PAG LIN 1 1 SENATE CONCURRENT RESOLUTION NO. 1 2 BY KIBBIE, HUSAK, BOSWELL, JUDGE, BISIGNANO, 1 3 FRAISE, PALMER, and PRIEBE 1 4 (COMPANION TO LSB 1342HH BY GARMAN) 1 5 A Concurrent Resolution to request that Congress 1 6 propose a Constitutional amendment, for ratifi- 1 7 cation by the states, which would specify that 1 8 the Congress and the states have the power to 1 9 prohibit the physical desecration of the American 1 10 flag. 1 11 WHEREAS, although the right of free expression is 1 12 part of the foundation of the United States 1 13 Constitution, very carefully drawn limits on 1 14 expression in specific instances have long been 1 15 recognized as legitimate means of maintaining public 1 16 safety and defining other societal standards; and 1 17 WHEREAS, certain actions, although arguably related 1 18 to one person's free expression, nevertheless raise 1 19 issues concerning public decency, public peace, and 1 20 the rights of other citizens; and 1 21 WHEREAS, there are symbols of our national soul, 1 22 such as the Washington Monument, the United States 1 23 Capitol Building, and memorials to our greatest 1 24 leaders, which are the property of every American and 1 25 are worthy of protection from desecration and 1 26 dishonor; and 1 27 WHEREAS, the American flag is a most honorable and 1 28 worthy banner that is a symbol of a nation which is 1 29 thankful for its strengths and is committed to curing 1 30 its faults, a nation that remains the destination of 2 1 millions of immigrants attracted by the universal 2 2 power of the American ideal; and 2 3 WHEREAS, the Constitution, as interpreted by the 2 4 United States Supreme Court, no longer accords the 2 5 Stars and Stripes the reverence, respect, and dignity 2 6 befitting the banner of this most noble experiment of 2 7 a nation-state; and 2 8 WHEREAS, it is only fitting that people everywhere 2 9 should lend their voices to a forceful call for 2 10 restoration of the Stars and Stripes to a proper 2 11 station under law and decency; NOW THEREFORE, 2 12 BE IT RESOLVED BY THE SENATE, THE HOUSE OF 2 13 REPRESENTATIVES CONCURRING, That the General Assembly 2 14 of the State of Iowa respectfully requests that the 2 15 Congress of the United States propose an amendment to 2 16 the United States Constitution, to be ratified by the 2 17 states, that specifies that Congress and the states 2 18 have the power to prohibit the physical desecration of 2 19 the flag of the United States; and 2 20 BE IT FURTHER RESOLVED, That copies of this 2 21 Resolution be transmitted to the Speaker of the United 2 22 States House of Representatives, the President of the 2 23 United States Senate, and all of the members of Iowa's 2 24 congressional delegation. 2 25 LSB 1342SS 76 2 26 lh/sc/14.1
