Page 23, by inserting after line 20 the 3 22 following: 3 23 "Sec. . Section 261.38, subsection 1, Code 3 24 1999, is amended to read as follows: 3 25 1. The commission shall establish a loan reserve 3 26 accountfrom which any default on a guaranteed student3 27loan shall be paidand an agency operating account as 3 28 authorized by the federal Higher Education Act of 3 29 1965. The commission shall credit tothis account3 30 these accounts all moneysdesignated exclusively for3 31the reserve fundprovided for the state student loan 3 32 program by the United States, the state of Iowa, or 3 33 any of their agencies, departments or 3 34 instrumentalities, as well as any funds accruing to 3 35 the program which are not required for current 3 36 administrative expenses. Thedepartment of management3 37shall determine the actuarially sound reserve3 38requirement for the amount of guaranteed loans3 39outstandingcommission may expend moneys in the loan 3 40 reserve and agency operating accounts as authorized by 3 41 the federal Higher Education Act of 1965. 3 42 Sec. . Section 261.38, subsection 2, Code 1999, 3 43 is amended by striking the subsection. 3 44 Sec. . Section 261.38, subsections 3, 4, and 5, 3 45 Code 1999, are amended to read as follows: 3 46 3. The payment of any funds for the default on a 3 47 guaranteed student loan shall be solely from the loan 3 48 reserveaccountand agency operating accounts. The 3 49 general assembly shall not be obligated to appropriate 3 50 any moneys to pay for any defaults or to appropriate 4 1 any moneys to be credited to the loan reserve account. 4 2 The commission shall not give or lend the credit of 4 3 the state of Iowa. 4 4 4.FundsNotwithstanding section 8.33, funds on 4 5 deposit in the loan reserveaccount or in the4 6administrative accountand operating accounts shall 4 7 not revert to the state general fund at the close of 4 8 any fiscal year. 4 9 5. The treasurer of state shall invest any funds, 4 10 including those in the loan reserveaccountand 4 11 operating accounts, and, notwithstanding section 4 12 12C.7, the interest income earned shall be credited 4 13 back to theloan reserveappropriate account. 4 14 Sec. . Section 261.38, subsection 6, Code 1999, 4 15 is amended by striking the subsection. 4 16 Sec. . Section 261.38, subsection 7, unnumbered 4 17 paragraph 1, Code 1999, is amended to read as follows: 4 18 The commission mayexpend funds in the reserve4 19account andenter into agreements with the Iowa 4 20 student loan liquidity corporation in order to 4 21 increase access for students to education loan 4 22 programs that the commission determines meet the 4 23 education needs of Iowa residents. The agreements 4 24 shall permit the establishment, funding, and operation 4 25 of alternative education loan programs, as described 4 26 in section 144(b)(1)(B) of the Internal Revenue Code 4 27 of 1986 as amended, as defined in section 422.3, in 4 28 addition to programs permitted under the federal 4 29 Higher Education Act of 1965. In accordance with 4 30 those agreements, the Iowa student loan liquidity 4 31 corporation may issue bonds, notes, or other 4 32 obligations to the public and others for the purpose 4 33 of funding the alternative education loan programs. 4 34 This authority to issuesuchbonds, notes, or other 4 35 obligations shall be in addition to the authority 4 36 established in the articles of incorporation and 4 37 bylaws of the Iowa student loan liquidity 4 38 corporation." 4 39 #22.
