PAG LIN 1 1 Amend Senate File 5 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. Section 321.34, Code 1997, is amended 1 5 by adding the following new subsection: 1 6 NEW SUBSECTION. 8A. EX-PRISONER OF WAR SPECIAL 1 7 PLATES. The owner of a motor vehicle subject to 1 8 registration under section 321.109, subsection 1, 1 9 light delivery truck, panel delivery truck, or pickup 1 10 who was a prisoner of war during the Second World War 1 11 at any time between December 7, 1941, and December 31, 1 12 1946, the Korean Conflict at any time between June 25, 1 13 1950, and January 31, 1955, or the Vietnam Conflict at 1 14 any time between August 5, 1964, and June 30, 1973, 1 15 all dates inclusive, may, upon written application to 1 16 the department, order only one set of special 1 17 registration plates with an ex-prisoner of war 1 18 processed emblem. The emblem shall be designed by the 1 19 department in cooperation with the adjutant general 1 20 and shall signify that the owner was a prisoner of war 1 21 as described in this subsection. The application is 1 22 subject to approval by the department, in consultation 1 23 with the adjutant general. The special plates shall 1 24 be issued at no charge and are subject to an annual 1 25 fee registration of fifteen dollars. The county 1 26 treasurer shall validate the special plates in the 1 27 same manner as regular registration plates are 1 28 validated under this section. 1 29 The surviving spouse of a person who was issued 1 30 special plates under this subsection may continue to 1 31 use the special plates subject to registration of the 1 32 special plates in the surviving spouse's name and upon 1 33 payment of the annual registration fee. If the 1 34 surviving spouse remarries, the surviving spouse shall 1 35 return the special plates to the department and the 1 36 department shall issue regular registration plates to 1 37 the surviving spouse. 1 38 Sec. 2. Section 321.34, subsection 15, Code 1997, 1 39 is amended by striking the subsection. 1 40 Sec. 3. A person eligible to be issued ex-prisoner 1 41 of war special plates who ordered and paid for the 1 42 special plates on or after January 1, 1997, but prior 1 43 to the effective date of this Act shall be entitled to 1 44 a refund from the state department of transportation 1 45 of all fees in excess of fifteen dollars paid for 1 46 issuance of one set of the special plates. 1 47 Notwithstanding any provision of the Code to the 1 48 contrary, refunds shall be paid by the department from 1 49 registration fees deposited in the road use tax fund 1 50 under section 321.145. 2 1 A person who obtained more than one set of special 2 2 plates under section 321.34, subsection 15, shall 2 3 surrender the additional sets of special plates not 2 4 later than the end of the registration year for which 2 5 the plates were issued. A refund shall not be issued 2 6 for additional sets of special plates. 2 7 Sec. 4. EFFECTIVE AND APPLICABILITY DATE. This 2 8 Act, being deemed of immediate importance, takes 2 9 effect upon enactment and is retroactively applicable 2 10 to January 1, 1997." 2 11 #2.
