PAG LIN 1 1 Amend House File 120 as follows: 1 2 #1. By striking everything after the enacting 1 3 clause and inserting the following: 1 4 "Section 1. NEW SECTION. 295.1 SCHOOL 1 5 IMPROVEMENT PROGRAM. 1 6 The general assembly finds that the fundamental 1 7 unit of educational improvement is the individual 1 8 schools in each community. The general assembly 1 9 further finds that the success of Iowa's educational 1 10 system has resulted from the high degree of 1 11 responsibility provided to local districts with regard 1 12 to educational decisions affecting their students. 1 13 The purpose of this chapter is to provide additional 1 14 resources for improvement at the school level, 1 15 particularly to provide compensation for school 1 16 instructional staff and school service personnel for 1 17 school improvement efforts. 1 18 Sec. 2. NEW SECTION. 295.2 DEFINITIONS. 1 19 1. "School level instructional staff" means an 1 20 individual holding a practitioner's license issued 1 21 under chapter 272 by the board of educational 1 22 examiners, who is employed in a nonadministrative 1 23 position by a school district pursuant to a contract 1 24 issued by a board of directors under section 279.13; 1 25 an administrator as defined in section 272.1, who is 1 26 assigned to work at one or more school sites; an 1 27 educational aide as defined under rules of the 1 28 department of education; and an area education agency 1 29 special education staff member assigned to a classroom 1 30 teaching assignment in a school district. 1 31 2. "School" means an attendance center within a 1 32 public school district under section 280.2. 1 33 3. "School service personnel" means a person 1 34 holding a practitioner's license who provides support 1 35 services to a student enrolled in school or to 1 36 practitioners employed by a school. 1 37 Sec. 3. NEW SECTION. 295.3 SCHOOL IMPROVEMENT 1 38 PLAN. 1 39 1. A plan developed under this section shall be 1 40 for a four-year period and may include plans for the 1 41 entire district and individual schools within the 1 42 district. Plans must be developed with involvement 1 43 from school-level instructional staff and school 1 44 service personnel, parents, and representatives of the 1 45 school district community, and must set academic goals 1 46 for students as identified in the reports submitted 1 47 pursuant to section 280.18. School-based building 1 48 plans shall be submitted to the board of directors of 1 49 the district no later than May 1 of the preceding 1 50 school year. Plans shall indicate the additional 2 1 instructional or noninstructional duties of school- 2 2 level instructional staff and school service personnel 2 3 performed beyond the regular instructional or 2 4 noninstructional duties for compensation pursuant to 2 5 this section. 2 6 2. The board of directors shall submit, to the 2 7 department of education by June 30 of the preceding 2 8 school year, on a form provided by the department of 2 9 education, assurances that the school improvement plan 2 10 was developed pursuant to subsection 1 and that the 2 11 district will comply with subsection 3 of this 2 12 section. 2 13 3. The board of directors of each school district 2 14 and each school participating in a school improvement 2 15 plan shall report to their respective constituents on 2 16 student progress toward meeting the identified goals 2 17 for their district. The report submitted under this 2 18 subsection may be used to meet the reporting 2 19 requirements of section 280.18 if the provisions of 2 20 this subsection and section 280.18 are met. 2 21 4. Provisions of school improvement plans 2 22 involving compensation shall be consistent with 2 23 current collective bargaining agreements. 2 24 Sec. 4. NEW SECTION. 295.4 SCHOOL IMPROVEMENT 2 25 FUND. 2 26 A school improvement fund is established in the 2 27 office of treasurer of state to be administered by the 2 28 department of education. Moneys appropriated by the 2 29 general assembly for deposit in the fund shall be paid 2 30 to school districts pursuant to the requirements of 2 31 this chapter. Moneys received by school districts and 2 32 area education agencies may be used to compensate 2 33 school level instructional staff and school service 2 34 personnel for performance of additional instructional 2 35 or noninstructional duties beyond the regular 2 36 instructional or noninstructional duties. 2 37 Notwithstanding section 8.33, any balance in the fund 2 38 on June 30 of any fiscal year shall not revert to the 2 39 general fund of the state. 2 40 Sec. 5. NEW SECTION. 295.5 ALLOCATIONS AND 2 41 PAYMENTS. 2 42 1. The amount of moneys allocated from the school 2 43 improvement fund to each school district for each 2 44 fiscal year shall be based upon the proportion that 2 45 the basic enrollment of the district for a budget year 2 46 as defined under section 257.6 bears to the sum of the 2 47 basic enrollments of all districts in the state for 2 48 that budget year. 2 49 2. Commencing with the school year beginning July 2 50 1, 1995, and annually for each subsequent four-year 3 1 period, the department of education shall notify the 3 2 department of revenue and finance of the amount of 3 3 school improvement money to be paid to each school 3 4 district. Payments shall be made by the department of 3 5 revenue and finance on a monthly basis commencing on 3 6 October 15 and ending June 15 of each fiscal year, 3 7 taking into account the relative budget position and 3 8 cash position of the state resources. The payments 3 9 shall be separate from state aid payments made 3 10 pursuant to sections 257.16 and 257.35. The school 3 11 district shall allocate moneys to the area education 3 12 agency in which the district is located for payment of 3 13 area education agency staff, as defined in section 3 14 295.2, subsection 1, who are participating in the 3 15 school improvement program. Payments made to school 3 16 districts under this chapter are miscellaneous income 3 17 for purposes of chapter 257. 3 18 Sec. 6. NEW SECTION. 295.6 CONTROLS ON 3 19 EXPENDITURES. 3 20 Funds received under this chapter shall be expended 3 21 only for the following purposes: 3 22 1. To provide compensation for school-level 3 23 instructional staff and school service personnel, for 3 24 activities and responsibilities that are part of the 3 25 school improvement plan approved by the district, 3 26 approved under subsection 3, and are in addition to 3 27 the regular activities and duties of the school and 3 28 instructional staff and of the school service 3 29 personnel; and to pay costs of the employer's share of 3 30 federal social security and the Iowa public employees' 3 31 retirement system, or a pension and annuity retirement 3 32 system established under chapter 294. 3 33 2. To provide for the costs of substitute 3 34 instructional staff to permit the regular 3 35 instructional staff to engage in planning or training 3 36 activities that are part of the school improvement 3 37 plan. 3 38 3. To provide for the costs associated with 3 39 specialized or general training that are part of the 3 40 school improvement plan." 3 41 #2.
