PAG LIN 1 1 Amend House File 766 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. Section 256.44, Code 1999, is amended 1 5 by striking the section and inserting in lieu thereof 1 6 the following: 1 7 256.44 NATIONAL BOARD CERTIFICATION PILOT PROJECT. 1 8 1. A national board certification pilot project is 1 9 established to be administered by the department of 1 10 education. A teacher, as defined in section 272.1, 1 11 who registers for or achieves national board for 1 12 professional teaching standards certification, and who 1 13 is employed by a school district in Iowa and receiving 1 14 a salary as a classroom teacher, may be eligible for 1 15 the following: 1 16 a. If a teacher registers for national board for 1 17 professional teaching standards certification prior to 1 18 June 30, 2002, a one-time initial reimbursement award 1 19 in the amount of up to one-half of the registration 1 20 fee paid by the teacher for registration for 1 21 certification by the national board for professional 1 22 teaching standards. The teacher shall apply to the 1 23 department of education within one year of 1 24 registration, submitting to the department any 1 25 documentation the department requires. A teacher who 1 26 receives an initial reimbursement award shall receive 1 27 a one-time final registration award in the amount of 1 28 the remaining national board registration fee paid by 1 29 the teacher if the teacher notifies the department of 1 30 the teacher's certification achievement and submits 1 31 any documentation requested by the department. 1 32 b. (1) If, by May 1, 2000, the teacher applies to 1 33 the department for an annual award and submits 1 34 documentation of certification by the national board 1 35 for professional teaching standards, an annual award 1 36 in the amount of five thousand dollars. However, if 1 37 the teacher does not achieve certification on the 1 38 teacher's first attempt to pass the national board for 1 39 professional teaching standards assessment, the 1 40 teacher shall be paid the award amount as provided in 1 41 subparagraph (2) upon achieving certification. The 1 42 department shall award not more than a total of fifty 1 43 thousand dollars in annual awards to an individual 1 44 during the individual's term of eligibility for annual 1 45 awards. 1 46 (2) If the teacher registers for national board 1 47 for professional teaching standards certification 1 48 between January 1, 1999, and January 1, 2002, and 1 49 achieves certification within three years from the 1 50 date of initial score notification, an annual award in 2 1 the amount of two thousand five dollars upon achieving 2 2 certification by the national board of professional 2 3 teaching standards. 2 4 To receive an annual award pursuant to this 2 5 paragraph "b", a teacher shall apply to the department 2 6 for an award within one year of eligibility. Payment 2 7 for awards shall be made only upon departmental 2 8 approval of an application or recertification of 2 9 eligibility. A term of eligibility shall be for ten 2 10 years or for the years in which the individual 2 11 maintains a valid certificate, whichever time period 2 12 is shorter. In order to continue receipt of payments, 2 13 a recipient shall annually recertify eligibility. 2 14 2. a. If the amount appropriated annually for 2 15 purposes of this section is insufficient to pay the 2 16 full amount of reimbursement awards in accordance with 2 17 subsection 1, paragraph "a", the department shall 2 18 annually prorate the amount of the registration awards 2 19 provided to each teacher who meets the requirements of 2 20 this section. 2 21 b. If the amount appropriated annually for 2 22 purposes of providing an annual award in accordance 2 23 with subsection 1, paragraph "b", is insufficient to 2 24 pay the full annual award to all teachers approved by 2 25 the department for an annual award, the department 2 26 shall prorate the amount of the annual award based 2 27 upon the amount appropriated. 2 28 3. A teacher receiving an annual award pursuant to 2 29 this section may provide additional services to the 2 30 school district that employs the teacher. The 2 31 additional services to be provided by the teacher may 2 32 be mutually agreed upon by the school district and the 2 33 teacher. 2 34 4. Awards shall be paid to teachers by the 2 35 department as follows: 2 36 a. Upon receipt of reimbursement documentation as 2 37 provided in subsection 1, paragraph "a". 2 38 b. Not later than June 1 to teachers whose 2 39 applications and recertifications for annual awards as 2 40 provided in subsection 1, paragraph "b", are submitted 2 41 to the department by May 1 and subsequently approved. 2 42 5. Notwithstanding any provision to the contrary, 2 43 a teacher approved by the department to receive an 2 44 annual award for certification in accordance with this 2 45 section in the fiscal year beginning July 1, 1998, 2 46 shall receive the annual award amount specified in 2 47 subsection 1, paragraph "b", subparagraph (1), to 2 48 commence with the fiscal year beginning July 1, 1999. 2 49 6. From funds appropriated for purposes of this 2 50 section by the general assembly to the department of 3 1 education for each fiscal year in the fiscal period 3 2 beginning July 1, 1999, and ending June 30, 2004, 3 3 three hundred thousand dollars, or so much thereof as 3 4 may be necessary, shall be used for the payment of 3 5 registration awards as provided in subsection 4, 3 6 paragraph "a". 3 7 7. The department shall prorate the amount of the 3 8 annual awards paid in accordance with this section 3 9 when the number of award recipients exceeds one 3 10 thousand one hundred individuals. 3 11 Sec. 2. DEPARTMENT OF EDUCATION STUDIES. The 3 12 department of education shall conduct a study of the 3 13 effects of the national board certification pilot 3 14 project established in section 256.44 on teaching 3 15 quality, professional development, the provision of 3 16 additional services to school districts in accordance 3 17 with section 256.44, subsection 3, and teacher 3 18 induction and retention in this state. The department 3 19 shall consider whether the effects of the pilot 3 20 project support continuation of the project or 3 21 expansion to include other teacher awards or 3 22 recognitions. The department shall submit its 3 23 findings and recommendations in a report to the 3 24 chairpersons and ranking members of the senate and 3 25 house standing committees on education and the joint 3 26 subcommittee on education appropriations by December 3 27 1, 2001. 3 28 Sec. 3. EMERGENCY RULES. The department of 3 29 education may adopt emergency rules under section 3 30 17A.4, subsection 2, and section 17A.5, subsection 2, 3 31 paragraph "b", to implement the provisions of this Act 3 32 and the rules shall be effective immediately upon 3 33 filing unless a later date is specified in the rules. 3 34 Any rules adopted in accordance with this section 3 35 shall also be published as a notice of intended action 3 36 as provided in section 17A.4." 3 37 3 38 3 39 3 40 GRUNDBERG of Polk 3 41 HF 766.303 78 3 42 kh/cf
