PAG LIN 1 1 HOUSE FILE 2477 1 2 1 3 AN ACT 1 4 RELATING TO NONHIGHWAY TRANSPORTATION, INCLUDING AIRCRAFT 1 5 REGISTRATION AND PASSENGER RAIL SERVICE. 1 6 1 7 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF IOWA: 1 8 1 9 Section 1. Section 327J.1, Code 1999, is amended by adding 1 10 the following new subsection: 1 11 NEW SUBSECTION. 5. "Midwest regional rail system" means 1 12 the passenger rail system identified through a multistate 1 13 planning effort in cooperation with AMTRAK. 1 14 Sec. 2. Section 327J.3, subsections 2 through 4, Code 1 15 1999, are amended by striking the subsections and inserting in 1 16 lieu thereof the following: 1 17 2. The director may enter into agreements with AMTRAK and 1 18 other states associated with the midwest regional rail system 1 19 for the purpose of developing a rail passenger system serving 1 20 the midwest, including service from Chicago, Illinois, to 1 21 Omaha, Nebraska, through Iowa. The agreements may include any 1 22 of the following: 1 23 a. Cost-sharing agreements associated with initiating 1 24 service, capital costs, operating subsidies, and other costs 1 25 necessary to develop and maintain service. 1 26 b. Joint powers agreements and other institutional 1 27 arrangements associated with the administration, management, 1 28 and operation of a midwest regional rail system. 1 29 3. The director shall enter into discussions with members 1 30 of Iowa's congressional delegation to foster rail passenger 1 31 service in this state and the midwest and to maximize the 1 32 level of federal funding for the service, including funding 1 33 for the midwest regional rail system. 1 34 4. The director may provide assistance and enter into 1 35 agreements with cities along the proposed route of the midwest 2 1 regional rail system or other passenger rail system serving 2 2 the midwest to ensure that rail stations and terminals are 2 3 designed and developed in accordance with the following 2 4 objectives: 2 5 a. To meet safety and efficiency requirements outlined by 2 6 AMTRAK and the federal railroad administration. 2 7 b. To aid intermodal transportation. 2 8 c. To encourage economic development. 2 9 5. The director shall report annually to the general 2 10 assembly concerning the development and operation of the 2 11 midwest regional rail system and the state's passenger rail 2 12 service. 2 13 Sec. 3. Section 328.35, subsection 1, Code 1999, is 2 14 amended by adding the following new paragraph: 2 15 NEW PARAGRAPH. e. An aircraft which is displayed in a 2 16 museum. 2 17 Sec. 4. LIMITATION ON EXPENDITURE OF FUNDS FOR PASSENGER 2 18 RAIL SERVICE. It is the intent of the general assembly that 2 19 moneys directed to be deposited in the road use tax fund under 2 20 section 312.1 shall not be used for loans, grants, or other 2 21 financial assistance for passenger rail service. 2 22 2 23 2 24 2 25 BRENT SIEGRIST 2 26 Speaker of the House 2 27 2 28 2 29 2 30 MARY E.
