  1  1    Section 1.  Section 2.12, unnumbered paragraph 4, Code
  1  2 1997, is amended to read as follows:
  1  3    There is appropriated out of any funds in the state
  1  4 treasury not otherwise appropriated such sums as may be
  1  5 necessary for the fiscal year budgets of the legislative
  1  6 service bureau, the legislative fiscal bureau, the legislative
  1  7 information technology bureau, the citizens' aide office and
  1  8 the computer support bureau for salaries, support,
  1  9 maintenance, and miscellaneous purposes to carry out their
  1 10 statutory responsibilities.  The legislative service bureau,
  1 11 the legislative fiscal bureau, the legislative information
  1 12 technology bureau, the citizens' aide office and the computer
  1 13 support bureau shall submit their proposed budgets to the
  1 14 legislative council not later than September 1 of each year.
  1 15 The legislative council shall review and approve the proposed
  1 16 budgets not later than December 1 of each year.  The budget
  1 17 approved by the legislative council for each of its statutory
  1 18 legislative agencies shall be transmitted by the legislative
  1 19 council to the department of management on or before December
  1 20 1 of each year for the fiscal year beginning July 1 of the
  1 21 following year.  The department of management shall submit the
  1 22 approved budgets received from the legislative council to the
  1 23 governor for inclusion in the governor's proposed budget for
  1 24 the succeeding fiscal year.  The approved budgets shall also
  1 25 be submitted to the chairpersons of the committees on
  1 26 appropriations.  The committees on appropriations may allocate
  1 27 from the funds appropriated by this section the funds
  1 28 contained in the approved budgets, or such other amounts as
  1 29 specified, pursuant to a concurrent resolution to be approved
  1 30 by both houses of the general assembly.  The director of
  1 31 revenue and finance shall issue warrants for salaries,
  1 32 support, maintenance, and miscellaneous purposes upon
  1 33 requisition by the administrative head of each statutory
  1 34 legislative agency.  If the legislative council elects to
  1 35 change the approved budget for a legislative agency prior to
  2  1 July 1, the legislative council shall transmit the amount of
  2  2 the budget revision to the department of management prior to
  2  3 July 1 of the fiscal year, however, if the general assembly
  2  4 approved the budget it cannot be changed except pursuant to a
  2  5 concurrent resolution approved by the general assembly.
  2  6    Sec. 2.  Section 2.44, unnumbered paragraph 2, Code 1997,
  2  7 is amended to read as follows:
  2  8    Members of special interim study committees which may from
  2  9 time to time be created, and members of the legislative fiscal
  2 10 committee who are not members of the legislative council, and
  2 11 members of the oversight and communications committee who are
  2 12 not members of the legislative council shall be entitled to
  2 13 receive the same expenses and compensation provided for the
  2 14 members of the legislative council.
  2 15    Sec. 3.  NEW SECTION.  2.45A  OVERSIGHT AND COMMUNICATIONS
  2 16 COMMITTEE.
  2 17    The legislative council shall establish an oversight and
  2 18 communications committee.  The membership of the committee is
  2 19 composed of the chairpersons or their designated committee
  2 20 members and the ranking minority party members or their
  2 21 designated committee members of the joint budget subcommittee
  2 22 responsible for developing a budget and appropriating funds to
  2 23 be used primarily for state communications and technology-
  2 24 related purposes.  To the extent possible, the other members
  2 25 of the committee shall also be members of the joint budget
  2 26 subcommittee responsible for developing a budget and
  2 27 appropriating funds to be used primarily for state
  2 28 communications and technology-related purposes.
  2 29    Sec. 4.  NEW SECTION.  2.45B  POWERS AND DUTIES OF THE
  2 30 OVERSIGHT AND COMMUNICATIONS COMMITTEE.
  2 31    1.  The purpose of the oversight and communications
  2 32 committee is to review and analyze the structure and
  2 33 operations of state government and the use of information
  2 34 technology in enhancing the ability of the public to interact
  2 35 with state government.
  3  1    2.  The committee shall be staffed by the legislative
  3  2 information technology bureau, legislative service bureau, and
  3  3 legislative fiscal bureau.
  3  4    3.  The committee, subject to the approval of the
  3  5 legislative council, may conduct a review of one or more
  3  6 programs or regulations administered or enforced by state
  3  7 government.
  3  8    4.  The committee shall prepare a final report and a
  3  9 summary of the report for submission to the general assembly
  3 10 not later than the first day of each regular session of the
  3 11 general assembly as provided in section 2.1.  The report shall
  3 12 contain findings and recommendations of the committee, which
  3 13 may include proposed bills or resolutions.
  3 14    Sec. 5.  NEW SECTION.  2.45C  PROCEDURES.
  3 15    The oversight and communications committee shall determine
  3 16 its own procedures and shall meet as often as deemed
  3 17 necessary, subject to the approval of the legislative council.
  3 18 The committee shall keep a record of its proceedings which
  3 19 shall be open to public inspection, and it shall inform the
  3 20 legislative council in advance concerning the dates of
  3 21 meetings of the committee.
  3 22    Sec. 6.  NEW SECTION.  2.70  INFORMATION TECHNOLOGY BUREAU
  3 23 – RESPONSIBILITIES.
  3 24    1.  A legislative information technology bureau is created
  3 25 which shall operate under the direction and control of the
  3 26 legislative council.  The administrative head of the
  3 27 legislative information technology bureau is the director of
  3 28 the bureau.  The bureau shall cooperate with and serve all
  3 29 members of the general assembly, the legislative council, the
  3 30 oversight and communications committee, and other committees
  3 31 of the general assembly.  The legislative council shall have
  3 32 the sole power and duty to allocate the work load of the
  3 33 bureau but may delegate such duty to the director of the
  3 34 legislative information technology bureau.
  3 35    2.  The legislative information technology bureau shall do
  4  1 all of the following:
  4  2    a.  Continuously review the use of information technology
  4  3 by all of state government.
  4  4    b.  Develop effective strategies regarding an enterprise-
  4  5 wide basis for the delivery and use of information technology
  4  6 throughout state government.
  4  7    c.  Report to the oversight and communications committee as
  4  8 required by the committee.
  4  9    d.  Report to the legislative council as required by the
  4 10 council.
  4 11    e.  Report to the general assembly after the convening of
  4 12 each legislative session and as otherwise required by the
  4 13 general assembly.
  4 14    Sec. 7.  NEW SECTION.  2.71  DIRECTOR – DUTIES.
  4 15    1.  The director of the legislative information technology
  4 16 bureau shall be appointed by the legislative council, upon
  4 17 recommendation of the oversight and communications committee.
  4 18 The salary of the director of the bureau shall be set by the
  4 19 legislative council.
  4 20    2.  The director shall do all of the following:
  4 21    a.  Employ and supervise all employees of the legislative
  4 22 information technology bureau in such positions and at such
  4 23 salaries as shall be authorized by the legislative council.
  4 24    b.  With the approval of the legislative council or its
  4 25 chairperson, employ such technical consultants as may be
  4 26 necessary to provide research and development of effective
  4 27 strategies regarding an enterprise-wide basis for the delivery
  4 28 and use of information technology.
  4 29    c.  Supervise all expenditures of the legislative
  4 30 information technology bureau with the approval of the
  4 31 legislative council.
  4 32    d.  Attend, or designate a representative to attend, budget
  4 33 hearings required under section 8.26, and offer explanations
  4 34 or suggestions and make inquiries with respect to such
  4 35 hearings regarding information technology.
  5  1    Sec. 8.  Sections 3 through 5 of this Act, being deemed of
  5  2 immediate importance, take effect upon enactment.  
  5  3                           EXPLANATION
  5  4    This bill establishes an oversight and communications
  5  5 committee and a legislative information technology bureau.
  5  6    The bill provides that the oversight and communications
  5  7 committee is established under the legislative council.
  5  8    The membership of the committee is composed of the
  5  9 chairpersons or their designated committee members and the
  5 10 ranking minority party members or their designated committee
  5 11 members of the joint budget subcommittee responsible for
  5 12 developing a budget and appropriating funds to be used
  5 13 primarily for state communications and technology-related
  5 14 purposes.  To the extent possible, the remaining members of
  5 15 the committee are to be members of the subcommittee as well.
  5 16    The committee is to review and analyze the structure and
  5 17 operations of state government and the use of information
  5 18 technology in enhancing the ability of the public to interact
  5 19 with state government.
  5 20    The bill establishes a legislative information technology
  5 21 bureau operating under the control and direction of the
  5 22 legislative council.  The administrative head of the
  5 23 legislative information technology bureau is the director who
  5 24 is to be appointed by the legislative council.  The
  5 25 legislative information technology bureau is to continuously
  5 26 review the use of information technology by all of state
  5 27 government, develop effective strategies regarding an
  5 28 enterprise-wide basis for the delivery and use of information
  5 29 technology throughout state government, report to the
  5 30 oversight and communications committee as required by the
  5 31 committee, report to the legislative council as required by
  5 32 the council, and report to the general assembly after the
  5 33 convening of each legislative session and as otherwise
  5 34 required by the general assembly.
  5 35    The bill provides that provisions relating to the oversight
  6  1 and communications committee take effect upon enactment.
