1 1 Section 1. NEW SECTION. 295.1 SCHOOLS MAKING ADVANCES
1 2 THROUGH TECHNOLOGY PROGRAM.
1 3 In order to meet the present and future technological needs
1 4 of the children of this state, it is the intent of the general
1 5 assembly that teachers employed by, and students enrolled in,
1 6 Iowa's school districts have access to computers and computer
1 7 technology in their schools.
1 8 Sec. 2. NEW SECTION. 295.2 TECHNOLOGY ASSISTANCE TRUST
1 9 FUND.
1 10 1. A technology assistance trust fund is created in the
1 11 office of the treasurer of state under the control of the
1 12 department of education. There is appropriated to the
1 13 technology assistance trust fund for the fiscal year beginning
1 14 July 1, 1995, and ending June 30, 1996, the sum of fifteen
1 15 million dollars from the general fund of the state. There is
1 16 appropriated to the technology assistance trust fund for the
1 17 fiscal year beginning July 1, 1996, and ending June 30, 1997,
1 18 the sum of thirty million dollars from the general fund of the
1 19 state. There is appropriated to the technology assistance
1 20 trust fund for the fiscal year beginning July 1, 1997, and
1 21 ending June 30, 1998, the sum of forty-five million dollars
1 22 from the general fund of the state. There is appropriated to
1 23 the technology assistance trust fund for the fiscal year
1 24 beginning July 1, 1998, and ending June 30, 1999, the sum of
1 25 sixty million dollars from the general fund of the state.
1 26 Moneys appropriated by the general assembly for deposit in the
1 27 fund shall be paid to the school districts, the Iowa braille
1 28 and sight saving school, and the state school for the deaf
1 29 pursuant to the requirements of this chapter.
1 30 2. Notwithstanding section 8.33, any unexpended or
1 31 unencumbered balances in the technology assistance trust fund
1 32 at the end of each fiscal year shall be retained in the fund
1 33 until June 30, 2000. Any unexpended or unencumbered balances
1 34 of moneys received under this chapter and remaining in the
1 35 accounts established by the districts, the Iowa braille and
2 1 sight saving school, and the state school for the deaf on June
2 2 30, 1999, shall be deposited in the technology assistance
2 3 trust fund. For the school year beginning July 1, 1999, the
2 4 department of education shall allocate funds on a competitive
2 5 basis to the Iowa braille and sight saving school, the state
2 6 school for the deaf, and school districts that submit to the
2 7 department technology plans for the purposes described in
2 8 subsection 3. The state board of education shall adopt, by
2 9 July 1, 1998, rules which establish guidelines for the
2 10 approval of plans submitted by districts, the Iowa braille and
2 11 sight saving school, and the state school for the deaf under
2 12 this subsection.
2 13 3. Funds in the technology assistance trust fund may be
2 14 used for the following purposes:
2 15 a. To purchase or lease telephone equipment, computers,
2 16 computer networks, computer programs, computer software,
2 17 computer systems, and for computer services as defined in
2 18 section 716A.1.
2 19 b. For maintaining purchases listed under this subsection.
2 20 c. For financing for the procurement and maintenance costs
2 21 for Part III of the Iowa communications network as provided in
2 22 section 8D.13, subsection 3.
2 23 d. The costs of establishing an electronic classroom, or
2 24 purchasing or leasing satellite equipment, receiving
2 25 equipment, studio and production equipment, and other
2 26 associated equipment.
2 27 e. The costs of purchasing or leasing audio, visual, or
2 28 audiovisual machines, machinery, or equipment.
2 29 f. For training or staff development in the use of
2 30 equipment or software purchased or leased under this
2 31 subsection, up to ten percent of the annual allocation may be
2 32 used.
2 33 4. Moneys in the technology assistance trust fund shall
2 34 not be used for technological support for school
2 35 administrators.
3 1 Sec. 3. NEW SECTION. 295.3 ALLOCATIONS AND PAYMENTS.
3 2 1. The amount of moneys allocated from the technology
3 3 assistance trust fund to each school district, the Iowa
3 4 braille and sight saving school, and the state school for the
3 5 deaf for each fiscal year shall be in the proportion that the
3 6 basic enrollment of a district, the Iowa braille and sight
3 7 saving school, or the state school for the deaf for the budget
3 8 year as defined under section 257.6 bears to the sum of the
3 9 basic enrollment of the Iowa braille and sight saving school,
3 10 and the state school for the deaf, and of all districts in the
3 11 state for the budget year. The Iowa braille and sight saving
3 12 school and the state school for the deaf shall annually
3 13 certify their basic enrollment to the department of education
3 14 by October 1.
3 15 2. Commencing with the school year beginning July 1, 1995,
3 16 and for each succeeding year until June 30, 1999, the
3 17 department of education shall notify the department of revenue
3 18 and finance of the amount of technology assistance moneys to
3 19 be paid to each school district, the Iowa braille and sight
3 20 saving school, and the state school for the deaf. Payments
3 21 shall be made by the department of revenue and finance on a
3 22 monthly basis commencing on October 15 and ending June 15 of
3 23 each fiscal year, taking into account the relative budget
3 24 position and cash position of the state resources. The
3 25 payments shall be separate from state aid payments made
3 26 pursuant to sections 257.16 and 257.35.
3 27 3. Any moneys received under this chapter, and any
3 28 interest accrued on the moneys, shall not be commingled with
3 29 state aid payments made, under sections 257.16 and 257.35, to
3 30 a school district and shall be accounted for by the school
3 31 district separately from state aid payments. The Iowa braille
3 32 and sight saving school and the state school for the deaf
3 33 shall maintain a separate account for moneys received under
3 34 this chapter and any interest accrued on the moneys.
3 35 4. Payments made to school districts under this chapter
4 1 are miscellaneous income for purposes of chapter 257. Each
4 2 district shall maintain a separate listing within the district
4 3 budget for payments received and expenditures made pursuant to
4 4 this chapter.
4 5 5. Each school district, the Iowa braille and sight saving
4 6 school, and the state school for the deaf shall annually
4 7 submit to the department by June 30 a detailed report
4 8 accounting for the expenditure of moneys received pursuant to
4 9 this chapter.
4 10 Sec. 4. NEW SECTION. 295.4 REPEAL.
4 11 This chapter is repealed effective July 1, 2000.
