  1  1    Section 1.  There is appropriated from the general fund of
  1  2 the state and other designated funds to the department of
  1  3 economic development for the fiscal year beginning July 1,
  1  4 1996, and ending June 30, 1997, on the condition that the
  1  5 department shall not use any moneys appropriated under this
  1  6 Act for further expansion of industrial site locator programs
  1  7 until the industrial site locator program at the university of
  1  8 northern Iowa is completed and fully implemented and the
  1  9 department and the university have reported to the general
  1 10 assembly on plans for coordination and cooperation between the
  1 11 department and the university, including access by the
  1 12 department to the database and technology of the university
  1 13 program, the following amounts, or so much thereof as is
  1 14 necessary, to be used for the purposes designated:
  1 15    1.  ADMINISTRATIVE SERVICES DIVISION
  1 16    a.  General administration
  1 17    For salaries, support, maintenance, miscellaneous purposes,
  1 18 and for providing that a business receiving moneys from the
  1 19 department for the purpose of job creation shall make
  1 20 available ten percent of the new jobs created for promise jobs
  1 21 program participants who are qualified for the jobs and for
  1 22 not more than the following full-time equivalent positions:

  1 25    The director shall coordinate efforts with the workforce

  3  3    d.  Strategic investment fund
  3  4    For deposit in the strategic investment fund for the
  3  5 purposes of the fund including providing funds for use in
  3  6 making awards from the community economic betterment account
  3  7 which, if under $500,000, must be to businesses able to pay
  3  8 100 percent of the average county wage within two years of
  3  9 project initiation, and which, if $500,000 or over, must be to
  3 10 businesses able to pay at least 130 percent of the average
  3 11 county wage, for providing that the wage cap in high wage
  3 12 counties tied to an appropriate inflator for determining
  3 13 eligibility for awards, and for reporting on the progress made
  3 14 by the department in making the community economic betterment
  3 15 program a self-sustaining, revolving loan program, and for
  3 16 salaries, support, not more than the following full-time
  3 17 equivalent positions, and for allocating $500,000 to a new
  3 18 competitive grant program for innovative programs designed to
  3 19 increase per capita income in Iowa and for allocating $222,792
  3 20 to the self-employment loan program for the purposes of the
  3 21 microbusiness rural enterprise assistance program under
  3 22 section 15.114:

  3 33 of insurance in excess of the anticipated gross revenues under
  3 34 section 505.7, subsection 3, to the department for the fiscal
  3 35 year beginning July 1, 1996, and ending June 30, 1997, the
  4  1 following amount, or so much thereof as is necessary, for
  4  2 insurance economic development and international insurance
  4  3 economic development:

  4 33 and the rural enterprise fund and for allocating $125,000 for
  4 34 the purposes of the microbusiness rural enterprise assistance

  5 14 revert but shall be available for expenditure for purposes of

  5 16    d.  Community development block grant and HOME
  5 17    For administration and related federal housing and urban
  5 18 development grant administration for salaries, support,
  5 19 maintenance, miscellaneous purposes, for not more than the
  5 20 following full-time equivalent positions and for directing 50
  5 21 percent of the community development and home funds received
  5 22 to councils of governments and counties not included in any
  5 23 council of governments on a per capita basis for local
  5 24 projects consistent with the purposes of those programs:

  5 34    There is appropriated from the rural community 2000 program

  6  1 Iowa's councils of governments funds for planning and
  6  2 technical assistance funds to assist local governments to
  6  3 develop community development strategies for addressing long-
  6  4 term and short-term community needs:

  6  7    For distributing on a per capita basis to each council of
  6  8 governments:

  6 10    g.  Housing development fund
  6 11    For providing technical assistance to communities of all

  6 13 housing needs and to provide and transfer matching funds for

  6 16    4.  INTERNATIONAL DIVISION
  6 17    a.  International trade operations
  6 18    For salaries, support, maintenance, miscellaneous purposes,
  6 19 for not more than the following full-time equivalent
  6 20 positions, and for allocating $100,000 to promote trade
  6 21 opportunities in Korea and the Pacific rim:

  6 24    The department shall privatize international trade and
  6 25 export assistance programs by June 30, 1997.  The department
  6 26 shall contract with a business and trade association that
  6 27 represents a broad segment of Iowa business and industry to
  6 28 promote international trade and export enhancement efforts for
  6 29 Iowa businesses.  The contract will contain benchmarks and
  6 30 performance measures which the department shall monitor.  The
  6 31 contract shall also require the association to provide an
  6 32 annual performance report to the international division of the
  6 33 department.
  6 34    b.  Foreign trade offices
  6 35    For salaries, support, maintenance, miscellaneous purposes,
  7  1 and for not more than the following full-time equivalent
  7  2 positions:

  7  4    c.  Export trade assistance program
  7  5    For export trade activities, including a program to
  7  6 encourage and increase participation in trade shows and trade
  7  7 missions by providing financial assistance to businesses for a
  7  8 percentage of their costs of participating in trade shows and
  7  9 trade missions, by providing for the lease/sublease of
  7 10 showcase space in existing world trade centers, by providing
  7 11 temporary office space for foreign buyers, international
  7 12 prospects, and potential reverse investors, and by providing
  7 13 other promotional and assistance activities, including
  7 14 salaries and support for not more than the following full-time
  7 15 equivalent positions:

  7 18    d.  Agricultural product advisory council
  7 19    For support, maintenance, and miscellaneous purposes:

  7 21    e.  For transfer to the partner state program which the
  7 22 department may use to contract with private groups or
  7 23 organizations which are the most appropriate to administer
  7 24 this program and the groups and organizations participating in
  7 25 the program shall, to the fullest extent possible, provide the
  7 26 funds to match the appropriation made in this subsection of
  7 27 the funds transferred:

  7 29    5.  TOURISM DIVISION
  7 30    a.  Tourism operations
  7 31    For salaries, support, maintenance, miscellaneous purposes,
  7 32 and for not more than the following full-time equivalent
  7 33 positions, provided that the appropriation shall not be used
  7 34 for advertising placements for in-state and out-of-state
  7 35 tourism marketing:

  8  3    b.  Tourism advertising
  8  4    For contracting exclusively for tourism advertising for in-
  8  5 state and out-of-state tourism marketing services, tourism
  8  6 promotion programs, electronic media, print media, and printed
  8  7 materials and for making available up to one-half of the
  8  8 moneys appropriated in this lettered paragraph to regional
  8  9 tourism associations on a per capita basis for funding local
  8 10 and regional tourism projects and promotions:  
  8 11 .................................................. $  2,687,000
  8 12    The department shall not use the moneys appropriated in
  8 13 this lettered paragraph, unless the department develops
  8 14 public-private partnerships with Iowa businesses in the
  8 15 tourism industry, Iowa tour groups, Iowa tourism
  8 16 organizations, and political subdivisions in this state to
  8 17 assist in the development of advertising efforts.  The
  8 18 department shall, to the fullest extent possible, develop
  8 19 cooperative efforts for advertising with contributions from
  8 20 other sources.
  8 21    6.  BUSINESS CONSORTIA AND SUPPLIER NETWORK TRAINING
  8 22    For deposit in the workforce development fund for training
  8 23 directed at specific needs of businesses involved with
  8 24 business consortia and supplier networks on the condition that
  8 25 training shall not be provided to a business which uses
  8 26 outsourcing:  
  8 27 .................................................. $    150,000
  8 28    Sec. 2.  Notwithstanding section 15E.120, subsections 5, 6,
  8 29 and 7, and section 15.287, there is appropriated from the Iowa
  8 30 community development loan fund all the moneys available
  8 31 during the fiscal year beginning July 1, 1996, and ending June
  8 32 30, 1997, to the department of economic development for the
  8 33 rural development program to be used by the department for the
  8 34 purposes of the program.
  8 35    Sec. 3.  Notwithstanding section 15.251, subsection 2,
  9  1 there is appropriated from the job training fund to the
  9  2 department of economic development for the fiscal year
  9  3 beginning July 1, 1996, and ending June 30, 1997, the
  9  4 following amounts, or so much thereof as is necessary, to be
  9  5 used for the purposes designated:
  9  6    For administration of chapter 260E, including salaries,
  9  7 support, maintenance, miscellaneous purposes, and for not more
  9  8 than the following full-time equivalent positions:  
  9  9 .................................................. $    160,000
  9 10 ............................................... FTEs        2.40
  9 11    Appropriations to the department of economic development
  9 12 for administration of chapter 260E and the department of
  9 13 employment services for the target alliance program shall be
  9 14 funded on a proportional basis if receipts to the job training
  9 15 fund are insufficient to fund both appropriations in their
  9 16 entirety.
  9 17    Sec. 4.  Of all funds appropriated to or receipts credited
  9 18 to the job training fund created in section 260F.6, subsection
  9 19 1, up to $125,000 for the fiscal year beginning July 1, 1996,
  9 20 and ending June 30, 1997, and some or all of the full-time
  9 21 equivalent positions may be used for the administration of the
  9 22 Iowa small business new job training Act.
  9 23    Sec. 5.  Notwithstanding section 8.33, funds remaining
  9 24 unobligated on June 30, 1996, in the Wallace technology
  9 25 transfer foundation shall be used by the department to develop
  9 26 a strategic plan for technology transfer and to support
  9 27 technology transfer.
  9 28    Sec. 6.  The Iowa seed capital corporation shall not make
  9 29 any new investments after June 30, 1996.  The portfolio of
  9 30 investments held by the seed capital corporation on June 30,
  9 31 1996, shall be transferred to a private entity for management
  9 32 of the investments.  Notwithstanding section 8.33, funds
  9 33 remaining unobligated in the Iowa seed capital corporation
  9 34 fund at the close of fiscal year 1995-1996 shall be
  9 35 transferred to the housing program fund created in section
 10  1 16.40.
 10  2    Sec. 7.  There is appropriated from the general fund of the
 10  3 state to the Iowa state university of science and technology
 10  4 for the fiscal year beginning July 1, 1996, and ending June
 10  5 30, 1997, the following amounts, or so much thereof as is
 10  6 necessary, to be used for the purposes designated:
 10  7    1.  For funding and maintaining in their current locations
 10  8 the existing small business development centers, and for not
 10  9 more than the following full-time equivalent positions:  
 10 10 .................................................. $  1,216,245

 10 12    2.  For funding the institute for physical research and
 10 13 technology, allocating $142,212 for a new technology transfer
 10 14 program, and for not more than the following full-time
 10 15 equivalent positions:

 10 18    It is the intent of the general assembly that the incentive
 10 19 program focus on Iowa industrial sectors and seek
 10 20 contributions and in-kind donations from businesses,
 10 21 industrial foundations, and trade associations and that moneys
 10 22 for the institute for physical research and technology
 10 23 industrial incentive program shall only be allocated for
 10 24 projects which are matched by private sector moneys for
 10 25 directed contract research or for nondirected research.  The
 10 26 match required of small businesses as defined in section
 10 27 15.102, subsection 4, for directed contract research or for
 10 28 nondirected research shall be $1 for each $3 of state funds.
 10 29 The match required for other businesses for directed contract
 10 30 research or for nondirected research shall be $1 for each $1
 10 31 of state funds.  The match required of industrial foundations
 10 32 or trade associations shall be $1 for each $1 of state funds.
 10 33    Iowa state university shall report annually to the joint
 10 34 appropriations subcommittee on economic development of the
 10 35 senate and house appropriations committees the total amounts
 11  1 of private contributions, the proportion of contributions from
 11  2 small businesses and other businesses, and the proportion for
 11  3 directed contract research and nondirected research of benefit
 11  4 to Iowa businesses and industrial sectors.
 11  5    Notwithstanding section 8.33, moneys appropriated for any
 11  6 fiscal year which remain unobligated and unexpended at the end
 11  7 of the fiscal year shall not revert but shall be available for
 11  8 expenditure the following fiscal year.
 11  9    Sec. 8.  There is appropriated from the general fund of the
 11 10 state to the state university of Iowa for the fiscal year
 11 11 beginning July 1, 1996, and ending June 30, 1997, the
 11 12 following amount, or so much thereof as is necessary, to be
 11 13 used for the purpose designated:
 11 14    For funding the advanced drug development program at the
 11 15 Oakdale research park and for not more than the following
 11 16 full-time equivalent positions:  
 11 17 .................................................. $    319,169

 11 19    The board of regents shall submit a report on the progress
 11 20 of regents institutions in meeting the strategic plan for
 11 21 technology transfer and economic development to the
 11 22 chairpersons of the joint appropriations subcommittee on
 11 23 economic development, the joint appropriations subcommittee on
 11 24 education, the majority leader and minority leader of the
 11 25 senate, the majority and minority leaders of the house of
 11 26 representatives, the secretary of the senate, the chief clerk
 11 27 of the house of representatives, and the legislative fiscal
 11 28 bureau by December 1, 1996.
 11 29    Sec. 9.  DEPARTMENT OF EMPLOYMENT SERVICES.  There is
 11 30 appropriated from the general fund of the state, to the
 11 31 department of employment services for the fiscal year
 11 32 beginning July 1, 1996, and ending June 30, 1997, the
 11 33 following amounts, or so much thereof as is necessary, for the
 11 34 purposes designated, including that the department of
 11 35 employment services, the department of personnel, and the
 12  1 department of management shall ensure that all nonsupervisory
 12  2 full-time equivalent positions authorized and funded for the
 12  3 department of employment services in this section will be
 12  4 utilized during the fiscal year beginning July 1, 1996, and
 12  5 ending June 30, 1997, and during future fiscal years, and will
 12  6 not be held vacant, to ensure that the backlog of cases in
 12  7 that department will be reduced as rapidly as possible:
 12  8    1.  DIVISION OF LABOR SERVICES
 12  9    For salaries, support, maintenance, miscellaneous purposes,
 12 10 and for not more than the following full-time equivalent
 12 11 positions contingent upon the enactment of section 11 of this
 12 12 Act and the provision which requires moneys appropriated from
 12 13 the special employment security contingency fund to first be
 12 14 used to fully fund the appropriation of $296,000 to the
 12 15 division of labor services in subsection 1 of section 12 of
 12 16 this Act prior to funding the appropriation in section 12 of
 12 17 this Act to the division of industrial services:

 12 20    From the contractor registration fees, the division of
 12 21 labor services shall reimburse the department of inspections
 12 22 and appeals for all costs associated with hearings under

 12 25    For salaries, support, maintenance, miscellaneous purposes,

 13 21 youth in areas with high juvenile crime rates and high
 13 22 minority populations in cities with populations exceeding

 13 31    b.  Workforce investment program
 13 32    For allocating $425,000 for funding, to the extent
 13 33 possible, the currently existing high technology
 13 34 apprenticeship programs, under section 260C.44 at the
 13 35 community colleges, and for the purposes of the workforce
 14  1 investment program, for a competitive grant program by the
 14  2 department for projects that increase Iowa's pool of available
 14  3 labor via training and support services with priority given to
 14  4 projects which serve displaced homemakers or welfare
 14  5 recipients, including salaries and support:

 14  8    The department shall ensure that the workforce investment
 14  9 program is coordinated with services provided under the
 14 10 federal Job Training Partnership Act and that welfare
 14 11 recipients receive priority for services under both programs.

 14 13 under contract that remain unexpended at the end of the fiscal
 14 14 year, shall not revert to any fund but shall be available for
 14 15 expenditure for purposes of the contract during the succeeding

 14 18    For salaries, support, maintenance, miscellaneous purposes,
 14 19 and for not more than the following full-time equivalent
 14 20 positions:

 14 23    Notwithstanding section 8.33, moneys committed to grantees

 14 27 fiscal year.  The department shall not use moneys appropriated
 14 28 in this lettered paragraph for grants to grantees who do not
 14 29 facilitate the active participation of labor as members of
 14 30 labor management councils or who fail to make a good faith
 14 31 effort to either schedule meetings during nonworking hours or
 14 32 obtain voluntary agreements with employers to allow employees
 14 33 time off to attend labor management council meetings with no
 14 34 loss of pay or other benefits.
 14 35    Sec. 10.  Notwithstanding section 15.251, subsection 2,
 15  1 there is appropriated from the job training fund to the
 15  2 department of employment services for the fiscal year
 15  3 beginning July 1, 1996, and ending June 30, 1997, the
 15  4 following amount, or so much thereof as is necessary, to be
 15  5 used for the purpose designated:
 15  6    For the target alliance program:  
 15  7 .................................................. $     30,000
 15  8    Sec. 11.  ADMINISTRATIVE CONTRIBUTION SURCHARGE FUND.
 15  9 There is appropriated from the administrative contribution
 15 10 surcharge fund of the state to the department of employment
 15 11 services for the fiscal year beginning July 1, 1996, and
 15 12 ending June 30, 1997, the following amount, or so much thereof
 15 13 as is necessary, for the purposes designated:
 15 14    DIVISION OF JOB SERVICE
 15 15    Notwithstanding section 96.7, subsection 12, paragraph "c",
 15 16 for salaries, support, maintenance, conducting labor
 15 17 availability surveys, miscellaneous purposes, and for not more
 15 18 than the following full-time equivalent positions:  
 15 19 .................................................. $  6,310,000
 15 20 ............................................... FTEs     141.54
 15 21    1.  The department of employment services shall provide
 15 22 services throughout the fiscal year beginning July 1, 1996,
 15 23 and ending June 30, 1997, in all communities in which
 15 24 workforce centers are operating on July 1, 1993.  However,
 15 25 this provision shall not prevent the consolidation of multiple
 15 26 offices within the same city or the colocation of workforce
 15 27 centers with another public agency.
 15 28    2.  The division of industrial services shall not reduce
 15 29 the number of scheduled hearings of contested cases or
 15 30 eliminate the venue of such hearings, as established by the
 15 31 division for the period beginning January 1, 1996, and ending
 15 32 January 20, 1997.  The division shall also establish a
 15 33 substantially similar schedule for such hearings for the
 15 34 period beginning January 20, 1997, and ending June 30, 1997.
 15 35 The division shall report to the legislative fiscal bureau
 16  1 concerning any modification of the established schedule, or
 16  2 any changes which the division determines are necessary in
 16  3 establishing the schedule for the period beginning January 20,
 16  4 1997, and ending June 30, 1997.
 16  5    3.  The division shall continue charging a $65 filing fee
 16  6 for workers' compensation cases.  The filing fee shall be paid
 16  7 by the petitioner of a claim.  However, the fee can be taxed
 16  8 as a cost and paid by the losing party, except in cases where
 16  9 it would impose an undue hardship or be unjust under the
 16 10 circumstances.
 16 11    Sec. 12.  EMPLOYMENT SECURITY CONTINGENCY FUND.  There is
 16 12 appropriated from the special employment security contingency
 16 13 fund to the department of employment services for the fiscal
 16 14 year beginning July 1, 1996, and ending June 30, 1997, the
 16 15 following amounts, or so much thereof as is necessary, for the
 16 16 purposes designated and subject to the requirement that the
 16 17 appropriation to the division of labor services under this
 16 18 section be fully funded from the special employment security
 16 19 contingency fund prior to any amounts being used to fund the
 16 20 appropriation made to the division of industrial services
 16 21 under this section:
 16 22    1.  DIVISION OF LABOR SERVICES
 16 23    For salaries, support, maintenance, and miscellaneous
 16 24 purposes:  
 16 25 .................................................. $    296,000
 16 26    2.  DIVISION OF INDUSTRIAL SERVICES
 16 27    For salaries, support, maintenance, and miscellaneous
 16 28 purposes:  
 16 29 .................................................. $    175,000
 16 30    Any additional penalty and interest revenue may be used to
 16 31 accomplish the mission of the department.
 16 32    Sec. 13.  PUBLIC EMPLOYMENT RELATIONS BOARD.  There is
 16 33 appropriated from the general fund of the state to the public
 16 34 employment relations board for the fiscal year beginning July
 16 35 1, 1996, and ending June 30, 1997, the following amount, or so
 17  1 much thereof as is necessary, for the purposes designated:
 17  2    For salaries, support, maintenance, miscellaneous purposes,
 17  3 and for not more than the following full-time equivalent
 17  4 positions:  
 17  5 .................................................. $    777,164
 17  6 ............................................... FTEs      12.80
 17  7    Sec. 14.  There is appropriated from the general fund of
 17  8 the state to the Iowa finance authority for the fiscal year
 17  9 beginning July 1, 1996, and ending June 30, 1997, the
 17 10 following amount, or so much thereof as is necessary, to be
 17 11 used for the purpose designated:
 17 12    For deposit in the housing improvement fund created in
 17 13 section 16.100 for purposes of the fund:  
 17 14 .................................................. $    700,000
 17 15    Sec. 15.  NEW SECTION.  15.113  ECONOMIC DEVELOPMENT
 17 16 ASSISTANCE – REPORT.  In order for the general assembly to
 17 17 have accurate and complete information regarding expenditures
 17 18 for economic development and job training incentives and to
 17 19 respond to the job training needs of Iowa workers, the
 17 20 department shall report to the general assembly by January 15
 17 21 of each year regarding all assistance or benefits provided
 17 22 under the community economic betterment program, the new jobs
 17 23 and income program, and the Iowa industrial new jobs training
 17 24 Act during the previous calendar year.  The report shall
 17 25 identify by company name each individual business receiving
 17 26 any assistance or benefits and shall contain a breakdown by
 17 27 company name of the amount of assistance or benefits provided
 17 28 to each individual business, including the amount of local and
 17 29 state tax abatements, grants, loans, on-the-job and customized
 17 30 job training moneys received, and the actual or estimated tax
 17 31 credits taken.
 17 32    Sec. 16.  NEW SECTION.  15.114  MICROBUSINESS RURAL
 17 33 ENTERPRISE ASSISTANCE.
 17 34    1.  As used in this section:
 17 35    a.  "Department" means the department of economic
 18  1 development.
 18  2    b.  "Microbusiness" or "microbusiness enterprise" means a
 18  3 business producing services with five or fewer full-time
 18  4 equivalent employee positions and with assistance requirements
 18  5 of not more than twenty-five thousand dollars.
 18  6    c.  "Microbusiness organization" means a nonprofit
 18  7 corporation organized under chapter 504A which is exempt from
 18  8 taxation pursuant to section 501(c) of the Internal Revenue
 18  9 Code and which has a principal mission of actively engaging in
 18 10 microbusiness development, training, technical assistance, and
 18 11 capital access for the start-up or expansion of
 18 12 microbusinesses.
 18 13    2.  The department shall contract with a microenterprise
 18 14 organization actively engaged in microbusiness enterprise to
 18 15 assist in the establishment of this program.  In order to
 18 16 qualify for the contract, the microenterprise organization
 18 17 shall do all of the following:
 18 18    a.  Demonstrate a past performance of and a capacity to
 18 19 successfully engage in microbusiness development.
 18 20    b.  Have a statewide commitment to and focus on
 18 21 microbusiness development.
 18 22    c.  Provide training and technical assistance.
 18 23    d.  Demonstrate an ability to provide access to capital for
 18 24 start-up or expansion of a microbusiness.
 18 25    e.  Have established linkages with financial institutions.
 18 26    f.  Demonstrate an ability to provide follow-up technical
 18 27 assistance after a microbusiness start-up or expansion.
 18 28    3.  Moneys allocated pursuant to this section which remain
 18 29 unexpended or unobligated at the end of a fiscal year shall
 18 30 remain available to the department to support the assistance
 18 31 program or may be credited to the value-added agricultural
 18 32 products and processes financial assistance fund created in
 18 33 section 15E.112 and shall not revert notwithstanding section
 18 34 8.33.
 18 35    4.  The department shall submit a report in accordance with
 19  1 section 7A.11 not later than November 1 of each year detailing
 19  2 the activities of the microenterprise organization and
 19  3 describing the success of the project.
 19  4    Sec. 17.  Section 15.313, subsection 2, Code 1995, is
 19  5 amended by adding the following new paragraphs:
 19  6    NEW PARAGRAPH.  g.  The entrepreneurs with disabilities
 19  7 program, which provides technical and financial assistance to
 19  8 help persons with disabilities become self-sufficient and
 19  9 create additional employment opportunities by establishing or
 19 10 expanding small business ventures.
 19 11    NEW PARAGRAPH.  h.  The job opportunities for persons with
 19 12 disabilities program, which provides service and technical
 19 13 assistance to rehabilitation organizations or agencies that
 19 14 create, expand, or spin off business ventures for persons with
 19 15 disabilities.
 19 16    Sec. 18.  NEW SECTION.  15.328  PUBLIC RECORDS.
 19 17    Notwithstanding any other provision of the Code to the
 19 18 contrary, applications from businesses and communities and
 19 19 application files maintained by the department are public
 19 20 records.  All details of an award under this part shall be
 19 21 disclosed to the public at the time public notice of the award
 19 22 is given.
 19 23    Sec. 19.  Section 15.343, Code Supplement 1995, is amended
 19 24 by adding the following new subsection:
 19 25    NEW SUBSECTION.  4.  Funds provided through the workforce
 19 26 development fund shall not be used to fund out-of-state travel
 19 27 or drug testing.
 19 28    Sec. 20.  NEW SECTION.  15A.4  COMPETITIVE PROGRAMS – GOOD
 19 29 NEIGHBOR AGREEMENT – ADDITIONAL CONSIDERATION.
 19 30    For any program providing financial assistance for economic
 19 31 development in which the assistance is provided on a
 19 32 competitive basis, a business which enters into a good
 19 33 neighbor agreement shall receive extra consideration of at
 19 34 least ten points or the equivalent.  A good neighbor agreement
 19 35 is an enforceable contract between the business and a
 20  1 community group or coalition of community groups which
 20  2 requires the business to adhere to negotiated environmental,
 20  3 economic, labor, or other social and community standards.
 20  4    A business which fails to abide by the good neighbor
 20  5 agreement shall repay all financial assistance received under
 20  6 the program.
 20  7    Sec. 21.  Section 159A.7, subsection 3, Code 1995, is
 20  8 amended to read as follows:
 20  9    3.  Until July 1, 2000, moneys shall be deposited in the
 20 10 fund as provided in section 423.24.  Not more than one and
 20 11 one-half four percent of the total moneys available to support
 20 12 value-added agricultural products and processes pursuant to
 20 13 section 423.24 shall be allocated to the department for
 20 14 administration of the office.
 20 15    Sec. 22.  Section 260E.3, Code Supplement 1995, is amended
 20 16 by adding the following new subsection:
 20 17    NEW SUBSECTION.  6.  An agreement to establish or modify a
 20 18 project shall provide that all funds allocated for job
 20 19 training, except administrative expenses, shall be used solely
 20 20 and exclusively for that purpose, and that funds for the
 20 21 project shall not be used for out-of-state travel or drug
 20 22 testing.
 20 23    Sec. 23.  Section 260F.3, Code 1995, is amended by adding
 20 24 the following new subsection:
 20 25    NEW SUBSECTION.  9.  An agreement to establish or modify a
 20 26 project shall provide that funds for the project shall not be
 20 27 used for out-of-state travel or drug testing.
 20 28    Sec. 24.  Notwithstanding sections 15.108, 15.224 through
 20 29 15.230, 15.347, 15.348, and 239.22, the department of
 20 30 employment services shall administer the following programs:
 20 31 job training partnership Act, Iowa conservation corps,
 20 32 americorps, mentoring for PROMISE JOBS, food stamp employment
 20 33 and training, and the labor/management co-op programs.
 20 34    Sec. 25.  FEDERAL GRANTS.  All federal grants to and the
 20 35 federal receipts of agencies appropriated funds under this
 21  1 Act, not otherwise appropriated, are appropriated for the
 21  2 purposes set forth in the federal grants or receipts unless
 21  3 otherwise provided by the general assembly.
 21  4    Sec. 26.  PERFORMANCE AUDIT.  The auditor of state shall
 21  5 conduct or cause to be conducted a performance audit of job
 21  6 training projects under the Iowa industrial new jobs training
 21  7 Act for at least the previous five years.  The auditor shall
 21  8 report on the performance audit to the general assembly not
 21  9 later than January 15, 1997.  The report shall contain at
 21 10 least the following:
 21 11    1.  The types of program services funded under the program.
 21 12    2.  The type and quality of program services actually
 21 13 provided.
 21 14    3.  The amount of job training actually provided, if any.
 21 15    4.  The relative numbers of job training recipients who are
 21 16 production versus management employees.
 21 17    5.  The demographic characteristics of recipients of the
 21 18 job training, including but not limited to gender, race, age,
 21 19 and disability status.
