Chairman Kaufmann, Representative James, and Representative Wheeler, on behalf of the members of Iowa Gun Owners I would like to express our strong support for House File 147, the Second Amendment Preservation Act (SAPA.) Over the last three years, gun owners have faced nonstop attacks from Joe Biden and various agencies within our federal government as they try to ban AR15s and similar firearms, institute a national gun owner registry, pass Red Flag Gun Seizures and more.Gun owners successfully fought to defeat these bills in Congress in 2021 and 20022, and then flipped the House last fall (in part by defeating Iowas Cindy Axne) to stop Bidens attacks. Unable to move gun control through Congress, Biden has turned to Executive Orders to declare gun control through executive fiat. One of these orders redefined pistol braces as a National Firearms Act item, meaning that for the approximately 40,000,000 Americans who own one of these braces, they will be facing felony charges on May 30 of this year, unless they register the brace with the ATF! But whether were talking about legislativebased gun control or gun control enacted via Executive Orders, Joe Biden is assuming that Iowa cops will enforce this agenda against gun owners in our state. Thats why its urgent that the Iowa legislature approve SAPA legislation, before adjournment this year. SAPA Defined: SAPA law instructs Iowa cops to exclusively enforce Iowa laws when it comes to firearms, ammunition, and accessories. In other words, Joe Biden would not be able to use our law enforcement community against law abiding gun owners, which would result in the vast majority of federal gun control laws going unenforced here in Iowa. SAPA does this by asserting the anticommandeering doctrine and which holds that the federal government may not simply commandeer the resources of the states and force them to carry out the dictates of the federal government. Iowa is a sovereign state. Iowa has its own legislature to pass laws on behalf of her people. Iowa protects the Second Amendment in her laws and state constitution. Iowa law enforcement, funded by Iowa taxpayers, are charged with enforcing Iowa laws. Simply put: Iowa is not the vassal of the federal government and our law enforcement community is not an appendage of the DOJ. SAPA law reminds Biden of that while protecting gun owners.SAPA Not a Supremacy Clause Violation: SAPA law is not a Supremacy Clause violation because SAPA law does not limit what the federal government may do here in Iowa. If Joe Biden wants to send federal agents into Iowa to enforce his gun control agenda, SAPA law would not stop that. But SAPA would stop Joe Biden from forcing Iowa cops to help him do it.The reality is that the federal government always relies on state and local partners to enforce their agenda, because they just dont have the manpower to do it themselves. And so while SAPA is not a Supremacy Clause violation, the impact of SAPA here in Iowa would be massive, as Bidens gun control agenda would go almost exclusively unenforced. This refusal to cooperate with federal laws or regulations is not new. Blue states/cities refused to deport violent illegal aliens during 20172020, and dozens of states have refused to enforce federal laws regarding marijuana for decades. SAPAs Supreme Court Precedent: The anticommandeering principle is not a new legal concept. The United States Supreme Court (SCOTUS) has upheld this principle in cases stretching back to 1842. In each of these cases, SCOTUS has reaffirmed that where the state and federal government disagree, the federal government has no authority to compel or commandeer the state (or their resources) to aid in the enforcement of federal law.While one of these cases touches directly on the Second Amendment, this concept is broader than that. SCOTUSs anticommandeering decisions cover gun rights, runaway slaves, sports betting, nuclear waste material, and much more. Some of these include: The 1842 Prigg v Pennsylvania decision; in this case SCOTUS held that the federal government could not force the states to enforce the Fugitive Slave Act of 1793. The 1997 New York v United States decision; in this case SCOTUS held that the federal government could not simply force New York State to dispose of radioactive waste in their state. The 1997 Printz v United States decision; in this case SCOTUS held that the state/county government of Arizona could not be compelled to enforce the Brady Gun Control bill. The 2012 NFIB v Sebelius decision; in this case SCOTUS held that the states could not be forced to expand Medicare. They further held that the federal government could not withhold money from the states to punish them for noncompliance. The 2018 Murphy v NCAA decision; in this case SCOTUS held that that New Jersey state legislature had the right to place restrictions on sports gambling, even though those restrictions contradicted federal law.Clearly the State of Iowa has the constitutional right to tell the federal government that our cops will not be enforcing federal gun control laws any longer. SAPA Protects Iowa Cops:HF147 contains civil penalties so that if a jurisdiction violated SAPA law and enforced federal gun control, the impacted gun owner could sue that agency (not the officer) in civil court for damages.The simple fact is that without these penalties, certain jurisdictions in Iowa would walk right over SAPA law. Thats why the legislature had to add penalties to a variety of existing laws over the last few years, to ensure compliance with the law from politicians at the county and local levels.Some have claimed that these penalties make SAPA anticop. But thats simply not the case. The overwhelming majority of Iowa cops love the Second Amendment and do NOT want to be forced to carry out Joe Bidens gun control agenda on fellow gun owners. Currently, our cops have two choices in dealing with these orders. One, violate their oath and their conscience and enforce gun control mandates. Second, refuse to carry out these orders, and get fired. SAPA law gives them true protection, by making it illegal for them to be used to enforce federal gun control laws. So while some law enforcement department heads may not like SAPA, front line officers love it! And to be clear, many of these same department heads opposed the Freedom Amendment, Constitutional Carry, StandYourGround law and even 2010s Shall Issue law. SAPA Does Not Help Criminals:Some will argue that SAPA law will benefit criminals, much like they claimed that Iowa would run red with blood after the passage of StandYourGround and Constitutional Carry law. This is, of course, false. SAPA law does not apply to felons. SAPA law does not apply to illegal aliens. SAPA law does not apply to outofstaters. SAPA law does not mean that the federal government cannot help the State of Iowa enforce Iowa laws. It can. SAPA law even allows Iowa cops to help the federal government enforce federal laws (even if a gun is involved) if an underlying state law regarding the distribution of narcotics or a violent crime against is being committed. Clearly this legislation will not help criminals. SAPA Precedent in Other States:The identical version of HF147 is the law of the land in nearby Missouri, which enacted SAPA in 2021. In Missouri, state and local cops enforce state laws when it comes to firearms, ammunition, and accessories. The federal government enforces federal gun laws on occasion. And crime rates havent changed. The DOJ has sued to block SAPA law at the Circuit Court level two times, and lost both cases. An appeal to the State Supreme Court was also defeated. The DOJ sued in federal district court over this last. And while oral argument were held last July, the judge has not issued an opinion in this case. Missouris AG who defended SAPA law in these cases was recently elected to the U.S. Senate. The Senate sponsor who passed SAPA law was recently elected to Congress. And not a single incumbent who voted for SAPA in Missouri lost their election over it. SAPA is What Gun Owners in Iowa Want:The members and supporters of Iowa Gun Owners have spoken very loudly about the Second Amendment here in Iowa since our inception in 2008. Gun owners have removed dozens of members of the House who voted for gun control since the 2010 election, flipping the chamber that year, and rebuffing the lefts efforts to take it back ever since.The same thing happened in the Senate in 2016. After years of blocking StandYourGround and Constitutional Carry, six of six incumbent Senate Democrats were removed from office, the chamber flipped into Republican hands, and its stayed that way.As a result of these efforts, Iowa recently passed Constitutional Carry and added protections for our gun rights in the state constitution by over 65% of the vote. Iowans clearly value our gun rights. But the threats we are facing today do not stem out of the Iowa legislature. They are coming from an increasingly hostile federal government and President who is now advancing gun control by executive fiat! If Iowa adopts SAPA law, then the impact of Bidens gun control agenda will be severely muted here in Iowa. If not, later this year, Iowa cops will be forced to arrest countless Iowans who own a pistol brace. So on behalf of the members of Iowa Gun Owners, we wholeheartedly support HF147 and urge the members of this subcommittee to advance this bill to the full committee, as is. With the ongoing constant push by the federal government to restrict or rights as law abiding citizens to practice our 2nd amendment rights, I believe it is imperative that we protect ourselves from the federal government, In essence, conscripting our local law enforcement to do their bidding. In recent years, American Citizens have seen their Constitutional Rights eroded by our government. Many of these assaults have come by way of government agencies like the EPA and the BATFE. These agencies pass policies that have the weight and power of law, with penalties of law. This is unconstitutional, as only Congress is empowered to pass laws. This is especially true of the BATFE, which has flip flopped on several issues such as bump stocks and pistol braces due to the politicization of that agency by the left. Citizens who own legal weapons one day may find they are in possession of "illegal" weapons the next, due to a change in policy by the BATFE. To make matters worse, there is no recourse but to surrender or destroy the weapons, or pay a fee to register them, which comes with a new set of requirements for possession and transfer or use of that weapon. This is unacceptable.The Bill Of Rights was written to protect the Rights of the individual Citizen from their own government. No one is saying that the federal government cant enforce their laws here in Iowa. But the reality is that the feds almost always reply on state and local resources to enforce their laws and regulations. By denying them this assistance, Bidens war on gun owners will go largely unenforced here. The Supreme Court has ruled for hundreds of years that the states can not be commandeered or compelled into enforcing federal laws and regulations that they disagreed with. And of course the State of Iowa has that power; if not, we may as well dissolve the legislature entirely. Thats why, when Missouri passed this landmark legislation in 2021, it survived multiple court challenges by the Department of Justice. The other benefit to the SAPA legislation being pushed by Iowa Gun Owners and Rep. Shipley is the protection it provides for progun cops who are trying to honor their oath of office and uphold the Second Amendment. So rather than be put in a spot where they have to break their oath or lose their job when told to enforce Bidens gun control, an officer could simply point to SAPA as his defense. And should a liberal, politically appointed department head try to violate SAPA law, this legislation allows individual gun owners to sue those agencies (not the individual officer) in civil court. This is also part of the law in Missouri and without it, SAPA is nothing but a political gimmick. Biden is about to unleash on gun owners, again. SAPA legislation is my top priority. Thats why I want you to cosponsor, vote for, and publicly champion this legislation with your caucus.

The Iowa Legislature and Gov. Reynolds worked against the majority of Iowans wishes on April 2, 2021 with the passing of HF 756. This bill is just another example of a gross misinterpretation of the Second Amendment. In the words of Supreme Court Chief Justice Warren Burger. The Gun Lobbys interpretation of the Second Amendment is one of the greatest pieces of fraud I repeat the word fraud on the American people by special interest groups that I have ever seen in my lifetime. The real purpose of the Second Amendment was to ensure that state armies the militia would be maintained for the defense of the state. The very language of the Second Amendment refutes any argument that it was intended to guarantee every citizen an unfettered right to any kind of weapon he or she desires. As our elected representatives, the Iowa State Legislature must be honor the wishes of the majority of Iowans, not the minority. We must work toward providing a safe home for our families, friends, fellow Iowans and Americans. Only in this way can we truly create a society worthy of the words we hold so dear. I support for the Second Amendment Preservation Act. The wording of the Bill of Rights was intended to protect law abiding citizens. We have for too long allowed bureaucrats to make rules which were never laws passed through legislative process. Our system of government does not provide any place for minidictators who think they individually should make rules for others while exempting themselves. I have asked Iowa legislators for many years to fix how LEOSA Title 18 U.S. Code 926C is handled in Iowa.There is no Iowa law stating that the retired police ID Shall Issue of Show Cause. If for some arbitrary reason an agency refused to issue the retired police ID, there is NO Oversight, NO way to appeal such a decision.Worse yet Iowa Legislators have failed to exempt QRLEO Qualified Retired Law Enforcement Officers from Gun Free School Zones. Two years ago, I did get legislators to exempt off duty currently serving police from gun free school zones. That must be extended to retired police who are currently firearms qualified. Remember the unarmed off duty police officer watering the football field at the Parkland Florida school shooting. It's important to realize he was unarmed because nothing exempted him from the school's gun free zone. He could have stopped the shooter sooner but legislators failed to exempt off duty and retired police in the wording of the law.School No Carry Zone signs do not stop bad guys from bringing guns...... they only stop those of us who are retired police even with our QRLEO ID which shows we firearms qualified to Iowa Police Standards.

February 15, 2023I write in support of the Second Amendment Preservation Act (SAPA) HF 147. By way of background, I am a six times elected county attorney, have had something north of 100 jury trials, several dozen appellate cases and am admitted to the federal courts in Iowa as well as the Eighth Circuit Court of Appeals and the United States Supreme Court. Currently I serve on the Board of Governors of the Iowa State Bar Association, the executive board of the Iowa State Association of Counties and, as a past president, a board member of the Iowa County Attorneys Association. I am not speaking for these organizations although I assure you that there is widespread concern about our liberties with the federal overreach of our era. Lets look ahead and think about the society we leave for our children and grandchildren.Were you a first law student taking constitutional law and answered a test that the CDC has the authority to order landlords throughout the country that they may not evict nonpaying tenants; I suspect you would have failed. If you took a quiz in administrative law class and answered that federal OSHA officials have the blanket authority to order workers to be vaccinated, that would also have been a wrong answer. Yet, we had the federal government doing just that until cases went to the United States Supreme Court and their efforts failed.We now have the most antigun rights ATF director in history. The recent administrative rule fabrication about pistol braces is but one example. Our Attorney General Bird has joined dozens of other states for court action to stop this regulatory overreach.I have been told the potential sanction against law enforcement agencies is a concern by some. Many laws have no teeth and I can recite hundreds of examples where agenda driven local political bureaucrats infuse their personal philosophy into government. Look at the county sheriff who denied a weapon permit based on the persons county budget protests. A federal judge ordered him to go back to school and take a constitutional rights law class. More recently, Monroe County paid out well into 6 figures to settle a lawsuit when it blatantly attempted to ignore the state code weapon preemption law.As an economics major at Grinnell College, I learned two immutable laws on human behavior, increase a cost and you will get less, subsidize and you will get more. Without a potential cost there are those who will ignore their oath to the Constitution and the Law and twist and turn words on end to justify their agenda. If it were up to me, the potential civil penalty against the agency (not the officer) would be significantly higher.More properly, the bill should be called the Peace Officer Protection Act. Joe Biden is vowing and taking action almost daily to eliminate our 2nd Amendment rights in this country at the Federal level, and its long time overdue to stop him. I target shoot with my 13 year old son at least twice a month and we hunt everything from squirrels, pheasants, and quail to deer every year. This is one of the greatest joys of our lives, and to think that that could be taken away by one man with a pen is unconscionable. I personally think our president has sold out the U.S. to China. Now that the Second Amendment Preservation Act (HF147) has been approved by a Judiciary SubCommittee, I am writing to urge the full Judiciary Committee to advance this bill through the committee so that it can receive a vote in the full House. At the end of May, Joe Bidens most recent Executive Order attacking gun owners (this one dealing with pistol braces) takes effect. Overnight, as estimated 40,000,000 gun owners will have to register their braces, or face felony charges. Tens of thousands could be Iowans. This new ATF rule wasnt voted on in Congress. Its gun control by executive decree. But whats worse is that Biden is counting on the free use of Iowas troopers, deputies, and city cops to do the dirty work of enforcing this legislation. Thats why Iowa needs to pass the Second Amendment Preservation Act (AKA SAPA) (HF147) this session. HF147 instructs Iowa cops to only enforce laws passed by the Iowa legislature where our gun rights are concerned. In this way, our cops can maintain law and order, without having to worry that theyll be ordered to enforce unconstitutional gun control mandates from the White House. The idea of states refusing to enforce federal laws they disagree with is not new.The left has used this tactic to protect violent, illegal aliens by simply refusing to deport them as directed by the federal government from 20172020. And, for over a decade now, a growing number of states have had their own laws regarding marijuana and have simply refused to enforce federal marijuana laws. As a former Iowan, born and raised in Iowa, with relatives still living there, here is my advice.Do not pass this bill. There are groups backed by the NRA and weapons manufacturers that want a free for allOn gun ownership. We all know without a doubt what the proliferation of arms has done to our society. Schools across this nation have had to implement active shooter response training for K12 grades and also in colleges.Grocery stores, malls, churches and even concerts have all become targets thanks to the excessive sales of guns to ANYONE with cash in hand. Since the expiration of the Clinton years Bradey Bill deaths from automatic weapons have skyrocketed. Dont get me wrong, at one time many years ago I supported the NRA for gun safety training but somewhere along the line they became RADICALIZED and split from gun owners that wanted good strong common sense gun laws passed. Keeping weapons restricted to only those that had passed background checks, required training and licensing and removing them from the hands of those deemed dangerous or threatening ie Red Flag Laws. As a retired veteran I will tell you AR15s and other civilian stylized assault weapons do not belong in the public domain. Even without an automatic setting these weapons can inflict mass casualties and death as fast as you can point, aim and squeeze the trigger. If the magazines are configured in a three pack as we used to call them, you can reload in seconds and continue the carnage. Please vote, NO! I know this is an organized petition by those that want to keep the Federal government from being able to regulate gun ownership in any state but in the incredible times and circumstances in which we all find ourselves we need to support Federal gun laws that are able to slow the proliferation of gun violence across this country. This refusal to cooperate with federal laws or regulations is not new. Blue states/cities refused to deport violent illegal aliens during 20172020, and dozens of states have refused to enforcefederal laws regarding marijuana for decades.SAPAs Supreme Court Precedent:The anticommandeering principle is not a new legal concept. The United States Supreme Court (SCOTUS) has upheld this principle in cases stretching back to 1842. In each of these cases, SCOTUS has reaffirmed that where the state and federal government disagree, the federal government has no authority to compel or commandeer the state (or their resources) to aid in the enforcement of federal law.While one of these cases touches directly on the Second Amendment, this concept is broader than that. SCOTUSs anticommandeering decisions cover gun rights, runaway slaves, sports betting, nuclear waste material, and much more.Some of these include: The 1842 Prigg v Pennsylvania decision; in this case SCOTUS held that the federal government could not force the states to enforce the Fugitive Slave Act of 1793. The 1997 New York v United States decision; in this case SCOTUS held that the federal government could not simply force New York State to dispose of radioactive waste in their state. The 1997 Printz v United States decision; in this case SCOTUS held that the state/county government of Arizona could not be compelled to enforce the Brady Gun Control bill. The 2012 NFIB v Sebelius decision; in this case SCOTUS held that the states could not be forced to expand Medicare. They further held that the federal government could not withhold money from the states to punish them for noncompliance. The 2018 Murphy v NCAA decision; in this case SCOTUS held that that New Jersey state legislature had the right to place restrictions on sports gambling, even though those restrictions contradicted federal law.Clearly the State of Iowa has the constitutional right to tell the federal government that our cops will not be enforcing federal gun control laws any longer.SAPA Protects Iowa Cops:HF147 contains civil penalties so that if a jurisdiction violated SAPA law and enforced federal gun control, the impacted gun owner could sue that agency (not the officer) in civil court for damages.The simple fact is that without these penalties, certain jurisdictions in Iowa would walk right over SAPA law.Thats why the legislature had to add penalties to a variety of existing laws over the last few years, to ensure compliance with the law from politicians at the county and local levels.Some have claimed that these penalties make SAPA anticop.But thats simply not the case. The overwhelming majority of Iowa cops love the Second Amendment and do NOT want to be forced to carry out Joe Bidens gun control agenda on fellow gun owners.Currently, our cops have two choices in dealing with these orders. One, violate their oath and their conscience and enforce gun control mandates. Second, refuse to carry out these orders, and get fired.SAPA law gives them true protection, by making it illegal for them to be used to enforce federal gun control laws.So while some law enforcement department heads may not like SAPA, front line officers love it! And to be clear, many of these same department heads opposed the Freedom Amendment, Constitutional Carry, StandYourGround law and even 2010s Shall Issue law.SAPA Does Not Help Criminals:Some will argue that SAPA law will benefit criminals, much like they claimed that Iowa would run red with blood after the passage of StandYourGround and Constitutional Carry law.This is, of course, false.SAPA law does not apply to felons.SAPA law does not apply to illegal aliens.SAPA law does not apply to outofstaters.SAPA law does not mean that the federal government cannot help the State of Iowa enforce Iowa laws. It can.SAPA law even allows Iowa cops to help the federal government enforce federal laws (even if a gun is involved) if an underlying state law regarding the distribution of narcotics or a violent crime against is being committed.Clearly this legislation will not help criminals.SAPA Precedent in Other States:The identical version of HF147 is the law of the land in nearby Missouri, which enacted SAPA in 2021.In Missouri, state and local cops enforce state laws when it comes to firearms, ammunition, and accessories. The federal government enforces federal gun laws on occasion. And crime rates havent changed.The DOJ has sued to block SAPA law at the Circuit Court level two times, and lost both cases. An appeal to the State Supreme Court was also defeated.The DOJ sued in federal district court over this last. And while oral argument were held last July, the judge has not issued an opinion in this case.Missouris AG who defended SAPA law in these cases was recently elected to the U.S. Senate. The Senate sponsor who passed SAPA law was recently elected to Congress. And not a single incumbent who voted for SAPA in Missouri lost their election over it.SAPA is What Gun Owners in Iowa Want:The members and supporters of Iowa Gun Owners have spoken very loudly about the Second Amendment here in Iowa since our inception in 2008.Gun owners have removed dozens of members of the House who voted for gun control since the 2010 election, flipping the chamber that year, and rebuffing the lefts efforts to take it back ever since.The same thing happened in the Senate in 2016. After years of blocking StandYourGround and Constitutional Carry, six of six incumbent Senate Democrats were removed from office, the chamber flipped into Republican hands, and its stayed that way.As a result of these efforts, Iowa recently passed Constitutional Carry and added protections for our gun rights in the state constitution by over 65% of the vote.Iowans clearly value our gun rights.But the threats we are facing today do not stem out of the Iowa legislature. They are coming from an increasingly hostile federal government and President who is now advancing gun control by executive fiat!If Iowa adopts SAPA law, then the impact of Bidens gun control agenda will be severely muted here in Iowa. Thats why the legislature had to add penalties to a variety of existing laws over the last few years, to ensure compliance with the law from politicians at the county and local levels.Some have claimed that these penalties make SAPA anticop. But thats simply not the case. The overwhelming majority of Iowa cops love the Second Amendment and do NOT want to be forced to carry out Joe Bidens gun control agenda on fellow gun owners. Currently, our cops have two choices in dealing with these orders. One, violate their oath and their conscience and enforce gun control mandates. Second, refuse to carry out these orders, and get fired. SAPA law gives them true protection, by making it illegal for them to be used to enforce federal gun control laws. If you know the law, you would know that the federal government has to take a back seat to the sheriff of any county.The sheriff is the superrior law enforcement officer, even above the FBI or IA. If the county sheriff is a constitutional sheriff, he is to enforce the constitution and you don't need all these statutes that the legislation passes. You must remember that the constitution is the law of the land. I believe that time is wasted on fretting over these codes and statutes that mean nothing unless you consent to them . The elected politicians as well as the Sheriff all work for the people who elected them. It, I believe,would be beneficial to everyone, if people would study the law instead of wasting their time crying over what is not necessary. We Iowans oppose the invasive techniques of the present executive department of the US Government and we need that opposition to be codified in Iowa law.In order to send Iowa National Guard troops to fight a sworn enemy of America, they must be sent by the Iowa Governor. Iowans deserve the Second Amendment Preservation Act! Our state motto says it all but the feds have overstepped virtually every right enshrined in the Bill of Rights. Biden's ATF (among other unconstitutional alphabet agencies) have been weaponized against the citizens of the United States. Many other states have enacted SAPA and Iowa should too. The 9th and 10th Amendments spell out that the States and the people hold political power and the federal government only has those powers enumerated which are defined and limited. HA! The feds have usurped far too much power. It's time to fight back. Iowa passed Constitutional carry and while that's a great thing for liberty anyone legally carrying in Iowa without a permit has violated the federal Gun Free School Zone act if they're within 1000 feet of any public or private school property!
