1 1 Amend the amendment, H-5419, to Senate File 2443,
1 2 as amended, passed, and reprinted by the Senate, as
1 3 follows:
1 4 #1. Page 13, by inserting after line 8 the
1 5 following:
1 6 "Sec. . Section 15.327, Code 1995, is amended
1 7 by adding the following new subsection:
1 8 NEW SUBSECTION. 3A. "Economic development area"
1 9 means a site or sites designated by the department for
1 10 the purpose of attracting an eligible business to
1 11 locate facilities within the state.
1 12 Sec. . NEW SECTION. 15.331B EXEMPTION FROM
1 13 LAND OWNERSHIP RESTRICTIONS FOR NONRESIDENT ALIENS –
1 14 PILOT PROJECT.
1 15 1. The eligible business, to the extent the
1 16 eligible business is not actively engaged in farming
1 17 within the economic development area, may acquire,
1 18 own, and lease up to one thousand two hundred eighty
1 19 acres of land in the economic development area,
1 20 notwithstanding the provisions of sections 9H.4, 9H.5,
1 21 and 567.3 if the eligible business has been designated
1 22 a pilot project business under subsection 3. The
1 23 eligible business may receive one or more one-year
1 24 extensions of the time limit for complying with the
1 25 requirements of section 567.4. Each extension must be
1 26 approved by the community prior to approval by the
1 27 department. The eligible business shall comply with
1 28 the remaining provisions of chapters 9H and 567 to the
1 29 extent they do not conflict with this subsection.
1 30 2. "Actively engaged in farming" means any of the
1 31 following:
1 32 a. Inspecting agricultural production activities
1 33 within the economic development area periodically and
1 34 furnishing at least half of the value of the tools and
1 35 paying at least half the direct cost of production.
1 36 b. Regularly and frequently making or taking an
1 37 important part in making management decisions
1 38 substantially contributing to or affecting the success
1 39 of the farm operations within the economic development
1 40 area.
1 41 c. Performing physical work which significantly
1 42 contributes to crop or livestock production.
1 43 3. The department may designate up to a total of
1 44 five eligible businesses as pilot project businesses
1 45 for the purposes of the exemption contained in this
1 46 section. An eligible business shall not receive the
1 47 exemption under this section unless it has applied to
1 48 be designated a pilot project business by July 1,
1 49 1997."
1 50 #2. Page 13, by inserting after line 49 the
2 1 following:
2 2 "Sec. . MONITORING AND REPORT. The department
2 3 of economic development shall monitor the activities
2 4 of eligible businesses under section 15.331B and
2 5 report to the general assembly by December 15 of each
2 6 year."
