PAG LIN 1 1 Section 1. Section 483A.7, subsection 3, Code 1999, is 1 2 amended to read as follows: 1 3 3. A nonresident wild turkey hunter is required to have 1 4 only a nonresident wild turkey hunting license and pay the 1 5 wildlife habitat fee. The commission shall annually limit to 1 6twothree thousand licenses the number of nonresidents allowed 1 7 to have wild turkey hunting licenses. The number of 1 8 nonresident wild turkey hunting licenses shall be determined 1 9 as provided in section 481A.38. The commission shall allocate 1 10 the nonresident wild turkey hunting licenses issued among the 1 11 zones based on the populations of wild turkey. A nonresident 1 12 applying for a wild turkey hunting license must exhibit proof 1 13 of having successfully completed a hunter safety and ethics 1 14 education program as provided in section 483A.27 or its 1 15 equivalent as determined by the department before the license 1 16 is issued. 1 17 Sec. 2. Section 483A.8, subsection 3, Code l999, is 1 18 amended to read as follows: 1 19 3. A nonresident hunting deer is required to have a 1 20 nonresident deer license and must pay the wildlife habitat 1 21 fee. The commission shall annually limit toseventen 1 22 thousandfive hundredlicenses the number of nonresidents 1 23 allowed to have deer hunting licenses.Of the first six1 24thousand nonresident deer licenses issued, not more than1 25thirty-five percent of the licenses shall be bow season1 26licenses and, after the first six thousand nonresident deer1 27licenses have been issued, all additional licenses shall be1 28issued for antlerless deer only.The number of nonresident 1 29 deer hunting licenses shall be determined as provided in 1 30 section 481A.38. The commission shall allocate the 1 31 nonresident deer hunting licenses issued among the zones based 1 32 on the populations of deer. However, a nonresident applicant 1 33 may request one or more hunting zones, in order of preference, 1 34 in which the applicant wishes to hunt. If the request cannot 1 35 be fulfilled, the applicable fees shall be returned to the 2 1 applicant. A nonresident applying for a deer hunting license 2 2 must exhibit proof of having successfully completed a hunter 2 3 safety and ethics education program as provided in section 2 4 483A.27 or its equivalent as determined by the department 2 5 before the license is issued. 2 6 Sec. 3. Section 483A.8, Code l999, is amended by adding 2 7 the following new subsection: 2 8 NEW SUBSECTION. 5. A nonresident owning land in this 2 9 state may apply for one of the ten thousand nonresident deer 2 10 licenses and the provisions of subsection 3 shall apply. 2 11 However, if a nonresident owning land in this state is 2 12 unsuccessful in the drawing, the landowner shall be issued an 2 13 antlerless deer license only. A nonresident owning land in 2 14 this state shall pay the full fee for a nonresident antlerless 2 15 deer license and the license is valid to hunt on the 2 16 nonresident's land only. A nonresident owning land in this 2 17 state is eligible for only one nonresident antlerless deer 2 18 license annually and if one or more parcels of land have 2 19 common nonresident ownership, only one of the nonresident 2 20 owners is eligible for a nonresident deer license. 2 21 Sec. 4. NEW SECTION. 483A.28 DEER MANAGEMENT PLAN. 2 22 A person controlling land by lease, ownership, or other 2 23 means where a hunter is charged a fee for hunting deer, shall 2 24 have a deer population management plan approved by the 2 25 department. The primary objective of a deer management plan 2 26 is to manage deer populations to minimize damage to 2 27 agricultural crops on land adjacent to the fee hunting 2 28 management area. This section does not apply to licensed 2 29 hunting preserves. 2 30 EXPLANATION 2 31 This bill increases the annual limit on nonresident turkey 2 32 hunting licenses from 2,000 to 3,000 and increases the number 2 33 of annual nonresident deer hunting licenses from 7,500 to 2 34 10,000. The statutory requirement that only 35 percent of the 2 35 nonresident deer hunting licenses shall be sold to bow and 3 1 arrow hunters is also stricken. A provision is added that a 3 2 nonresident owning land in this state may purchase a license 3 3 to hunt an antlerless deer if the nonresident does not receive 3 4 a regular nonresident deer hunting license. The antlerless 3 5 deer hunting license is valid for hunting only on land owned 3 6 by the nonresident. 3 7 The bill provides that operators of hunting areas where 3 8 fees are charged for hunting deer shall have a deer population 3 9 management plan approved by the department.
