Thank you for your review of Section 216.8 of the Iowa Code. This section of the Code needs to be further reworked to be in compliance with the Federal mandates found in the Reasonable Accommodations and Reasonable Modifications provisions of the Federal Housing Amendments Act (FHAA). If the latter is not made to come into compliance, HUD could deny the ICRC funding for this failure to comply with the latter. (This has already happened to the Missouri Civil Rights Commission in 2023 to the tune of a half a million dollars.) Additionally, the current verbiage does not touch upon the very important distinction between the matter of "reasonableness" with regard to unsubsidized landlords and subsidized (Section 504, Section 8, etc.) landlords, nor upon the importance of the nexus between a disability and the requested accommodation. In addition to these FHAA mandates, this section of the Code must be clarified if this proposed legislation is to be accurately interpreted as well as to be in compliance with the private property protections provided for in the due process amendments found in both the Iowa and US Constitutions.
