There is appropriated from the general fund of 1 14 the state to the college student aid commission for the fiscal 1 15 year beginning July 1, 1998, and ending June 30, 1999, the 1 16 following amounts, or so much thereof as may be necessary, to 1 17 be used for the purposes designated: 1 18 1. Notwithstanding the maximum allowed balance 2 21 requirement of the scholarship and tuition grant reserve fund 2 22 as provided in section 261.20, there is appropriated from the 2 23 scholarship and tuition grant reserve fund to the college 2 24 student aid commission for the fiscal year beginning July 1, 2 25 1998, and ending June 30, 1999, the moneys remaining in the 2 26 fund following transfer, pursuant to section 261.20 for the 2 27 fiscal years ending June 30, 1997, and June 30, 1998, which 2 28 are to be used for purposes of Iowa vocational-technical 2 29 tuition grants in accordance with section 261.17. Funds 2 30 appropriated in this section are in addition to funds 2 31 appropriated in section 261.25, subsection 3. 2 32 Sec. 4. The department of revenue and finance shall 2 33 deposit interest earned on the Pub. L. No. 105-33 recall 2 34 account within the office of the treasurer of state during the 2 35 fiscal year ending June 30, 1998, in the fund 61 default 3 1 reduction account. Moneys in the fund 61 default reduction 3 2 account are appropriated to the college student aid commission 3 3 for the fiscal year beginning July 1, 1998, and ending June 3 4 30, 1999, for purposes of issuing emergency loans to assist 3 5 needy students in avoiding default on a guaranteed or parental 3 6 loan made under chapter 261. 3 7 DEPARTMENT OF CULTURAL AFFAIRS 3 8 Sec. 5. HISTORIC SITES WESTERN TRAILS CENTER. 4 26 Notwithstanding section 8.33, the unencumbered or unobligated 4 27 moneys remaining at the end of the fiscal year ending June 30, 4 28 1998, from the appropriations made in 1997 Iowa Acts, chapter 4 29 212, section 5, subsection 3, shall not revert but shall be 4 30 available for expenditure during subsequent fiscal years for 4 31 purposes of support, staffing, marketing, outreach, and 4 32 programs at the western trails center in Council Bluffs. 4 33 Sec. 7. NATIONAL ARTS RANKING SURVEYS. The department of 4 34 cultural affairs shall, when calculating the amount of state 4 35 financial assistance for the arts in national ranking surveys, 5 1 include the amount appropriated for the local arts 5 2 comprehensive educational strategies program, as well as the 5 3 total estimated cost of the fine arts elements included in a 5 4 plan and specifications for a state building or group of state 5 5 buildings in accordance with section 304A.10. 5 6 DEPARTMENT OF EDUCATION 5 7 Sec. 8. The 6 11 merit system provisions of chapter 19A and the provisions of 6 12 chapter 20 shall not govern this transition movement into 6 13 these full-time equivalent positions during the period 6 14 beginning July 1, 1998, and ending August 31, 1998. 6 15 From the funds appropriated in this subsection, up to 6 16 $2,000,000 shall be used to provide services to persons 6 17 without regard to an order of selection. The division shall 6 18 seek additional local matching funds in an amount sufficient 6 19 to avoid any loss of federal funds. 6 20 The division of vocational rehabilitation services shall 6 21 seek a waiver from the federal government to accept 6 22 assessments of clients performed by area education agencies or 6 23 any other governmental subdivision. The division shall also 6 24 seek additional federal waivers to improve and increase the 6 25 availability of supported employment services to Iowans. 6 26 The division of vocational rehabilitation services shall 6 27 seek funds other than federal funds, which may include but are 6 28 not limited to local funds from local provider entities, 6 29 community colleges, area education agencies, and local 6 30 education agencies, for purposes of matching federal 6 31 vocational rehabilitation funds. The funds collected by the 6 32 division may exceed the amount needed to match available 6 33 federal vocational rehabilitation funds in an effort to 6 34 qualify for additional federal funds when such funds become 6 35 available. 7 1 Except where prohibited under federal law, the division of 7 2 vocational rehabilitation services of the department of 7 3 education shall accept client assessments, or assessments of 7 4 potential clients, performed by other agencies in order to 7 5 reduce duplication of effort. 7 6 Notwithstanding the full-time equivalent position limit 7 7 established in this subsection, for the fiscal year ending 7 8 June 30, 1999, if federal funding is received to pay the costs 7 9 of additional employees for the vocational rehabilitation 7 10 services division who would have duties relating to vocational 7 11 rehabilitation services paid for through federal funding, 7 12 authorization to hire not more than four additional full-time 7 13 equivalent employees shall be provided, the full-time 7 14 equivalent position limit shall be exceeded, and the 7 15 additional employees shall be hired by the division. 7 16 The division of vocational rehabilitation services shall 7 17 enter into a chapter 28E agreement with the creative 7 18 employment options program at the state university of Iowa to 7 19 enable the division to count as a local match the state funds 7 20 appropriated to the university for purposes of the creative 7 21 employment options program. 7 22 b. For matching funds for programs to enable persons with 7 23 severe physical or mental disabilities to function more 7 24 independently, including salaries and support, and for not 7 25 more than the following full-time equivalent positions: 7 26 .................................................. $ 75,631 7 27 ............................................... Funds shall be used 9 1 as reimbursement for vocational education expenditures made by 9 2 secondary schools in the manner provided by the department of 9 3 education for implementation of the standards set in 1989 Iowa 9 4 Acts, chapter 278. 9 5 9. SCHOOL FOOD SERVICE 9 6 For use as state matching funds for federal programs that 9 7 shall be disbursed according to federal regulations, including 9 8 salaries, support, maintenance, miscellaneous purposes, and 9 9 for not more than the following full-time equivalent 9 10 positions: 9 11 .................................................. $ 2,716,859 9 12 ............................................... Merged Area XVI ........................... $ 6,197,314 10 31 Sec. 9. DISTRIBUTION OF FUNDS APPROPRIATED. For the 10 32 fiscal year beginning July 1, 1998, and ending June 30, 1999, 10 33 moneys appropriated by the general assembly from the general 10 34 fund to the department of education for community colleges for 10 35 a fiscal year shall be allocated to each community college by 11 1 the department of education in the following manner: 11 2 1. BASE FUNDING. The base funding for a fiscal year shall 11 3 be equal to the amount each community college received as an 11 4 allocation from appropriations made from the general fund of 11 5 the state in the most recent fiscal year. 11 6 2. DISTRIBUTION FOR INFLATION. First priority shall be to 11 7 give each college an increase based upon inflation. The 11 8 inflation increase shall be not less than two percent. 11 9 However, the inflation increase shall be equal to the national 11 10 inflation rate, if it exceeds two percent, if the amount of 11 11 state aid appropriated is equal to or greater than the 11 12 national inflation rate. 11 13 3. DISTRIBUTION BASED ON PROPORTIONAL SHARE OF ENROLLMENT. 11 14 The balance of the growth in state aid appropriations, once 11 15 the inflation increase has been satisfied, shall be 11 16 distributed based on each college's proportional share of 11 17 enrollment. However, a minimum of one percent of the total 11 18 growth shall be distributed in this manner. 11 19 4. If the total appropriation made by the general assembly 11 20 is less than two percent growth, the entire increase shall be 11 21 distributed as inflation. 11 22 Sec. 10. READING RECOVERY. The department of education 11 23 shall analyze the expenditures of the moneys appropriated 11 24 during the fiscal year beginning July 1, 1997, for purposes of 11 25 the reading recovery program, and shall provide the analysis 11 26 to the general assembly and the legislative fiscal bureau in a 11 27 report not later than January 1, 1999. The analysis shall 11 28 include moneys appropriated for fiscal year 1997-1998 and 11 29 fiscal year 1998-1999. Priority for training shall be given 11 30 to teachers employed by school districts and accredited 11 31 nonpublic schools in Iowa. The department shall make every 11 32 reasonable effort to publicize and promote the use of the 11 33 center. 11 34 Sec. 11. Notwithstanding section 8.33 and 1997 Iowa Acts, 11 35 chapter 209, section 10, the funds appropriated in 1997 Iowa 12 1 Acts, chapter 209, section 10, subsection 11, to the 12 2 department of education to develop an initiative to improve 12 3 access to education through distance learning in postsecondary 12 4 institutions, which remain unencumbered or unobligated on June 12 5 30, 1998, shall not revert to the general fund of the state 12 6 but shall be reallocated to the division of libraries and 12 7 information services for purposes of the open access program. 12 8 Sec. 12. Notwithstanding section 8.33 and section 294A.25, 12 9 subsection 5, of the funds appropriated and paid to the 12 10 department of education for participation in the national 12 11 assessment of education progress, that remain unencumbered or 12 12 unobligated on June 30, 1998, the amount remaining shall not 12 13 revert to the general fund of the state but shall be 12 14 reallocated to the division of libraries and information 12 15 services for purposes of the open access program. 12 16 Sec. 13. Notwithstanding section 8.33 and 1997 Iowa Acts, 12 17 chapter 212, section 7, subsection 15, the funds appropriated 12 18 to the department of education and allocated for 12 19 rehabilitating computers for schools and libraries, which 12 20 remain unencumbered or unobligated on June 30, 1998, shall not 12 21 revert to the general fund of the state but shall be 12 22 reallocated to merged areas as defined in section 260C.2. BOARD OF EDUCATIONAL EXAMINERS LICENSING FEES. 13 5 Notwithstanding section 272.10, up to 85 percent of any funds 13 6 received resulting from an increase in fees approved and 13 7 implemented for licensing by the state board of educational 13 8 examiners after July 1, 1997, shall be available for the 13 9 fiscal year beginning July 1, 1998, to the state board for 13 10 purposes related to the state board's duties, including, but 13 11 not limited to, additional full-time equivalent positions. 13 12 The director of revenue and finance shall draw warrants upon 13 13 the treasurer of state from the funds appropriated as provided 13 14 in this section and shall make the funds resulting from the 13 15 increase in fees available during the fiscal year to the state 13 16 board on a monthly basis. 13 17 Sec. 15. DIGITAL TELEVISION CONVERSION. If 1998 Iowa 13 18 Acts, House File 2395, section 5, relating to a study of 13 19 digital television conversion by the public broadcasting 13 20 division of the department of education, is enacted, and upon 13 21 the request of a public radio broadcaster the division shall 13 22 include in the study a review of the tower space availability 13 23 and related cost efficiencies for broadcast antennas and 13 24 associated equipment for the transmission of public radio 13 25 station broadcasts. 13 26 Sec. 16. 1998 Iowa Acts, Senate File 2366, section 1, 13 27 subsection 1, unnumbered paragraphs 2 and 3, if enacted, are 13 28 amended by striking the unnumbered paragraphs. 13 29 STATE BOARD OF REGENTS 13 30 Sec. 17. There is appropriated from the general fund of 13 31 the state to the state board of regents for the fiscal year 13 32 beginning July 1, 1998, and ending June 30, 1999, the 13 33 following amounts, or so much thereof as may be necessary, to 13 34 be used for the purposes designated: 13 35 1. MEDICAL ASSISTANCE SUPPLEMENTAL AMOUNTS. For 21 8 the fiscal year beginning July 1, 1998, and ending June 30, 21 9 1999, the department of human services shall continue the 21 10 supplemental disproportionate share and a supplemental 21 11 indirect medical education adjustment applicable to state- 21 12 owned acute care hospitals with more than 500 beds and shall 21 13 reimburse qualifying hospitals pursuant to that adjustment 21 14 with a supplemental amount for services provided medical 21 15 assistance recipients. The adjustment shall generate 21 16 supplemental payments intended to equal the state 21 17 appropriation made to a qualifying hospital for treatment of 21 18 indigent patients as provided in chapter 255. To the extent 21 19 of the supplemental payments, a qualifying hospital shall, 21 20 after receipt of the funds, transfer to the department of 21 21 human services an amount equal to the actual supplemental 21 22 payments that were made in that month. The aggregate amounts 21 23 for the fiscal year shall not exceed the state appropriation 21 24 made to the qualifying hospital for treatment of indigent 21 25 patients as provided in chapter 255. The department of human 21 26 services shall deposit the portion of these funds equal to the 21 27 state share in the department's medical assistance account and 21 28 the balance shall be credited to the general fund of the 21 29 state. To the extent that state funds appropriated to a 21 30 qualifying hospital for the treatment of indigent patients as 21 31 provided in chapter 255 have been transferred to the 21 32 department of human services as a result of these supplemental 21 33 payments made to the qualifying hospital, the department shall 21 34 not, directly or indirectly, recoup the supplemental payments 21 35 made to a qualifying hospital for any reason, unless an 22 1 equivalent amount of the funds transferred to the department 22 2 of human services by a qualifying hospital pursuant to this 22 3 provision is transferred to the qualifying hospital by the 22 4 department. 22 5 If the state supplemental amount allotted to the state of 22 6 Iowa for the federal fiscal year beginning October 1, 1998, 22 7 and ending September 30, 1999, pursuant to section 1923(f)(3) 22 8 of the federal Social Security Act, as amended, or pursuant to 22 9 federal payments for indirect medical education is greater 22 10 than the amount necessary to fund the federal share of the 22 11 supplemental payments specified in the preceding paragraph, 22 12 the department of human services shall increase the 22 13 supplemental disproportionate share or supplemental indirect 22 14 medical education adjustment by the lesser of the amount 22 15 necessary to utilize fully the state supplemental amount or 22 16 the amount of state funds appropriated to the state university 22 17 of Iowa general education fund and allocated to the university 22 18 for the college of medicine. The state university of Iowa 22 19 shall transfer from the allocation for the college of medicine 22 20 to the department of human services, on a monthly basis, an 22 21 amount equal to the additional supplemental payments made 22 22 during the previous month pursuant to this paragraph. A 22 23 qualifying hospital receiving supplemental payments pursuant 22 24 to this paragraph that are greater than the state 22 25 appropriation made to the qualifying hospital for treatment of 22 26 indigent patients as provided in chapter 255 shall be 22 27 obligated as a condition of its participation in the medical 22 28 assistance program to transfer to the state university of Iowa 22 29 general education fund on a monthly basis an amount equal to 22 30 the funds transferred by the state university of Iowa to the 22 31 department of human services. To the extent that state funds 22 32 appropriated to the state university of Iowa and allocated to 22 33 the college of medicine have been transferred to the 22 34 department of human services as a result of these supplemental 22 35 payments made to the qualifying hospital, the department shall 23 1 not, directly or indirectly, recoup these supplemental 23 2 payments made to a qualifying hospital for any reason, unless 23 3 an equivalent amount of the funds transferred to the 23 4 department of human services by the state university of Iowa 23 5 pursuant to this paragraph is transferred to the qualifying 23 6 hospital by the department. 23 7 Continuation of the supplemental disproportionate share and 23 8 supplemental indirect medical education adjustment shall 23 9 preserve the funds available to the university hospital for 23 10 medical and surgical treatment of indigent patients as 23 11 provided in chapter 255 and to the state university of Iowa 23 12 for educational purposes at the same level as provided by the 23 13 state funds initially appropriated for that purpose. 23 14 The department of human services shall, in any compilation 23 15 of data or other report distributed to the public concerning 23 16 payments to providers under the medical assistance program, 23 17 set forth reimbursements to a qualifying hospital through the 23 18 supplemental disproportionate share and supplemental indirect 23 19 medical education adjustment as a separate item and shall not 23 20 include such payments in the amounts otherwise reported as the 23 21 reimbursement to a qualifying hospital for services to medical 23 22 assistance recipients. 23 23 For purposes of this section, "supplemental payment" means 23 24 a supplemental payment amount paid for medical assistance to a 23 25 hospital qualifying for that payment under this section. 23 26 Sec. 19. STATE UNIVERSITY OF IOWA DEPARTMENT OF HUMAN 23 27 SERVICES. The department of human services shall transfer to 23 28 the state university of Iowa for the purposes of the creative 23 29 employment options program the same amount of moneys in the 23 30 fiscal year beginning July 1, 1998, and ending June 30, 1999, 23 31 as was transferred in the fiscal year beginning July 1, 1997, 23 32 and ending June 30, 1998. 23 33 Sec. 20. For the fiscal year beginning July 1, 1998, and 23 34 ending June 30, 1999, the state board of regents may use 23 35 notes, bonds, or other evidences of indebtedness issued under 24 1 section 262.48 to finance projects that will result in energy 24 2 cost savings in an amount that will cause the state board to 24 3 recover the cost of the projects within an average of six 24 4 years. 24 5 Sec. 21. Notwithstanding section 270.7, the department of 24 6 revenue and finance shall pay the state school for the deaf 24 7 and the Iowa braille and sight saving school the moneys 24 8 collected from the counties during the fiscal year beginning 24 9 July 1, 1998, for expenses relating to prescription drug costs 24 10 for students attending the state school for the deaf and the 24 11 Iowa braille and sight saving school. 24 12 Sec. 22. 1997 Iowa Acts, chapter 212, section 11, 24 13 subsection 1, paragraph b, subparagraph (2), is amended to 24 14 read as follows: 24 15 (2)Notwithstanding section 8.33, fundsFunds appropriated 24 16 in this lettered paragraph remaining unencumbered or 24 17 unobligated on June 30, 1998, shallnotrevert to the general 24 18 fund of the statebut shall be available for expenditure for24 19the purposes listed in this lettered paragraph during the24 20subsequent fiscal year. 24 21 Sec. 23. Section 256.9, subsection 29, Code 1997, is 24 22 amended by striking the subsection. 24 23 Sec. 24. Section 256.16, unnumbered paragraph 1, Code 24 24 1997, is amended to read as follows: 24 25 Pursuant to section 256.7, subsection 5, the state board 24 26 shall adopt rules requiring all higher education institutions 24 27 providing practitioner preparation to include in the 24 28 professional education program, preparation that contributes 24 29 to education of students with disabilities and students who 24 30 are gifted and talented, along with preparation in reading 24 31 recovery and other reading programs, which must be 24 32 successfully completed before graduation from the practitioner 24 33 preparation program. 24 34 Sec. 25. Section 256.22, subsection 1, unnumbered 24 35 paragraph 1, if enacted by 1998 Iowa Acts, Senate File 2366, 25 1 is amended to read as follows: 25 2 Subject to an appropriation of sufficient funds by the 25 3 general assembly, the department shall establish a frontier 25 4 school and extended year school grant program to provide for 25 5 the allocation of grants to school districts, or a 25 6 collaboration of school districts, to provide technical 25 7 assistance for conversion of an existing school to a frontier 25 8 school or to an extended school year calendar, or for 25 9 investigating the possibility of converting an existing school 25 10 within a district to a frontier school or to an extended 25 11 school year calendar. A district that wants to participate in 25 12 the program shall submit to the department a written request 25 13 for a grant bySeptemberOctober 1, 1998. The school district 25 14 or collaboration of school districts shall agree to appoint a 25 15 planning committee composed of parents, guardians, teachers, 25 16 administrators, and individuals representing business, and the 25 17 local community. The school district or collaboration shall 25 18 also indicate in its request its intention to use any grant 25 19 moneys received under this section to examine, at a minimum, 25 20 all of the following: 25 21 Sec. 26. Section 256.22, subsections 2 and 5, if enacted 25 22 by 1998 Iowa Acts, Senate File 2366, are amended to read as 25 23 follows: 25 24 2. Grant moneys shall be distributed to qualifying school 25 25 districts by the department no later than October15, 199830 25 26 annually. Grant amounts shall be distributed as determined by 25 27 the department. Not more than fifteen of the grants awarded 25 28 per year in accordance with this section shall be used for 25 29 purposes of frontier school planning or conversion. A grant 25 30 awarded to a school district under this section shall not 25 31 exceed twenty-five thousand dollars. Notwithstanding the 25 32 other provisions of this section, the department shall not 25 33 award grant moneys for technical assistance for conversion of 25 34 an existing school to a frontier school or to an extended 25 35 school year calendar prior to July 1, 1999. 26 1 5. Except as provided in this subsection, frontier schools 26 2 are exempt from all statutes and rules applicable to a school, 26 3 a school board, or a school district, although a frontier 26 4 school may elect to comply with one or more provisions of 26 5 statute or rule. However, a frontier school shall meet all 26 6 applicable state and local health and safety requirements;the26 7frontier school shall be organized and operated as a nonprofit26 8cooperative association under chapter 498 or nonprofit26 9corporation under chapter 504A;the provisions of chapters 21 26 10 and 22 shall apply to meetings and records of the frontier 26 11 school board; and frontier schools are subject to and shall 26 12 comply with chapters 216 and 216A relating to civil and human 26 13 rights, and sections 275.55A, 279.9A, 280.17B, 280.21B, and 26 14 282.4, relating to suspension and expulsion of a student. The 26 15 frontier school shall employ or contract with necessary 26 16 teachers, as defined in section 272.1, who hold a valid 26 17 license with an endorsement for the type of service for which 26 18 the teacher is employed. Frontier schools are subject to the 26 19 same financial audits, audit procedures, and audit 26 20 requirements as a school district. The audits shall be 26 21 consistent with the requirements of sections 11.6, 11.14, 26 22 11.19, 256.9, subsection 19, and section 279.29, except to the 26 23 extent deviations are necessary because of the program at the 26 24 school. The department, auditor of state, or the legislative 26 25 fiscal bureau may conduct financial, program, or compliance 26 26 audits. The provisions of chapter 20 shall not apply to the 26 27 board of directors of a frontier school or its employees. 26 28 Sec. 27. Section 256.22, if enacted by 1998 Iowa Acts, 26 29 Senate File 2366, section 4, is amended by adding the 26 30 following new subsection: 26 31 NEW SUBSECTION. 6. Notwithstanding section 8.33, 26 32 unencumbered or unobligated funds remaining on June 30 of the 26 33 fiscal year for which the funds were appropriated shall not 26 34 revert but shall be available for expenditure for the 26 35 following fiscal year for purposes of this section. 27 1 Sec. 28. NEW SECTION. 256.24 MATHEMATICS PILOT PROGRAMS. 27 2 1. The Iowa mathematics and science coalition shall 27 3 administer a two-year mathematics pilot program to help 27 4 teachers become aware of possibilities for mathematics 27 5 instruction other than traditional approaches and discuss 27 6 those approaches with other teachers, employ new problem- 27 7 centered approaches, develop routines that create an 27 8 environment that promotes problem solving and student 27 9 autonomy, and integrate new approaches to teaching mathematics 27 10 in the regular mathematics curriculum. 27 11 2. The Iowa mathematics and science coalition shall locate 27 12 the pilot programs in at least four public school districts, 27 13 one located in a large school district, one located in a 27 14 medium-sized school district, and two located in small school 27 15 districts. In the case of a large school district, the 27 16 district shall apply for a secondary school in the district 27 17 provided that the middle and elementary schools within the 27 18 secondary school attendance area shall be represented in the 27 19 application. Districts participating in the program shall 27 20 require all teachers employed by the district who teach 27 21 mathematics to participate in the pilot program. However, in 27 22 the case of a large district, only teachers employed to teach 27 23 mathematics in the secondary school for which the application 27 24 was made, and the teachers employed to teach mathematics in 27 25 the middle and elementary schools within the secondary school 27 26 attendance area, shall be required to participate in the pilot 27 27 program. For purposes of this section, a large school 27 28 district is a district with an actual enrollment of five 27 29 thousand or more pupils; a medium-sized school district is a 27 30 district with an actual enrollment that is greater than one 27 31 thousand one hundred ninety-nine pupils, but less than five 27 32 thousand pupils; and a small school district is a district 27 33 with an actual enrollment of one thousand one hundred ninety- 27 34 nine or fewer pupils. 27 35 3. Funds appropriated for purposes of this section may be 28 1 used for administrative costs of the program and shall be used 28 2 to provide partial financial assistance to a participating 28 3 school district. The portion of the program costs for which a 28 4 district does not receive financial assistance pursuant to 28 5 this section shall be paid by the district. However, the 28 6 district may use phase III funds to pay this portion of the 28 7 program costs. 28 8 Sec. 29. Section 256.44, subsection 3, if enacted by 1998 28 9 Iowa Acts, Senate File 2366, section 5, is amended to read as 28 10 follows: 28 11 3. To receive a five-year annual award for achieving 28 12 certification by the national board of professional teaching 28 13 standards, a teacher shall apply to the department within one 28 14 year of eligibility. Payment for awards shall be made only 28 15 upon departmental approval of an application or 28 16 recertification of eligibility. A nonrenewable term of 28 17 eligibility shall be for five years or for the years the 28 18 certificate is valid, whichever time period is shorter. In 28 19 order to continue receipt of payments, a recipient shall 28 20 annually recertify eligibility. It is the intent of the 28 21 general assembly to appropriate not more than one million 28 22 dollars from the general fund for purposes of this program 28 23 during the lifetime of this program. 28 24 Sec. 30. Section 257B.1A, Code 1997, is amended by 28 25 striking the section and inserting in lieu thereof the 28 26 following: 28 27 257B.1A INTEREST FOR IOWA SCHOOLS FUND TRANSFER OF 28 28 INTEREST. 28 29 An interest for Iowa schools fund is established in the 28 30 office of treasurer of state. The department of revenue and 28 31 finance shall deposit interest earned on the permanent school 28 32 fund in the interest for Iowa schools fund. The treasurer 28 33 shall transfer moneys in the interest for Iowa schools fund on 28 34 a quarterly basis as follows: 28 35 1. Fifty-five percent of the moneys deposited in the fund 29 1 to the department of education for allocation to assist school 29 2 districts in developing reading recovery programs. From the 29 3 moneys allocated in this subsection, $100,000 shall be 29 4 distributed to the reading recovery center, and the remaining 29 5 balance shall be distributed to the area education agencies in 29 6 the proportion that the number of children who are eligible 29 7 for free or reduced price meals under the federal National 29 8 School Lunch Act and the federal Child Nutrition Act of 1966, 29 9 42 U.S.C. } 1751-1785, in the basic enrollment of grades one 29 10 through six in the area served by an agency, bears to the sum 29 11 of the number of children who are eligible for free or reduced 29 12 price meals under the federal National School Lunch Act and 29 13 the federal Child Nutrition Act of 1966, 42 U.S.C. } 1751- 29 14 1785, in the basic enrollments of grades one through six in 29 15 all of the areas served by area education agencies in the 29 16 state for the budget year. 29 17 2. Forty-five percent of the moneys deposited in the fund 29 18 to the credit of the international center endowment fund of 29 19 the international center for gifted and talented education 29 20 established in section 263.8A. 29 21 Sec. 31. Section 260C.28, subsection 3, Code 1997, is 29 22 amended to read as follows: 29 23 3. If the board of directors wishes to certify for a levy 29 24 under subsection 2, the board shall direct the county 29 25 commissioner of elections to call an election to submit the 29 26 question of such authorization for the board at a regular or 29 27 special election. If a majority of those voting on the 29 28 question at the election favors authorization of the board to 29 29 make such a levy, the board may certify for a levy as provided 29 30 under subsection 2 during each of the ten years following the 29 31 election. If a majority of those voting on the question at 29 32 the election does not favor authorization of the board to make 29 33 a levy under subsection 2, the board shall not submit the 29 34 question to the voters again untiltwelve monthsthree hundred 29 35 fifty-five days havelapsedelapsed from the election. 30 1 Sec. 32. Section 261.2, Code 1997, is amended by adding 30 2 the following new subsection: 30 3 NEW SUBSECTION. 15. Be prohibited from expending interest 30 4 moneys earned on accounts of the commission located within the 30 5 office of the treasurer of state unless the general assembly 30 6 specifically appropriates the interest moneys for use by the 30 7 commission. If the general assembly appropriates interest 30 8 moneys transferred from the Pub. L. No. 105-33 recall account 30 9 within the office of the treasurer of state to the fund 61 30 10 default reduction account, the commission shall adopt rules 30 11 for the expenditure of the interest moneys for purposes of 30 12 issuing emergency loans to assist needy students in avoiding 30 13 default on a guaranteed or parental loan made under this 30 14 chapter. 30 15 Sec. 33. Section 261.12, subsection 1, paragraph b, Code 30 16 Supplement 1997, is amended to read as follows: 30 17 b. For the fiscal year beginning July 1,19961998, and 30 18 for each following fiscal year, three thousandfoursix 30 19 hundred fifty dollars. 30 20 Sec. 34. Section 261.17, Code Supplement 1997, is amended 30 21 by adding the following new subsection: 30 22 NEW SUBSECTION. 1A. All classes, including liberal arts 30 23 classes, identified by the community college as required for 30 24 completion of the student's vocational-technical or career 30 25 option program shall be considered a part of the student's 30 26 vocational-technical or career option program for the purpose 30 27 of determining the student's eligibility for a grant. 30 28 Notwithstanding subsection 2, if a student is making 30 29 satisfactory academic progress but the student cannot complete 30 30 a vocational-technical or career option program in the time 30 31 frame allowed for a student to receive a vocational-technical 30 32 tuition grant as provided in subsection 2 because additional 30 33 classes are required to complete the program, the student may 30 34 continue to receive a vocational-technical tuition grant for 30 35 not more than one additional enrollment period. 31 1 Sec. 35. Section 261.17, subsection 6, Code Supplement 31 2 1997, is amended by adding the following new paragraph: 31 3 NEW PARAGRAPH. e. Establish a late application deadline 31 4 for new applicants which shall not be earlier than August 1 of 31 5 the fiscal year in which the appropriation received pursuant 31 6 to section 261.25, subsection 3, is made. From the funds 31 7 appropriated by section 261.25, subsection 3, not less than 31 8 sixty-three thousand dollars shall be used for tuition grants 31 9 for late applicants as provided in this paragraph. 31 10 Sec. 36. NEW SECTION. 261.24 IOWA STATE FAIR 31 11 SCHOLARSHIP. 31 12 The Iowa state fair scholarship fund is established in the 31 13 office of treasurer of state to be administered by the 31 14 commission. The commission shall adopt rules pursuant to 31 15 chapter 17A for the administration of this section. The rules 31 16 shall provide, at a minimum, that only residents of Iowa who 31 17 have actively participated in the Iowa state fair and 31 18 graduated from an accredited secondary school in Iowa shall be 31 19 eligible to receive an Iowa state fair scholarship for 31 20 matriculation at an eligible institution as defined in section 31 21 261.35. Notwithstanding section 12C.7, interest earned on 31 22 money in the Iowa state fair scholarship fund shall be 31 23 deposited into the fund and may be used by the commission only 31 24 for Iowa state fair scholarship awards. 31 25 Sec. 37. Section 261.25, subsections 1 and 3, Code 31 26 Supplement 1997, are amended to read as follows: 31 27 1. There is appropriated from the general fund of the 31 28 state to the commission for each fiscal year the sum offorty-31 29oneforty-four million six hundred sixty-four thousand seven 31 30 hundred fifty dollars for tuition grants. 31 31 3. There is appropriated from the general fund of the 31 32 state to the commission for each fiscal year the sum ofone31 33 two millionsixtwo hundredeightforty-four thousandtwoone 31 34 hundredfifty-sevenninety-seven dollars for vocational- 31 35 technical tuition grants. 32 1 Sec. 38. Section 261.25, Code Supplement 1997, is amended 32 2 by adding the following new subsection: 32 3 NEW SUBSECTION. 3A. There is appropriated from the 32 4 general fund of the state to the commission for each fiscal 32 5 year the sum of ninety thousand dollars for the industrial 32 6 technology forgivable loan program established in section 32 7 261.111. 32 8 Sec. 39. NEW SECTION. 261.111 INDUSTRIAL TECHNOLOGY 32 9 FORGIVABLE LOAN PROGRAM. 32 10 1. There is established an industrial technology 32 11 forgivable loan program to be administered by the college 32 12 student aid commission. An individual is eligible for the 32 13 forgivable loan program if the individual meets all of the 32 14 following conditions: 32 15 a. Is a resident of this state who is enrolled as a 32 16 sophomore, junior, or senior in the area of industrial 32 17 technology education at an institution of higher learning 32 18 under the control of the state board of regents or an 32 19 accredited private institution as defined in section 261.9, 32 20 or, is a resident of this state who is enrolled in the area of 32 21 industrial technology at a community college in the state and 32 22 the credits for the coursework in industrial technology are 32 23 transferable to an institution of higher learning under the 32 24 control of the state board of regents, or to an accredited 32 25 private institution as defined in section 261.9. 32 26 b. Completes and files an application for an industrial 32 27 technology forgivable loan. The individual shall be 32 28 responsible for the submission of the parents' confidential 32 29 statement for processing to both the commission and the 32 30 institution in which the applicant is enrolling. 32 31 c. Reports promptly to the commission any information 32 32 requested. 32 33 d. Files a new application and parents' confidential 32 34 statement annually on the basis of which the applicant's 32 35 eligibility for a renewed industrial technology forgivable 33 1 loan will be evaluated and determined. 33 2 2. Forgivable loans to eligible students shall not become 33 3 due until after the student graduates or leaves school. The 33 4 individual's total loan amount, including principal and 33 5 interest, shall be reduced by twenty percent for each year in 33 6 which the individual remains an Iowa resident and is employed 33 7 by a school district or an accredited nonpublic school as an 33 8 industrial technology teacher. If the commission determines 33 9 that the person does not meet the criteria for forgiveness of 33 10 the principal and interest payments, the commission shall 33 11 establish a plan for repayment of the principal and interest 33 12 over a ten-year period. If a person required to make the 33 13 repayment does not make the required payments, the commission 33 14 shall provide for payment collection. 33 15 3. There is created an industrial technology forgivable 33 16 loan repayment fund for deposit of payments made by forgivable 33 17 loan recipients who do not fulfill the conditions of the 33 18 forgivable loan program. Notwithstanding section 8.33, moneys 33 19 deposited in the industrial technology forgivable loan 33 20 repayment fund shall not revert to the general fund of the 33 21 state at the end of any fiscal year but shall remain in the 33 22 industrial technology forgivable loan repayment fund and be 33 23 continuously available to make additional loans under the 33 24 program. 33 25 Sec. 40. NEW SECTION. 261.112 INDUSTRIAL TECHNOLOGY 33 26 FORGIVABLE LOAN ADMINISTRATION. 33 27 1. The college student aid commission shall administer the 33 28 industrial technology forgivable loan program. The amount of 33 29 an industrial technology forgivable loan shall not exceed 33 30 three thousand dollars annually, or the amount of the 33 31 student's established financial need, whichever is less. 33 32 2. The interest rate for the forgivable loan shall be 33 33 equal to the interest rate collected by an eligible lender 33 34 under the Iowa guaranteed student loan program for the year in 33 35 which the forgivable loan is made. 34 1 Sec. 41. Section 279.14, subsection 2, if enacted by 1998 34 2 Iowa Acts, Senate File 2366, is amended by striking the 34 3 subsection and inserting in lieu thereof the following: 34 4 2. The determination of standards of performance expected 34 5 of school district personnel shall be reserved as an exclusive 34 6 management right of the school board and shall not be subject 34 7 to mandatory negotiations under chapter 20. Notwithstanding 34 8 chapter 20, objections to the procedures, use, or content of 34 9 an evaluation in a teacher termination proceeding brought 34 10 before the school board in a hearing held in accordance with 34 11 section 279.16 or 279.27 shall not be subject to the grievance 34 12 procedures negotiated in accordance with chapter 20. A school 34 13 district shall not be obligated to process any evaluation 34 14 grievance after service of a notice and recommendation to 34 15 terminate an individual's continuing teaching contract in 34 16 accordance with chapter 279. 34 17 Sec. 42. Section 279.14A, subsection 1, if enacted by 1998 34 18 Iowa Acts, Senate File 2366, is amended to read as follows: 34 19 1. The department of education shall establish and 34 20 implement a voluntary practitioner performance improvement 34 21 program that shall provide technical assistance to teachers 34 22 and administrators from each public school district and area 34 23 education agency. Individuals under contract with a school 34 24 district may receive technical assistance in accordance with 34 25 this subsection. The department shall consult with the Iowa 34 26 state education association, the Iowa association of school 34 27 boards, the school administrators of Iowa, the professional 34 28 educators of Iowa, and, as practicable, other entities 34 29 providing similar programs, in developing the program. At a 34 30 minimum, the program shall provide administrators with 34 31 training, including but not limited to, seminars and written 34 32 materials, relating to the areas of employment policies and 34 33 procedures, employment documentation, performance evaluations, 34 34 corrective performance techniques, discipline, termination, 34 35 and support by qualified individuals for implementation of the 35 1 program. The program shall not be used to provide 35 2 consultation or assistance on specific employment situations. 35 3 Training received by an administrator in accordance with this 35 4 section shall apply toward an administrator's evaluator 35 5 approval renewal. 35 6 Sec. 43. Section 279.19, Code 1997, is amended by adding 35 7 the following new unnumbered paragraph: 35 8 NEW UNNUMBERED PARAGRAPH. Notwithstanding any provision to 35 9 the contrary, the grievance procedures of section 20.18 35 10 relating to job performance or job retention shall not apply 35 11 to a teacher during the first two years of the teacher's 35 12 probationary period. However, this paragraph shall not apply 35 13 to a teacher who has successfully completed a probationary 35 14 period in a school district in Iowa. 35 15 Sec. 44. Section 279.51, subsection 4, Code Supplement 35 16 1997, is amended to read as follows: 35 17 4. The department shall seek assistance fromthe first in35 18the nation in education foundation established in chapter 257A35 19and otherfoundations and public and private agencies in the 35 20 evaluation of the programs funded under this section, and in 35 21 the provision of support to school districts in developing and 35 22 implementing the programs funded under this section. 35 23 Sec. 45. Section 279.60, subsection 5, if enacted by 1998 35 24 Iowa Acts, Senate File 2366, section 29, is amended to read as 35 25 follows: 35 26 5. The ranked list of nominees shall be submitted to the 35 27 board of directors of the school district for review and 35 28 approval. The board of directors shall be responsible for 35 29 determining the number of awards and the amount of the awards 35 30 based upon the moneys received by the school district pursuant 35 31 to section 279.61. The board of directors shall also consult 35 32 with practitioners to plan appropriate recognition events 35 33 within the school district for presentation of the awards. 35 34 Sec. 46. Section 294A.19, unnumbered paragraph 2, Code 35 35 1997, is amended to read as follows: 36 1 Annually, by November 1, the department shall summarize the 36 2 information contained in the phase III reports filed by the 36 3 school districts and area education agencies. Thereports36 4 summary shallbe available upon requestcontain information 36 5 including the numbers of districts and area education agencies 36 6 that have implemented a performance-based pay plan, a 36 7 supplemental pay plan, a combination of a performance-based 36 8 and supplemental pay plan, and the number of districts and 36 9 area education agencies that have established comprehensive 36 10 school transformation programs. The summary shall highlight 36 11 and briefly describe innovative and successful uses of phase 36 12 III funds that have had a positive effect on student 36 13 achievement within the district as measured by means of a 36 14 widely recognized educational assessment tool or test. The 36 15 department, in conjunction with the legislative fiscal bureau, 36 16 shall identify additional items to be reported. Copies of the 36 17 annual summary shall be submitted to each school district, the 36 18 general assembly, and the legislative fiscal bureau by 36 19 December 1. 36 20 Sec. 47. Section 294A.25, subsection 5, Code Supplement 36 21 1997, is amended by striking the subsection and inserting in 36 22 lieu thereof the following: 36 23 5. For the fiscal year beginning July 1, 1998, and for 36 24 each succeeding fiscal year, the amount of fifty thousand 36 25 dollars to be paid to the department of cultural affairs for 36 26 contracting with the Iowa alliance for arts education to 36 27 execute the local arts comprehensive educational strategies 36 28 program. 36 29 Sec. 48. Section 294A.25, subsection 6, Code Supplement 36 30 1997, is amended to read as follows: 36 31 6. For the fiscal year beginning July 1,19971998, and 36 32ending June 30, 1998each succeeding fiscal year, the amount 36 33 of fifty thousand dollars to the department of education for 36 34 the geography alliance. 36 35 Sec. 49. Section 294A.25, subsection 9, Code Supplement 37 1 1997, is amended by striking the subsection and inserting in 37 2 lieu thereof the following: 37 3 9. For the fiscal year beginning July 1, 1998, and for 37 4 each succeeding fiscal year, the amount of fifty thousand 37 5 dollars to the department of education for the Iowa 37 6 mathematics and science coalition from phase III moneys. 37 7 Sec. 50. Section 294A.25, subsection 10, Code Supplement 37 8 1997, is amended to read as follows: 37 9 10. For the fiscal year beginning July 1,19971998, and 37 10ending June 30, 1998for each succeeding fiscal year, the 37 11 amount of seventy thousand dollars to the state board of 37 12 regents for equal distribution to the Iowa braille and sight 37 13 saving school and the Iowa state school for the deaf from 37 14 phase III moneys. 37 15 Sec. 51. Section 294A.25, subsection 11, Code Supplement 37 16 1997, is amended to read as follows: 37 17 11. For the fiscal year beginning July 1,19971998, and 37 18 ending June 30,19981999, to the department of education from 37 19 phase III moneys the amount of one million two hundred fifty 37 20 thousand dollars for support for the operations of the new 37 21 Iowa schools development corporation and for school 37 22 transformation design and implementation projects administered 37 23 by the corporation. Of the amount provided in this 37 24 subsection, one hundred fifty thousand dollars shall be used 37 25 for the school and community planning initiative. 37 26 Sec. 52. Section 294A.25, Code Supplement 1997, is amended 37 27 by adding the following new subsections: 37 28 NEW SUBSECTION. 6A. For each fiscal year of the fiscal 37 29 period beginning July 1, 1998, and ending June 30, 2000, the 37 30 amount of seventy-five thousand dollars from phase III moneys 37 31 to the department of education for distribution to the Iowa 37 32 mathematics and science coalition for purposes of mathematics 37 33 pilot programs in accordance with section 256.24. 37 34 NEW SUBSECTION. 10A. For the fiscal year beginning July 37 35 1, 1998, and ending June 30, 1999, the amount of thirty-five 38 1 thousand dollars from phase III moneys to the department of 38 2 education for allocation to the Sioux City community school 38 3 district for purposes of developing and implementing a 38 4 listening curriculum. 38 5 NEW SUBSECTION. 12. For the fiscal year beginning July 1, 38 6 1998, and for each succeeding fiscal year, to the department 38 7 of education from phase III moneys the amount of one hundred 38 8 fifty thousand dollars to the Iowa public broadcasting 38 9 division for overnight transmitter feeds. 38 10 Sec. 53. Section 303.1, subsection 2, Code 1997, is 38 11 amended by adding the following new paragraph: 38 12 NEW PARAGRAPH. e. Encourage the use of volunteers 38 13 throughout its divisions, especially for purposes of restoring 38 14 books and manuscripts. 38 15 Sec. 54. NEW SECTION. 303.3A ARTS AND CULTURAL 38 16 CONFERENCES AND CAUCUSES. 38 17 1. For the purposes of this section, the following 38 18 definitions apply: 38 19 a. "Arts" means music, dance, theater, opera and music 38 20 theater, visual arts, literature, design arts, media arts, and 38 21 folk and traditional arts. 38 22 b. "Culture" or "cultural" means programs and activities 38 23 which explore past and present human experience. 38 24 c. "Department" means the department of cultural affairs. 38 25 d. "Enhancement" means programs that allow arts and 38 26 cultural organizations to improve or enhance the quality of 38 27 programs currently offered, and increase and support 38 28 professional and student artists and arts educators. 38 29 e. "Outreach" means programs that increase rural access to 38 30 cultural resources, social awareness, cultural diversity, and 38 31 which serve special populations. 38 32 2. The department shall administer regional conferences 38 33 and a statewide caucus on arts and cultural enhancement. The 38 34 purpose of the conferences and caucus is to encourage the 38 35 development of the arts and culture in the state by 39 1 identifying opportunities for programs involving education, 39 2 outreach, and enhancement; by reviewing possible changes in 39 3 enhancement program policies, programs, and funding; and by 39 4 making recommendations to the department regarding funding 39 5 allocations and priorities for arts and cultural enhancement. 39 6 3. Every four years beginning in June 2001, the department 39 7 shall convene a statewide caucus on arts and cultural 39 8 enhancement. 39 9 a. Prior to the statewide caucus, the department shall 39 10 make arrangements to hold a conference in each of several 39 11 regions of the state as determined by the Iowa arts council. 39 12 The department shall promote attendance of interested persons 39 13 at each conference. A designee of the department shall serve 39 14 as temporary chairperson until persons attending the 39 15 conference elect a chairperson. The department shall provide 39 16 persons attending the conference with current information 39 17 regarding cultural programs and expenditures. Persons 39 18 attending the conference shall identify opportunities for 39 19 programs in the areas of education, outreach, and enhancement, 39 20 and make recommendations in the form of a resolution. The 39 21 persons attending the conference shall elect six persons from 39 22 among the attendees to serve as regional, voting delegates to 39 23 the statewide caucus. The conference attendees shall elect a 39 24 chairperson from among the six representatives. Other 39 25 interested persons are encouraged to attend the statewide 39 26 caucus as nonvoting attendees. 39 27 b. The department shall charge a reasonable fee for 39 28 attendance at the statewide caucus on arts and cultural 39 29 enhancement. 39 30 c. A designee of the department shall call the statewide 39 31 caucus to order and serve as temporary chairperson until 39 32 persons attending the caucus elect a chairperson. Persons 39 33 attending the caucus shall discuss the recommendations of the 39 34 regional conferences and decide upon recommendations to be 39 35 made to the department and the general assembly. Elected 40 1 chairpersons of the regional conferences shall meet with 40 2 representatives of the department and present the 40 3 recommendations of the caucus. 40 4 Sec. 55. Section 304A.10, Code 1997, is amended to read as 40 5 follows: 40 6 304A.10 COST OF FINE ARTS PERCENTAGE. 40 7 The total estimated cost of the fine arts elements included 40 8 in a plan and specifications for a state building or group of 40 9 state buildings in accordance with the purposes of this 40 10 division shall in no case be less than one-half of one percent 40 11 of the total estimated cost of such building or group of 40 12 buildings. This percentage allocation shall not be diminished 40 13 by professional fees. By September 1 annually, the 40 14 contracting officer or principal user shall submit to the 40 15 department of cultural affairs the total amount of state 40 16 financial assistance expended in accordance with this section 40 17 during the previous fiscal year. If deemed in the best 40 18 interests of the citizens, funds allocated for the acquisition 40 19 of fine arts may be accumulated over more than one 40 20 appropriation or fiscal period or combined to complete 40 21 significant projects, however, this sentence does not 40 22 authorize interproject transfers. The total estimated cost of 40 23 the fine arts elements included in a plan and specifications 40 24 for a state building or group of state buildings in accordance 40 25 with this section shall be included by the department of 40 26 cultural affairs in calculating the amount of state financial 40 27 assistance for the arts for purposes of national ranking 40 28 surveys. By January 1 annually, the department of cultural 40 29 affairs shall submit a summary of the total amount of state 40 30 financial assistance expended in accordance with this section 40 31 and for which state buildings the assistance was expended. 40 32 Sec. 56. Section 256.17A, if enacted by 1998 Iowa Acts, 40 33 Senate File 2366, section 3, is repealed. 40 34 Sec. 57. Chapters 257A and 303C, Code 1997, are repealed. 40 35 Sec. 58. 1998 Iowa Acts, Senate File 2366, section 40, if 41 1 enacted, is amended to read as follows: 41 2 SEC. 40. EMERGENCY RULES. The department may adopt 41 3 emergency rules as necessary for the administration of chapter 41 4 256E and sections256.17A256.22, 257.13, and 279.60, if 41 5 enacted. 41 6 Sec. 59. Notwithstanding section 257A.4, Code 1997, with 41 7 the repeal of chapter 257A pursuant to this Act, the rights 41 8 and properties of the first in the nation in education 41 9 foundation shall remain with the nonprofit corporation which 41 10 shall continue its existence as a nonprofit corporation but 41 11 shall no longer be a quasi-public instrumentality. However, 41 12 debts and other financial obligations shall not succeed to the 41 13 state. 41 14 Sec. 60. AUDIT OF AREA EDUCATION AGENCIES. Subject to an 41 15 appropriation of sufficient funds by the general assembly, the 41 16 auditor of state shall analyze area education agency finances 41 17 and operations for the 1996-1997 fiscal year. In conducting 41 18 the analysis, the auditor of state shall utilize reports on 41 19 audits of area education agencies conducted in accordance with 41 20 section 11.6, information available from the department of 41 21 education, the department of management, the area education 41 22 agencies, and from any other source necessary. The auditor of 41 23 state shall have access to all records of the area education 41 24 agencies. 41 25 The analysis shall include, but shall not be limited to, 41 26 major areas of expenditure by area education agency districts, 41 27 such as media services, special education services, additional 41 28 services pursuant to section 273.7, services to school 41 29 districts pursuant to section 273.7A, services for preschool 41 30 children with disabilities, juvenile shelter services, and 41 31 detention home instruction; and a comparison by area education 41 32 agency of staffing levels, number of students served, purchase 41 33 or lease of equipment and facilities, and funding from local 41 34 school districts. The results of the analysis, and any 41 35 recommendations, shall be submitted to the general assembly 42 1 and the legislative fiscal bureau by January 1, 1999, and 42 2 shall be utilized in the comprehensive study of school finance 42 3 requested in accordance with House Concurrent Resolution 15, 42 4 if resolved by the Seventy-seventh General Assembly. 42 5 Sec. 61. CONTINGENT APPROPRIATION. In the event the funds 42 6 transferred in accordance with section 257B.1A are not 42 7 received by the department of education in the fiscal year 42 8 beginning July 1, 1998, and ending June 30, 1999, for 42 9 allocation to assist school districts in developing reading 42 10 recovery programs, in addition to the allocations provided for 42 11 in section 294A.25, there is allocated to the department of 42 12 education for the fiscal year beginning July 1, 1998, and 42 13 ending June 30, 1999, from phase III moneys, $200,000, or so 42 14 much thereof as is necessary, for allocation to assist school 42 15 districts in developing reading recovery programs. From the 42 16 moneys allocated in this section, $100,000 shall be 42 17 distributed to the reading recovery center, and the remaining 42 18 balance shall be distributed to the area education agencies in 42 19 the proportion that the number of children who are eligible 42 20 for free or reduced price meals under the federal National 42 21 School Lunch Act and the federal Child Nutrition Act of 1966, 42 22 42 U.S.C. } 1751-1785, in the basic enrollment of grades one 42 23 through six in the area served by an agency, bears to the sum 42 24 of the number of children who are eligible for free or reduced 42 25 price meals under the federal National School Lunch Act and 42 26 the federal Child Nutrition Act of 1966, 42 U.S.C. } 1751- 42 27 1785, in the basic enrollments of grades one through six in 42 28 all of the areas served by area education agencies in the 42 29 state for the budget year. 42 30 Sec. 62. EFFECTIVE DATES. 42 31 1. Section 6 of this Act, relating to historic sites and 42 32 the western trails center, being deemed of immediate 42 33 importance, takes effect upon enactment. 42 34 2. Sections 11 and 12 of this Act, relating to 42 35 reallocation of moneys to the division of libraries and 43 1 information services for purposes of the open access program, 43 2 being deemed of immediate importance, take effect upon 43 3 enactment. 43 4 3. Section 13 of this Act, relating to the nonreversion of 43 5 funds appropriated for rehabilitating computers for school and 43 6 libraries, being deemed of immediate importance, takes effect 43 7 upon enactment. 43 8 4. Section 14 of this Act, relating to the state board of 43 9 educational examiners licensing fees, being deemed of 43 10 immediate importance, takes effect upon enactment. 43 11 5. Section 22 of this Act, relating to the reversion of 43 12 funds appropriated for tuition replacement, being deemed of 43 13 immediate importance, takes effect upon enactment. 43 14 Sec. 63. Sections 23 and 59 of this Act, relating to the 43 15 first in the nation in education foundation, section 36 of 43 16 this Act, relating to the Iowa state fair scholarship, and the 43 17 portion of section 57 of this Act repealing chapter 257A, take 43 18 effect December 31, 1998. 43 19 Section 56 of this Act, relating to the repeal of section 43 20 256.17A, being deemed of immediate importance, takes effect 43 21 upon enactment. 43 22 43 23 43 24 43 25 RON J.
