PAG LIN 1 1 Section 1. Section 1B.1, Code 1995, is amended to read as 1 2 follows: 1 3 1B.1 SPECIFICATIONS OF STATEBANNERFLAG. 1 4 The banner designed by the Iowa society of the Daughters of 1 5 the American Revolution and presented to the state, which1 6banneris hereby adopted as the state flag for use on all 1 7 occasions where a state flag may be fittingly displayed. The 1 8 design consists of three vertical stripes of blue, white, and 1 9 red, the blue stripe being nearest the staff and the white 1 10 stripe being in the center, and upon. On the central white 1 11 stripebeingis depicted a spreading eagle bearing in its beak 1 12 blue streamers on which is inscribed, in white letters,the 1 13 state motto, "Our liberties we prize and our rights we will 1 14 maintain"andin white letters, with the word "Iowa" in red 1 15 letters belowsuchthe streamers, as such design now appears1 16on the banner in the office of the governor of the state of1 17Iowa, is hereby adopted as a distinctive state banner, for use1 18on all occasions where a distinctive state symbol in the way1 19of a banner may be fittingly displayed. 1 20 Sec. 2. Section 1B.2, Code 1995, is amended to read as 1 21 follows: 1 22 1B.2 USE OF STATEBANNERFLAG. 1 23SuchThe designmayshall be used asa distinctivethe 1 24 statebannerflag and mayas suchbe displayed on all proper 1 25 occasions where the state is officially representedas1 26distinct from other states, either at home or abroad, or 1 27 wherever it may be proper to distinguish the citizens of Iowa 1 28 from the citizens of other states, such display. When 1 29 displayed with the national emblem, the state flag shall in 1 30 all casestobe subservient to andalong with the display of1 31the national emblem and, when displayed with the latter, to be1 32 placed beneath the stars and stripes. 1 33 Sec. 3. Section 1B.3, Code 1995, is amended to read as 1 34 follows: 1 35 1B.3 FLAGS ON PUBLIC BUILDINGS. 2 1 It shall be the duty of any board of public officers 2 2 charged with providing supplies for a public building in the 2 3 state to provide a suitable state flag and it shall be the 2 4 duty of thecustodianscustodian ofallthat publicbuildings2 5of the statebuilding to raiseover such buildingtheflag2 6 flags of the United States of America and the state of Iowa, 2 7 upon each secular day when weather conditions are favorable,2 8and it shall be the duty of any board of public officers2 9charged with the duty of providing for the supplies of any2 10such public building to provide, in connection with other2 11supplies for any such building of the state, a suitable flag2 12for the purposes herein provided. 2 13 Sec. 4. Section 280.5, Code 1995, is amended to read as 2 14 follows: 2 15 280.5 DISPLAY OF UNITED STATES FLAG AND IOWA STATEBANNER2 16 FLAG. 2 17 The board of directors of each public school district and 2 18 the authorities in charge of each nonpublic school shall 2 19 provide and maintain a suitable flagstaff on each school site 2 20 under its control, and the United States flag and the Iowa 2 21 statebannerflag shall be raised on all school days when 2 22 weather conditions are suitable. 2 23 EXPLANATION 2 24 This bill reenacts provisions of 1921 Iowa Acts, chapter 78 2 25 (House File 398). The bill, as passed by the House of 2 26 Representatives and Senate in 1921 was never signed by the 2 27 Speaker of the House as required by Article III, section 15 of 2 28 the Iowa Constitution. The bill also updates the language 2 29 describing the flag of the state of Iowa. The term "banner" 2 30 is replaced by the word "flag". Currently and under the bill, 2 31 boards of directors of public buildings are required to fly 2 32 the flag of Iowa as well as the stars and stripes of the 2 33 nation. 2 34 LSB 1030HH 76 2 35 cl/sc/14
