:
  1  3    35C.3  DUTY TO INVESTIGATE AND APPOINT.
  1  4    When any preferred person applies for appointment or
  1  5 employment under this chapter, the officer, board, or person
  1  6 whose duty it is or may be to appoint or employ a person to
  1  7 fill the position or place shall, before appointing or
  1  8 employing a person to fill the position or place, make an
  1  9 investigation as to the qualifications of the applicant for
  1 10 the place or position, and if the applicant is of good moral
  1 11 character and can perform the duties of the position applied
  1 12 for, the officer, board, or person shall appoint the applicant
  1 13 to the position, place, or employment.  The appointing
  1 14 officer, board, or person shall set forth in writing and file
  1 15 for public inspection the specific grounds upon which it
  1 16 appointed or refused to appoint the person.  Within ten days
  1 17 after an appointment is refused, the appointing officer,
  1 18 board, or person shall notify the unsuccessful applicant in
  1 19 writing of the specific grounds for refusal.  
  1 20                           EXPLANATION
  1 21    This bill strikes a requirement that a public employer who
  1 22 refuses an appointment to a veteran applicant shall notify the
  1 23 unsuccessful applicant in writing within 10 days of the
  1 24 specific grounds for the refusal.  The public employer would
  1 25 still be required to file for public inspection the specific
  1 26 grounds for appointing or refusing to appoint a veteran
  1 27 applicant.
