The Urban Education Network is registered as undecided on this bill. We have no objections to any of the language in Section 1 regarding self administration by students and parent permission processes to support that selfadministration. Regarding Section 2, all of the purchase, storage, maintenence and replacement of bronchodilators is written as permissive, ie., district "may" purchase, store, and provide, etc., so we do not see this as a mandate. However, we are concerned that this sets an expectation and possible litigation that might make school boards responsible if they do not prepare for this kind of situation, especially since they would be given the authority to do so. The protections against liability only apply to actions in good faith use of the bronchodilator, but there does not appear to be protection for the district or school board that decides not to provide a store of bronchodilators/canisters for use.
