                        REFUSAL OF GOVERNORS APPOINTMENT

                       (Individual Confirmation Calendar)

         Senator Connolly called up the appointment of Derald L. Judson, Jr.
    as a member of the Employment Appeal Board, placed on the Individual
    Confirmation Calendar on February 15, 1995, without recommendation, and
    found on page 366 of the Senate Journal.

         Senator Connolly moved that the foregoing appointment be confirmed
    by the Senate.

         On the question Shall the appointee be confirmed? the vote was:

         Rule 23, requiring all Senators present to vote except those who
    express a conflict of interest, was invoked.
