PAG LIN 1 1 Section 1. Section 331.321, subsection 1, paragraph n, 1 2 Code 1997, is amended to read as follows: 1 3 n.Two membersOne member of the county compensation board 1 4 in accordance with section 331.905. 1 5 Sec. 2. Section 331.905, subsections 1 and 2, Code 1997, 1 6 are amended by striking the subsections and inserting in lieu 1 7 thereof the following: 1 8 1. A county compensation board is created in each county 1 9 which shall be composed of five members who are residents of 1 10 the county. The members of the county compensation board 1 11 shall be as follows: 1 12 a. One member shall be a mayor or member of the city 1 13 council of a city located within the county selected by a 1 14 convention of the representatives of all cities located within 1 15 the county. Each city shall be represented at the convention 1 16 by the mayor or a member of the city council selected by the 1 17 mayor and the members of the city council. 1 18 b. One member shall be a member of a board of directors of 1 19 a school district located within the county selected by a 1 20 convention of the representatives of the boards of directors 1 21 of all school districts located within the county. Each board 1 22 of directors of a school district shall select a 1 23 representative to the convention from among its membership. 1 24 c. One member shall be an elector of the county 1 25 representing the general public selected by the supervisors. 1 26 d. One member shall be a person representing the general 1 27 public selected by a convention of the representatives of the 1 28 incorporated cities located within the county. 1 29 e. One member shall be a person representing the general 1 30 public selected by a convention of the representatives of the 1 31 boards of directors of the school districts located within the 1 32 county. 1 33 2. a. A member of the county compensation board selected 1 34 to represent the general public pursuant to subsection 1, 1 35 paragraph "c", "d", or "e", shall not be an employee or 2 1 officer of the state or a political subdivision of the state, 2 2 and shall not be related within the third degree of 2 3 consanguinity or affinity to such an employee or officer. 2 4 b. The members of the county compensation board shall be 2 5 appointed to four-year, staggered terms of office. The terms 2 6 of office of members of the initial board shall be determined 2 7 by lot. A term shall be effective on the first of July of the 2 8 year of appointment and a vacancy shall be filled for the 2 9 unexpired term in the same manner as the original appointment. 2 10 In addition to the circumstances which constitute a vacancy 2 11 under section 69.2, a vacancy exists on the county 2 12 compensation board if a member of the board who is also an 2 13 elective public officer ceases to hold the elective office 2 14 under which the officer originally qualified for membership or 2 15 if a member of the board who is selected under subsection 1, 2 16 paragraph "c", "d", or "e", becomes an employee or officer of 2 17 the state or a political subdivision of the state or is 2 18 related within the third degree of consanguinity to such an 2 19 employee or officer. 2 20 Sec. 3. NEW SECTION. 331.906 CONVENTION – MEMBERSHIP 2 21 SELECTION. 2 22 1. The auditor shall convene the conventions of the 2 23 representatives of the cities and the boards of directors of 2 24 the school districts during the month of June of each odd- 2 25 numbered year, by written notice stating the date, time, and 2 26 location of each convention meeting to each person eligible to 2 27 attend the convention. When a vacancy exists which must be 2 28 filled by a convention, the auditor shall convene a special 2 29 meeting of the convention within thirty days after the auditor 2 30 becomes aware of the vacancy. 2 31 2. If the boundaries of a school district or a city extend 2 32 into more than one county, a representative of the board of 2 33 directors of the school district or of the city shall be a 2 34 member of the convention of the boards of directors or of the 2 35 cities in the county of the representative's residence only. 3 1 3. Each convention of the representatives of the boards of 3 2 directors or of the cities shall organize by electing a 3 3 chairperson and other officers as necessary from among its 3 4 membership. Each member of the county compensation board to 3 5 be selected by the convention shall be elected by a majority 3 6 vote of the members of the convention. 3 7 4. The members of the convention shall receive 3 8 compensation and reimbursement for expenses incurred in the 3 9 performance of their duties from the school district or the 3 10 city which the member represents if the compensation or 3 11 reimbursement is otherwise authorized by law. 3 12 Sec. 4. EFFECTIVE DATE – TRANSITION. This Act takes 3 13 effect on June 1, 1997. The terms of office of members of the 3 14 county compensation board serving unexpired terms immediately 3 15 before the effective date of this Act shall expire on June 1, 3 16 1997, and their successors shall be appointed as provided in 3 17 this Act. 3 18 EXPLANATION 3 19 This bill creates a county compensation board which is 3 20 composed of five residents of the county. One member shall be 3 21 a mayor or member of a city council selected by a convention 3 22 of representatives of the mayors and city council members 3 23 residing in the county. One member shall be a member of the 3 24 board of directors of a school district selected by the 3 25 representatives of the members of the boards of directors of 3 26 all school districts in the county. Another member shall be 3 27 an elector of the county selected by the board of supervisors. 3 28 One member shall be selected by the convention of the 3 29 representatives of the mayors and city council members of the 3 30 cities in the county. The final member shall be a 3 31 representative of the general public selected by the 3 32 convention of the representatives of the boards of directors 3 33 of the school districts in the county. 3 34 The members of the county compensation board representing 3 35 the general public shall not be public officers or employees 4 1 of the state or a political subdivision of the state, or 4 2 related within the third degree of consanguinity or affinity 4 3 of such an officer or employee. The county compensation board 4 4 members are appointed to four-year, staggered terms of office. 4 5 The conventions of the city officers and school district 4 6 directors are called by the county auditor during the month of 4 7 June of each odd-numbered year and within 30 days after a 4 8 vacancy occurs which must be filled by the convention. If a 4 9 school district or city extends into more than one county, the 4 10 city officer or school director shall participate in the 4 11 county of the officer's or director's residence only. 4 12 This bill takes effect on June 1, 1997. 4 13 LSB 2078SS 77 4 14 tj/jw/5
