The department 5 7 shall submit a report of its findings and recommendations to 5 8 the general assembly by December 31, 1997. 5 9 The director of the department of education shall convene a 5 10 study committee during the 1997 legislative interim consisting 5 11 of the co-chairpersons of the joint appropriations 5 12 subcommittee on education; two members of the governing board 5 13 of the first in the nation in education foundation, who shall 5 14 be appointed by the chairperson of the governing board; and 5 15 the director of the department of education. The study 5 16 committee shall do the following: 5 17 a Study how to maintain the autonomy of the foundation. 5 18 b Develop strategies that allow the foundation's funds to 5 19 be invested in such a way as to increase the interest earned. 5 20 c Explore ways to enhance the research and dissemination 5 21 functions of the foundation. 5 22 d Determine methods for reporting foundation activities 5 23 that impact Iowa education. The study committee shall report 5 24 its findings and recommendations in a report to the general 5 25 assembly by October 1, 1997. 5 26 2. The funds collected by the 6 15 division may exceed the amount needed to match available 6 16 federal vocational rehabilitation funds in an effort to 6 17 qualify for additional federal funds when such funds become 6 18 available. 6 19 Except where prohibited under federal law, the division of 6 20 vocational rehabilitation services of the department of 6 21 education shall accept client assessments, or assessments of 6 22 potential clients, performed by other agencies in order to 6 23 reduce duplication of effort. 6 24 Notwithstanding the full-time equivalent position limit 6 25 established in this subsection, for the fiscal year ending 6 26 June 30, 1998, if federal funding is received to pay the costs 6 27 of additional employees for the vocational rehabilitation 6 28 services division who would have duties relating to vocational 6 29 rehabilitation services paid for through federal funding, 6 30 authorization to hire not more than four additional full-time 6 31 equivalent employees shall be provided, the full-time 6 32 equivalent position limit shall be exceeded, and the 6 33 additional employees shall be hired by the division. 6 34 b. Notwithstanding section 8.33 and section 256.39, 10 19 subsection 7, unobligated or unencumbered moneys remaining on 10 20 June 30, 1997, from the appropriation made in 1995 Iowa Acts, 10 21 chapter 218, section 1, subsection 11, for purposes of the 10 22 career pathways program, shall not revert but shall be 10 23 available for expenditure for the program during the fiscal 10 24 year beginning July 1, 1997, and ending June 30, 1998. 10 25 Sec. 9. Notwithstanding section 8.33, of the unencumbered 10 26 or unobligated funds remaining on June 30, 1997, from moneys 10 27 appropriated in 1996 Iowa Acts, chapter 1215, section 6, 10 28 subsection 5, $120,000 shall not revert to the general fund of 10 29 the state but shall be available the following fiscal year for 10 30 expenditure for maintenance of the state of Iowa libraries 10 31 online (SILO) program. 10 32 Sec. 10. A school district shall not receive funds from 10 33 the new Iowa schools development corporation for more than 10 34 three consecutive years, effective July 1, 1998. The 10 35 corporation shall place a high priority on increasing the 11 1 number of school districts the corporation serves. The 11 2 corporation shall study the methods by which it can increase 11 3 the number of school districts served, analyze the services 11 4 provided to school districts, and determine the average amount 11 5 of time necessary to adequately serve a school district. The 11 6 corporation shall submit its findings and recommendations to 11 7 the general assembly by December 31, 1997. 11 8 STATE BOARD OF REGENTS 11 9 Sec. 11. There is appropriated from the general fund of 11 10 the state to the state board of regents for the fiscal year 11 11 beginning July 1, 1997, and ending June 30, 1998, the 11 12 following amounts, or so much thereof as may be necessary, to 11 13 be used for the purposes designated: 11 14 1. OFFICE OF STATE BOARD OF REGENTS 11 15 a. FTEs 5,523.11 13 15 The university of Iowa hospitals and clinics, the Iowa 13 16 department of corrections, and the association of Iowa 13 17 hospitals and health systems shall jointly develop and issue 13 18 recommendations relating to localizing indigent health care 13 19 services, including but not limited to health care services to 13 20 inmates, the potential application of telemedicine in 13 21 providing health care services to inmates, and the feasibility 13 22 of establishing a corrections infirmary, in a report to be 13 23 submitted to the general assembly by January 1, 1998. 13 24 The university of Iowa hospitals and clinics shall submit 13 25 quarterly a report regarding the portion of the appropriation 13 26 in this lettered paragraph expended on medical education. The 13 27 report shall be submitted in a format jointly developed by the 13 28 university of Iowa hospitals and clinics, the legislative 13 29 fiscal bureau, and the department of management, and shall 13 30 delineate the expenditures and purposes of the funds. 13 31 Funds appropriated in this lettered paragraph shall not be 13 32 used to perform abortions except medically necessary 13 33 abortions, and shall not be used to operate the early 13 34 termination of pregnancy clinic except for the performance of 13 35 medically necessary abortions. For the purpose of this 14 1 lettered paragraph, an abortion is the purposeful interruption 14 2 of pregnancy with the intention other than to produce a live- 14 3 born infant or to remove a dead fetus, and a medically 14 4 necessary abortion is one performed under one of the following 14 5 conditions: 14 6 (1) The attending physician certifies that continuing the 14 7 pregnancy would endanger the life of the pregnant woman. 14 8 (2) The attending physician certifies that the fetus is 14 9 physically deformed, mentally deficient, or afflicted with a 14 10 congenital illness. 14 11 (3) The pregnancy is the result of a rape which is 14 12 reported within 45 days of the incident to a law enforcement 14 13 agency or public or private health agency which may include a 14 14 family physician. 14 15 (4) The pregnancy is the result of incest which is 14 16 reported within 150 days of the incident to a law enforcement 14 17 agency or public or private health agency which may include a 14 18 family physician. 14 19 (5) The abortion is a spontaneous abortion, commonly known 14 20 as a miscarriage, wherein not all of the products of 14 21 conception are expelled. 14 22 The total quota allocated to the counties for indigent 14 23 patients for the fiscal year beginning July 1, 1997, shall not 14 24 be lower than the total quota allocated to the counties for 14 25 the fiscal year commencing July 1, 1996. The total quota 14 26 shall be allocated among the counties on the basis of the 1990 14 27 census pursuant to section 255.16. 14 28 d. Notwithstanding section 8.33, funds appropriated 18 29 in 1996 Iowa Acts, chapter 1215, section 12, subsection 1, 18 30 paragraph "b", remaining unencumbered or unobligated on June 18 31 30, 1997, shall not revert to the general fund of the state 18 32 but shall be available for expenditure for the purposes listed 18 33 in section 11, subsection 1, paragraph "b", of this Act during 18 34 the fiscal year beginning July 1, 1997, and ending June 30, 18 35 1998. 19 1 Sec. 14. Notwithstanding section 8.33, funds appropriated 19 2 in 1996 Iowa Acts, chapter 1215, section 12, subsection 2, 19 3 paragraph "n", remaining unencumbered or unobligated on June 19 4 30, 1997, shall not revert to the general fund of the state 19 5 but shall be available for expenditure for the purposes listed 19 6 in section 11, subsection 2, paragraph "n", of this Act. 19 7 Sec. 15. MEDICAL ASSISTANCE SUPPLEMENTAL AMOUNTS. For 19 8 the fiscal year beginning July 1, 1997, and ending June 30, 19 9 1998, the department of human services shall continue the 19 10 supplemental disproportionate share and a supplemental 19 11 indirect medical education adjustment applicable to state- 19 12 owned acute care hospitals with more than 500 beds and shall 19 13 reimburse qualifying hospitals pursuant to that adjustment 19 14 with a supplemental amount for services provided medical 19 15 assistance recipients. The adjustment shall generate 19 16 supplemental payments intended to equal the state 19 17 appropriation made to a qualifying hospital for treatment of 19 18 indigent patients as provided in chapter 255. To the extent 19 19 of the supplemental payments, a qualifying hospital shall, 19 20 after receipt of the funds, transfer to the department of 19 21 human services an amount equal to the actual supplemental 19 22 payments that were made in that month. The aggregate amounts 19 23 for the fiscal year shall not exceed the state appropriation 19 24 made to the qualifying hospital for treatment of indigent 19 25 patients as provided in chapter 255. The department of human 19 26 services shall deposit the portion of these funds equal to the 19 27 state share in the department's medical assistance account and 19 28 the balance shall be credited to the general fund of the 19 29 state. To the extent that state funds appropriated to a 19 30 qualifying hospital for the treatment of indigent patients as 19 31 provided in chapter 255 have been transferred to the 19 32 department of human services as a result of these supplemental 19 33 payments made to the qualifying hospital, the department shall 19 34 not, directly or indirectly, recoup the supplemental payments 19 35 made to a qualifying hospital for any reason, unless an 20 1 equivalent amount of the funds transferred to the department 20 2 of human services by a qualifying hospital pursuant to this 20 3 provision is transferred to the qualifying hospital by the 20 4 department. 20 5 If the state supplemental amount allotted to the state of 20 6 Iowa for the federal fiscal year beginning October 1, 1997, 20 7 and ending September 30, 1998, pursuant to section 1923 (f)(3) 20 8 of the federal Social Security Act, as amended, or pursuant to 20 9 federal payments for indirect medical education is greater 20 10 than the amount necessary to fund the federal share of the 20 11 supplemental payments specified in the preceding paragraph, 20 12 the department of human services shall increase the 20 13 supplemental disproportionate share or supplemental indirect 20 14 medical education adjustment by the lesser of the amount 20 15 necessary to utilize fully the state supplemental amount or 20 16 the amount of state funds appropriated to the state university 20 17 of Iowa general education fund and allocated to the university 20 18 for the college of medicine. The state university of Iowa 20 19 shall transfer from the allocation for the college of medicine 20 20 to the department of human services, on a monthly basis, an 20 21 amount equal to the additional supplemental payments made 20 22 during the previous month pursuant to this paragraph. A 20 23 qualifying hospital receiving supplemental payments pursuant 20 24 to this paragraph that are greater than the state 20 25 appropriation made to the qualifying hospital for treatment of 20 26 indigent patients as provided in chapter 255 shall be 20 27 obligated as a condition of its participation in the medical 20 28 assistance program to transfer to the state university of Iowa 20 29 general education fund on a monthly basis an amount equal to 20 30 the funds transferred by the state university of Iowa to the 20 31 department of human services. To the extent that state funds 20 32 appropriated to the state university of Iowa and allocated to 20 33 the college of medicine have been transferred to the 20 34 department of human services as a result of these supplemental 20 35 payments made to the qualifying hospital, the department shall 21 1 not, directly or indirectly, recoup these supplemental 21 2 payments made to a qualifying hospital for any reason, unless 21 3 an equivalent amount of the funds transferred to the 21 4 department of human services by the state university of Iowa 21 5 pursuant to this paragraph is transferred to the qualifying 21 6 hospital by the department. 21 7 Continuation of the supplemental disproportionate share and 21 8 supplemental indirect medical education adjustment shall 21 9 preserve the funds available to the university hospital for 21 10 medical and surgical treatment of indigent patients as 21 11 provided in chapter 255 and to the state university of Iowa 21 12 for educational purposes at the same level as provided by the 21 13 state funds initially appropriated for that purpose. 21 14 The department of human services shall, in any compilation 21 15 of data or other report distributed to the public concerning 21 16 payments to providers under the medical assistance program, 21 17 set forth reimbursements to a qualifying hospital through the 21 18 supplemental disproportionate share and supplemental indirect 21 19 medical education adjustment as a separate item and shall not 21 20 include such payments in the amounts otherwise reported as the 21 21 reimbursement to a qualifying hospital for services to medical 21 22 assistance recipients. 21 23 For purposes of this section, "supplemental payment" means 21 24 a supplemental payment amount paid for medical assistance to a 21 25 hospital qualifying for that payment under this section. 21 26 Sec. 16. For the fiscal year beginning July 1, 1997, and 21 27 ending June 30, 1998, the state board of regents may use 21 28 notes, bonds, or other evidences of indebtedness issued under 21 29 section 262.48 to finance projects that will result in energy 21 30 cost savings in an amount that will cause the state board to 21 31 recover the cost of the projects within an average of six 21 32 years. 21 33 Sec. 17. REMAINING INTEREST FOR IOWA SCHOOLS FUND BALANCE. 21 34 Notwithstanding section 257B.1A, subsection 5, Code 1995, or 21 35 any other provision to the contrary, the interest remaining 22 1 unencumbered or unobligated on June 30, 1996, in the interest 22 2 for Iowa schools fund, after the total of the transfer of 22 3 moneys to the first in the nation in education foundation 22 4 pursuant to section 257B.1A, subsection 2, and after the 22 5 transfer of moneys to the international center endowment fund 22 6 in section 257B.1A, subsection 3, paragraph "a", shall be 22 7 transferred to the state board of regents, which shall 22 8 distribute the moneys by July 1, 1997, to the state university 22 9 of Iowa for the fiscal year beginning July 1, 1997, and ending 22 10 June 30, 1998, for purposes of the reading recovery program. 22 11 The university of Iowa shall work with the department of 22 12 education to coordinate the support system for delivery of the 22 13 reading recovery program to school districts. 22 14 Sec. 18. Notwithstanding section 270.7, the department of 22 15 revenue and finance shall pay the state school for the deaf 22 16 and the Iowa braille and sight saving school the moneys 22 17 collected from the counties during the fiscal year beginning 22 18 July 1, 1997, for expenses relating to prescription drug costs 22 19 for students attending the state school for the deaf and the 22 20 Iowa braille and sight saving school. 22 21 Sec. 19. ADDITIONAL FUNDING FOR PROGRAMS FOR AT-RISK 22 22 CHILDREN. In addition to the funds appropriated in section 22 23 279.51, subsection 1, there is appropriated from the general 22 24 fund of the state to the department of education for the 22 25 fiscal year beginning July 1, 1997, and ending June 30, 1998, 22 26 the amount of $190,000 to be allocated to the child 22 27 development coordinating council established in chapter 256A 22 28 for the purposes set out in section 279.51, subsection 2, and 22 29 section 256A.3. 22 30 Sec. 20. Section 19A.3, subsection 24, unnumbered 22 31 paragraph 2, Code 1997, is amended to read as follows: 22 32 The director of the department of personnel shall negotiate 22 33agreementsan agreement with the director of the department 22 34 for the blindand with the director of the department of22 35educationconcerning the applicability of the merit system to 23 1 the professional employees oftheir respective agenciesthe 23 2 department for the blind. 23 3 Sec. 21. Section 256.10, Code 1997, is amended to read as 23 4 follows: 23 5 256.10 EMPLOYMENT OF PROFESSIONAL STAFF. 23 6 The salary of the director shall be fixed by the governor 23 7 within a range established by the general assembly. 23 8 Appointments to the professional staff of the department shall 23 9 be without reference to political party affiliation, religious 23 10 affiliation, sex, or marital status, but shall be based solely 23 11 upon fitness, ability, and proper qualifications for the 23 12 particular position. The professional staff shall serve at 23 13 the discretion of the director. A member of the professional 23 14 staff shall not be dismissed for cause withoutat least ninety23 15days' notice, except in cases of conviction of a felony or23 16cases involving moral turpitudeappropriate due process 23 17 procedures including a hearing.In cases of procedure for23 18dismissal, the accused has the same right to notice and23 19hearing as teachers in the public school systems as provided23 20in section 279.27 to the extent that it is applicable.23 21 Sec. 22. Section 257B.1A, Code 1997, is amended by 23 22 striking the section and inserting in lieu thereof the 23 23 following: 23 24 257B.1A INTEREST FOR IOWA SCHOOLS FUND TRANSFER OF 23 25 INTEREST. 23 26 1. The interest for Iowa schools fund is established in 23 27 the office of the treasurer of state. The department of 23 28 revenue and finance shall deposit interest earned on the 23 29 permanent school fund in the interest for Iowa schools fund. 23 30 Of the interest deposited in the interest for Iowa schools 23 31 fund each year, fifty percent shall be transferred to the 23 32 first in the nation in education foundation as established in 23 33 section 257A.1 and fifty percent shall be transferred to the 23 34 international center for gifted and talented education 23 35 endowment fund established in section 263.8A. The department 24 1 of revenue and finance shall transfer interest as provided in 24 2 this section on a quarterly basis. As a condition of 24 3 receiving funds under this section, the foundation and the 24 4 center shall maintain and continue to increase the balances of 24 5 their private foundations. In addition, the foundation and 24 6 the center shall each certify to the department of revenue and 24 7 finance and the general assembly, by January 1 of each year, 24 8 the cumulative total value of contributions received during 24 9 the preceding calendar year. 24 10 2. If the general assembly appropriates funds to the 24 11 international center endowment fund in the amount of not less 24 12 than eight hundred seventy-five thousand dollars prior to July 24 13 1, 1998, the center's interest allocation shall decrease to 24 14 twenty-five percent. If the general assembly appropriates 24 15 funds to the international center endowment fund in an amount 24 16 of not less than one million five hundred fifty thousand 24 17 dollars, the center shall no longer receive an interest 24 18 allocation. 24 19 3. The foundation shall use for administrative costs not 24 20 more than twenty-five percent of any moneys received annually 24 21 pursuant to this section. 24 22 Sec. 23. Section 260C.14, Code 1997, is amended by adding 24 23 the following new subsection: 24 24 NEW SUBSECTION. 2A. Cause to be printed on all statements 24 25 of account for payment of tuition and fees issued by the 24 26 community college the portion of the average cost of an Iowa 24 27 resident student's education at that community college that is 24 28 paid by appropriations from the general fund of the state. 24 29 The information, rounded to the nearest one-tenth of one 24 30 percent and the nearest whole dollar, shall be included in the 24 31 following statement: 24 32 "Tuition pays for approximately ____% of the average cost 24 33 for a resident Iowa student at this community college. The 24 34 State of Iowa pays approximately $____ of the average cost for 24 35 a full-time state resident student at this community college." 25 1 Sec. 24. Section 260C.29, subsections 1 and 2, Code 1997, 25 2 are amended to read as follows: 25 3 1. The mission of thecareer opportunityacademic 25 4 incentives for minorities program established in this section 25 5 is to encourage collaborative efforts byacommunitycollege25 6 colleges, the institutions of higher learning under the 25 7 control of the state board of regents, and business and 25 8 industry to enhancetheeducational opportunities and provide 25 9 for job creation and career advancement for Iowa'sminority25 10personsminorities by providing assistance tominority persons25 11 minorities who major in fields or subject areas where 25 12 minorities are currently underrepresented or underutilized. 25 13 2.A career opportunityAn academic incentives for 25 14 minorities program is established to be administered bythea 25 15 community college located in a county with a population in 25 16 excess of three hundred thousand. The community college shall 25 17 provide office space for the efficient operation of the 25 18 program. The community college shall employ a director for 25 19 the program. The director of the program shall employ 25 20 necessary support staff. The director and staff shall be 25 21 employees of the community college. 25 22 Sec. 25. Section 261.12, subsection 1, paragraph b, Code 25 23 1997, is amended to read as follows: 25 24 b. For the fiscal year beginning July 1, 1996, and for 25 25 each following fiscal year, three thousandonefour hundred 25 26fiftydollars. 25 27 Sec. 26. Section 261.17, subsections 1, 2, and 4, Code 25 28 1997, are amended to read as follows: 25 29 1. A vocational-technical tuition grant may be awarded to 25 30 any resident of Iowa who is admitted and in attendance as a 25 31 full-time or part-time student in a vocational-technical or 25 32 career option program at a community college in the state, and 25 33 who establishes financial need. 25 34 2. A qualified full-time student may receive vocational- 25 35 technical tuition grants for not more than four semesters, 26 1 eight quarters or the equivalent of two full years of study. 26 2 The amount of a vocational-technical tuition grant to a 26 3 qualified part-time student enrolled in a course of study 26 4 including at least three semester hours but fewer than twelve 26 5 semester hours or the trimester or quarter equivalent shall be 26 6 equal to the amount of a tuition grant that would be paid to a 26 7 full-time student times a number which represents the number 26 8 of hours in which the part-time student is actually enrolled 26 9 divided by twelve semester hours, or the trimester or quarter 26 10 equivalent. 26 11 PARAGRAPH DIVIDED. However, if a student resumes study 26 12 after at least a two-year absence, the student may again be 26 13 eligible for the specified amount of time, except that the 26 14 student shall not receive assistance for courses for which 26 15 credit was previously received. 26 16 4. A vocational-technical tuition grant shall be awarded 26 17 on an annual basis, requiring reapplication by the student for 26 18 each year. Payments under the grant shall be allocated 26 19 equally among the semesters or quarters of the year upon 26 20 certification by the institution that the student is in full- 26 21 time or part-time attendance in a vocational-technical or 26 22 career option program, as defined under rules of the 26 23 department of education. If the student discontinues 26 24 attendance before the end of any term after receiving payment 26 25 of the grant, the entire amount of any refund due that 26 26 student, up to the amount of any payments made under the 26 27 annual grant, shall be paid by the institution to the state. 26 28 Sec. 27. Section 261.25, subsection 1, Code 1997, is 26 29 amended to read as follows: 26 30 1. There is appropriated from the general fund of the 26 31 state to the commission for each fiscal year the sum of 26 32thirty-eightforty-one million six hundred sixty-four thousand 26 33 seven hundred fifty dollars for tuition grants. 26 34 Sec. 28. Section 262.9, subsection 24, Code 1997, is 26 35 amended to read as follows: 27 1 24. Develop a policy requiring oral communication 27 2 competence of persons who provide instruction to students 27 3 attending institutions under the control of the board. The 27 4 policy shall include a student evaluation mechanism which 27 5 requires student evaluation of persons providing instruction 27 6 on at least an annual basis. However, the board shall 27 7 establish criteria by which an institution may discontinue 27 8 annual evaluations of a specific person providing instruction. 27 9 The criteria shall include receipt by the institution of two 27 10 consecutive positive annual evaluations from the majority of 27 11 students evaluating the person. 27 12 Sec. 29. Section 262.9, Code 1997, is amended by adding 27 13 the following new subsection: 27 14 NEW SUBSECTION. 30. Cause to be printed on all statements 27 15 of account for payment of tuition and fees issued by each 27 16 institution of higher learning under the control of the board 27 17 the portion of the average cost of an Iowa resident student's 27 18 education at the institution issuing the statement that is 27 19 paid by appropriations from the general fund of the state. 27 20 The information, rounded to the nearest one-tenth of one 27 21 percent and the nearest whole dollar, shall be included in the 27 22 following statement: 27 23 "Tuition pays for approximately ____% of the average cost 27 24 for a resident Iowa student at this institution of higher 27 25 learning. The State of Iowa pays approximately $____ of the 27 26 average cost for a full-time state resident student at this 27 27 institution of higher learning." 27 28 Sec. 30. Section 294A.25, Code 1997, is amended by adding 27 29 the following new subsections: 27 30 NEW SUBSECTION. 4A. For the fiscal year beginning July 1, 27 31 1997, and ending June 30, 1998, the amount of fifty thousand 27 32 dollars to be paid to the department of education for 27 33 participation in a state and national project, the national 27 34 assessment of education progress, to determine the academic 27 35 achievement of Iowa students in math, reading, science, United 28 1 States history, or geography. 28 2 NEW SUBSECTION. 4B. For the fiscal year beginning July 1, 28 3 1997, and ending June 30, 1998, the amount of fifty thousand 28 4 dollars to the department of education for the geography 28 5 alliance. 28 6 NEW SUBSECTION. 7A. For the fiscal year beginning July 1, 28 7 1997, and ending June 30, 1998, the amount of seventy thousand 28 8 dollars to the state board of regents for equal distribution 28 9 to the Iowa braille and sight saving school and the Iowa state 28 10 school for the deaf from phase III moneys. 28 11 Sec. 31. Section 294A.25, subsections 7 and 8, Code 1997, 28 12 are amended to read as follows: 28 13 7. Commencing with the fiscal year beginning July 1,199628 14 1997, the amount offifty thousand dollars for geography28 15alliance and onetwo hundredeightythirty thousand dollars 28 16 for a kindergarten to grade twelve management information 28 17 system from additional funds transferred from phase I to phase 28 18 III. 28 19 8. For the fiscal year beginning July 1,19961997, and 28 20 ending June 30,19971998, to the department of education from 28 21 phase III moneys the amount of one million two hundred fifty 28 22 thousand dollars for support for the operations of the new 28 23 Iowa schools development corporation and for school 28 24 transformation design and implementation projects administered 28 25 by the corporation. Of the amount provided in this 28 26 subsection, one hundred fifty thousand dollars shall be used 28 27 for the school and community planning initiative. 28 28 Sec. 32. Section 303.3, subsection 3, Code 1997, is 28 29 amended by striking the subsection and inserting in lieu 28 30 thereof the following: 28 31 3. Notwithstanding section 8.33, moneys committed to 28 32 grantees under this section that remain unencumbered or 28 33 unobligated on June 30 of the fiscal year for which the funds 28 34 were appropriated shall not revert but shall be available for 28 35 expenditure for the following fiscal year for the purposes of 29 1 subsection 2. 29 2 Sec. 33. Section 321.34, subsection 21, paragraph c, 29 3 subparagraph (2), Code 1997, is amended to read as follows: 29 4 (2) Twenty-five percent shall be allocated to the 29 5 department ofeducationcultural affairs. The department 29 6 shall use the moneys to support teacher training in Iowa 29 7 history, to purchase Iowa history classroom materials, to 29 8 support student participation in Iowa history and citizenship- 29 9 building activities, and to create a grant program for school 29 10 districts to apply for funding to support field trips to 29 11 museums, historic sites, and heritage attractions. 29 12 Sec. 34. FUNDS TRANSFERRED. For the fiscal year 29 13 beginning July 1, 1997, and ending June 30, 1998, the 29 14 following amounts for the purposes designated shall be paid to 29 15 the department of education from additional funds transferred 29 16 from phase I to phase III: 29 17 1. For Iowa public television overnight transmitter feeds: 29 18 .................................................. $ 150,000 29 19 2. For contracting with the Iowa alliance for arts 29 20 education to execute the local arts comprehensive educational 29 21 strategies program (LACES): 29 22 .................................................. $ 50,000 29 23 3. For allocation to area education agencies to assist 29 24 school districts in developing reading recovery programs: 29 25 .................................................. $ 50,000 29 26 If funds available are insufficient to fully fund the 29 27 amount designated for the reading recovery program under this 29 28 section, the amount distributed for the reading recovery 29 29 programs shall be reduced to an amount equal to the available 29 30 funds. 29 31 Sec. 35. EFFECTIVE DATES. 29 32 1. Section 6 of this Act, relating to moneys designated 29 33 for the Iowa state arts council for purposes of awarding 29 34 operational support grants, being deemed of immediate 29 35 importance, takes effect upon enactment. 30 1 2. Section 8 of this Act, relating to carryover for the 30 2 career pathways program, being deemed of immediate importance, 30 3 takes effect upon enactment. 30 4 3. Section 9 of this Act, relating to the state of Iowa 30 5 libraries online (SILO) program, being deemed of immediate 30 6 importance, takes effect upon enactment. 30 7 4. Section 13 of this Act, relating to tuition 30 8 replacement, being deemed of immediate importance, takes 30 9 effect upon enactment. 30 10 5. Section 14 of this Act, relating to the nonreversion of 30 11 funds appropriated for the national advanced driving 30 12 simulator, being deemed of immediate importance, takes effect 30 13 upon enactment. 30 14 6. Section 17 of this Act, relating to the remaining 30 15 interest for Iowa schools fund balance, being deemed of 30 16 immediate importance, takes effect upon enactment. 30 17 Sec. 36. The section of this Act that amends section 30 18 257B.1A applies to interest earned on or after July 1, 1997. 30 19 Sec. 37. EFFECTIVE DATE. Sections 23 and 29 of this Act, 30 20 relating to statements of account, being deemed of immediate 30 21 importance, take effect upon enactment and apply to statements 30 22 of account issued after January 1, 1998. 30 23 SF 549 30 24 kh/cc/26
