I am an Iowa wife, mother and grandmother. I am writing to express my opposition to the proposed strict scrutiny amendment to the Iowa constitution. This dangerous step would lead courts to strike down the few public safety guarantees Iowa currently has against gun violence. It could put too many guns in the hands of dangerous people in our state. In addition, this is not even what Iowans want! Twothirds of Iowans oppose amending the constitution to undermine gun safety laws, according to polling data from 2020. Given the events of last week, we need our lawmakers to make us safer, not less safe. Do the right thing and stop this radical and dangerous amendment.

My name is Leslie Carpenter and I am the mom of an adult son who lives with a Schizoaffective Disorder, which is a difficult to treat combination of Schizophrenia and Bipolar Disorder. When his illness is worse at times, the voices he hears often tell him to do horrible things. At other times, they tell him to kill himself. The last thing I would ever want is for him to have a gun while his illness is out of control. For this reason, I am adamantly opposed to this bill which would prevent future legislation that would limit his ability to get a gun via sensible gun legislation. It would prevent Extreme Risk Protection Orders which would prevent someone at high risk for suicide or homicide due to a mental illness from having access to a gun. Suicide attempts with guns are lethal 8595% of the time and are the leading causes of gun deaths. This bill is extreme and dangerous. At a time when so many are in crisis in our state, and so many are struggling with mental illnesses, with our suicide rates climbing, we should be spending our time, resources and money helping Iowans...not working on bills that can prevent reasonable public safety laws in the future. I urge you to vote against this bill and to not advance it beyond this subcommittee meeting.

I grew up in a hunting family and have a tremendous amount of respect for the right to bear arms responsibly. I very much enjoy time hunting withmy family, learning where my food comes from and being a part of the entire process. However, in our family, we always knew that responsiblegun ownership was essential and protected the rights of futuregenerations to bear arms. People are just human beings, and we sometimesget things twisted. It's fair and right for us to have constraints on how we can use firearms. We have constraints on how we can use vehicles. We have to have insurance, wear a seatbelt and follow traffic laws. The point is that it is for the collective safety of all of our residents. Adding the high bar of "strict scrutiny" does not allow us to regulate those arms at all. I understand that the 2nd Amendment is a sacred right, but it is already covered by the US Constitution. The only thing we need to do is protect Iowans. We cannot protect Iowans when you take that ability away from us completely. Do not allow this bill to pass.

I'm a married man in my 40s with a family. I fully support amending the state constitution to guarantee the right to keep and bear arms in our state. The United States constitution guarantees this right. While it may seem repetitious to amend our state constitution to reflect that federal document it reinforces the rights of citizens in our state. Like the discovery of fire, the firearm is a human invention that one cannot simply wish away. They will always be in our society either legally or illegally. It's just a simple fact. Pass the bill!

I am a gun violence survivor. I know all too well the destruction that unchecked access to guns causes to our lives, our families and our communities. Nowhere has the Iowa legislature clearly explained the rationale behind HSB9. Who among the citizens of Iowa are asking for this? NO ONE. In fact, public polling has shown that a majority of Iowa voters DO NOT support amending the constitution in a way that poses a direct threat to our communities. Represent the people of Iowa, not the NRA, gun manufacturers and sellers and their lobbyists. If this gets passed it will force the courts to use judicial analyses that are likely to lead to the dissolution of our public safety laws. In fact, the NRA itself has described such "strict scrutiny" amendments as the "iron wall" that will prevent state legislatures from enacting common sense gun safety laws. This is concerning to me as a mom and Iowan. By adding this language, we are putting our strong Iowa's gun laws at risk. Everyone I know in this state supports our background check system that works for so well and keeps guns out of those who should not have them. Felons and such. This type of scrutiny would put those at risk and spend thousands of dollars on court cases that could be guns in the hands of violent people. Please do not put this forward and focus on other issues that will help our state grow and attract talent to our workforce.

I hope you will reject this dangerous proposal.I am an Iowan and an Army Reserve veteran who served in the first Gulf War with the 320th Military Police. Prior to that, I served with the 339th Military Police in Davenport, Iowa. After last weeks attempted coup at the United States Capitol Building, the FBI is warning of further armed demonstrations at the state Capitol in Des Moines. This moment calls for lawmakers to do more to prevent gun violence, rather than undermining Iowas gun safety laws. I fully support the 2nd Amendment. Unfortunately, this proposal is NOT the 2nd Amendment. With language that reads any and all restrictions, this is much more extreme. If strict scrutiny is applied to any and all restrictions this could remove public safety measures that the majority of Iowans support, such as background checks on handgun sales and permitting for concealed carry. I dont want convicted felons to have guns and I dont want guns on school grounds. This amendment will put all of that in jeopardy, with Iowa taxpayers funding all of the lawsuits filed by criminal defendants and extremists with criminal histories. I have a concern about adding Strict Scrutiny to the constitution, for any amendment. Only 3 other states (Missouri, Louisiana, and Alabama) have strict scrutiny with the 2nd Amendment. Missouri has had concerns about the cost of litigating with strict scrutiny. Has anyone looked into how much it could cost Iowa to add those 2 words? Why not add the 2nd amendment without Strict Scrutiny? Why does the 2nd amendment need more scrutiny than the 1st or any other amendment?

To: Iowa House of Representatives Public Safety CommitteeIm writing to express my opposition to HSB9, my great concern at the way its sponsors have sought to rush the adoption of a constitutional amendment with so little public discussion, and my anger at the misrepresentation of this legislation as simply enshrining the federal Second Amendment in Iowas Constitution. I support the Second Amendment. HSB9 is NOT the Second Amendment, and it is not what the majority of Iowa voters want, as recent polls have demonstrated.When conservative icon Antonin Scalia wrote the majority opinion in the 2008 Supreme Court decision (District of Columbia v. Heller) that the Second Amendment protects the individual right to possess and carry handguns in ones homes for selfdefense, he made clear that nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms. This should be a relief to the majority of Iowans, including a majority of gun owners, who support permit regulations, universal background checks, and other sensible gun restrictions. Apparently the National Rifle Association, which authored this dangerous bill, begs to differ. In their version of the Second Amendment, any and all infringements on the right to bear arms will be subject to strict scrutiny by the courts. The future of Iowas sensible gun laws is an open question if this constitutional amendment is adopted. Only three states have adopted the NRAs version of the Second Amendment. Im writing in strong opposition to HSB9. By requiring a strict scrutiny analysis of any proposed gun restriction, HSB9 goes farther than the second amendment to the US Constitution. Ironically, the most pressing compelling state interest today given the increasing polarization of American society is continuing to institute common sense gun restrictions like background checks. The last thing we need at the present time is passing a law that would give insurrectionists like those who invaded the US Capitol last week more encouragement to arm themselves in pursuit of their political goals. I am a new mom. I had my first baby 9 months ago and I am afraid of the Iowa he will grow up in if you go forward with the "strict scrutiny" constitutional amendment. If you adopt this amendment, you are placing my baby son at risk by allowing the potential for convicted felons and domestic abusers to posses firearms. You would be threateningIowa's ability to require background checks on handgun sales and permits to care a concealed handgun in Iowa. Please don't move forward with this to keep Iowa safe for my son. I have always been a proud Iowan, but don't want to be one of only three additional states that has this extreme language. Nearly 70% of voters do not support amending our constitution to undermine gun laws. Please protect the children of Iowa by not moving forward with this constitutional amendment.

This would eliminate background checks and allow convicted felons to buy guns. This is not a reasonable way to protect Iowa citizens. It undermines existing public safety laws. I urge you to drop this proposal. We need Iowa to be safe and protected!

I am in strong opposition to HSB 9. Iowas constitution is a sound and fair basis for the governing of our state. Amending it to specify no restrictions whatsoever to gun rights is incredibly wrong and not in the best interests of Iowans. I was born in Iowa and have lived much of my 48 years here. The vast majority of citizens support common sense gun laws, including universal background checks and getting guns out of the hands of those likely to do harm. This proposal goes in the opposite direction and does not make Iowans safer. This is a fringe and extreme approach that has no place in Iowa.

Are you planning to allow sexual predators and domestic abusers to own guns? Do you really not worry about the safety of our children at school? Or the safety of families who live with an abuser? For that matter, your own safety in YOUR workplace?My nowdeceased father was mentally ill. I remember him telling me that he wished he had a gun so he could shoot the Hispanic family who lived next door to him in Cedar Rapids. I was terrified. He didn't have the means to get a gun, and I warned a former relative who owned a local gun shop not to sell to him. But what if he had been able to buy a gun? Would he have killed his neighbors, whom he didn't even know, but whose very existence seemed to drive him to think this violent thought? Why should someone who is suffering from mental illness have the right to own a gun? What about the safety of the rest of us?Do you really want more school shootings? Concert shootings? Loan officer shootings? Restrict gun ownership to mentally stable individuals. Restrict where they can be carried. Use reason when contemplating this illadvised law. If you don't, then any gunrelated death in Iowa will be squarely on your heads.

The Second Amendment of the US Constitutions protects the existence of a WELLREGULATED militia. This Strict Scrutiny bill would endanger Iowans, and goes against what the majority of Iowans want. A majority of voters in Iowa, including 70% of Republican women, say they would never vote for a candidate who doesnt support background checks on all gun sales. In fact, opposing background checks on all gun sales was the most disqualifying candidate position among suburban women by a sixpoint margin. I am calling on your to drop this bill. It's not what Iowans want, and it will endanger citizens.

I am opposed to allowing felons and previous domestic abusers keeping guns and obtaining guns. Gun violence is high, and obviously very lethal. These people already have a bad track record and now giving them the right to keep and obtain guns? Im not opposed to guns, in fact I have a gun myself. But, Im also a law abiding citizen with a lot of gun safety training. Additionally, this is very personal to me. Ive been in an abusive marriage for many years. After being assaulted several times, finally I am moving on. However he continues to possess guns. I am always in fear, as he still threatens me and harasses me. Police and all know he has guns, ammo etc. and yet, nothing? In fact, there is an order to preserve to bring those guns back. Still, not returned and in his possession. So, now we are going to support situations like this? Guns in this situation need to be controlled. More stringent laws need to protect all is us Iowans. I know Im not the only person with this situation....I see gun violence in my ER all the time. Please help

I'm a Registered Nurse, born in Greene County, educated at Luther College in Decorah (graduating in 1982). I am a certified Pediatric Nurse and have seen the effects of gun violence (mostly suicide) since the early years of my career. Please do NOT amend Iowa's constitution. We need the popular laws that have supported safe gun ownership; and we also need the laws that protect us from those that we don't want guns available to (people dealing with Depression and other mental health issues). As a nurse, I have answered the emergency phone call that says "Lady, send an ambulance quick. My friend just shot himself." (This person was killed instantly.)Please do what is best for all Iowans. Keep popular gun safety laws. But leave the constitution as is. I believe Strict Scrutiny will only lead to more lives lost. I'm in the business of helping people live. Please help me be successful. Nurses need your support of keeping people alive.

We do not need strict scrutiny placed around the 2nd Amendment in Iowa. It would make us considerably less safe to allow felons, insurrectionists, and dangerously mentally ill people to own guns. Missouri enacted a similar and has seen an increase in gun deaths. Iowa is better than a shithole state like Missouri.

Please do not pass House Study Bill 9 (HSB 9. We need more control of guns, fewer guns and more consideration of the rights and the safety of the public than catering to a fringe of of gun owners. This legislation would go much further in protecting gun rights than the Second Amendment to the US Constitution does, because the language of the Second Amendment does not say (and the US Supreme Court has never held), that strict scrutiny applies to all gun regulations.The proposed strictscrutiny amendment could make it much more difficult to pass any commonsense gun reform legislation in Iowa and could even invalidate the States existing limits on gun rights (like the law that felons cannot have guns or that guns are not allowed in sensitive places like schools). This would be absolutely crazy! States that have adopted strict scrutiny language have seen costly legal battles to preserve common sense gun laws, and in some cases prosecutors have even declined to enforce them. Gun deaths have increased dramatically in Missouri since its passage of a similar amendment in 2014.After the scenes in the US Capital last week (January 6th) it is obvious we need to be very cautious about making it easier for people to own and carry guns. HB 9 is step in the wrong direction and should absolutely not be passed out of committee.

This amendment is dangerous and financially irresponsible. Imposing the "strict scrutiny" standard (which is not a part of the 2nd Amendment, contrary to what this amendment is trying to suggest), at a time when so many are hurting financially, this amendment would dramatically increase the amount of taxpayer money going to litigation litigation which would also undercutting the current laws that keep Iowans safe from death, injury and threat of gun violence.

Most Iowans, including many responsible hunters and gun owners, are in favor of common sense gun legislation. Adding language like strict scrutiny makes it more difficult for Iowans to live safely and to keep our children safe in schools and in their own homes. I support hunting. I support safe gun sports. I support responsible Iowans owning guns that they are trained on and capable of using safely. I do not support this amendment. And I think there are critical issues for Iowansincluding economics, COVID vaccination rollout, and water quality that are more deserving of the attention of the Iowa legislature.

Why spend time and money on something that is already guaranteed by the U.S. Constitution 2nd amendment.Isn't this country already armed to the teeth? Do Iowans feel the need to open carry weapons to schools, nursery schools, libraries, the doctors office, the grocery store, the closing store, the pedicurist and the list goes on. S T O P the madness!!!We DO NOT need more guns and more laws protecting these frightened Republicans right to bear arms. As an Iowan I would like to respectfully express my concern for HSB9. In these tumultuous times when we have watched violence unfold, most recently at our nation's capitol, I am concerned about any measure that could hinder common sense public safety laws in our state. Current public safety measures like prohibition of gun possession by convicted felons and domestic abusers and concealed weapons permitting are supported by most Iowans including gun owners. Having to meet the legal bar of strict scrutiny in Iowa's constitution would likely spell challenges to these reasonable laws. Not only could this amendment erode measures that increase safety for Iowans and keep guns out of the hands of people intent to do harm, there is also the very real possibility there will be great expense to the state of Iowa when legal challenges arise.

HSB 9 is not an attempt to add the Second Amendment right to the Iowa Constitution. Democrats previously proposed an amendment that exactly mirrors the US Constitutions Second Amendment and the Republican majority voted it down.Under this proposed amendment to the Iowa Constitution, ALL state gun safety regulations would be subject to "strict scrutiny," the highest level of constitutional review available. Any regulation concerning firearms would have to further a compelling government interest in a narrowly tailored manner and in the least restrictive possible way. Every commonsense gun safety regulation would be challenged in court. It goes well beyond the federal Second Amendment and is terribly unwise in light of the suicide rate, mass shootings, private 3Dprinting of firearms, Capitol insurrection, and more. I also find it not just a little ironic (and tragic) that a subcommittee of nearly the same people will be meeting in the same hour to advance two constitutional amendments, one of which will elevate the right to bear arms to the highest level, and the other which will completely remove the right to bodily integrity and autonomy for a pregnant person.Please vote NO on HSB 9.

Please oppose adding an amendment to the Iowa Constitution that includes "strict scrutiny" for any gun safety laws. "Strict scrutiny," which would require the highest standard for any gun safety law, would place all of Iowa's gun safety laws in danger of being struck down by the courts. This Amendment is not a mirror of the Second Amendment to the U.S. Constitution. In fact, the Iowa House and Senate have each voted down efforts to substitute the U.S. Second Amendment version in the past.Only three states include NRApushed "strict scrutiny" language in their gun rights amendments and Iowa should not be the fourth.

Similar strict scrutiny amendments have only harmed residents in other states that have passed these amendments. Gun deaths have dramatically risen in Missouri since they passed their similar amendment in 2014. A strict scrutiny amendment is also deeply unpopular with Iowans. Polling by Everytown shows that nearly 70% of Iowans do not support a strict scrutiny amendment. I strongly urge the subcommittee to save the lives of countless Iowans by voting down HSB 9.

I find it extremely irresponsible to pass amendments that work in opposition with the gun sense legislation intended to protect children while they are learning in public schools. I am old enough to remember when the NRA was opposed to selling or owning automatic weapons of war. Of course that was before the main NRA funding came from their invidual members and not gun manufacturers and sellers. The NRA used to have the view that reasonable laws were not antisecond amendment. It gets worse. This amendment would likely force the courts to throw out most of our state's existing gun control laws. If the events of the last week have shown anything, they have shown the dangers of making firearms ever more available and easier to use. After the horrific tragedy at Sandy Hook in Newtown, Connecticut, I cannot believe that anyone would support a bill that allows guns to be carried in places in our country where children could be murdered en masse. As a school teacher, I am very disappointed in the legistlature's push to protect inanimate objects like guns more than our children. We need common sense gun reform, not freedom to do whatever you want with them. Watching the elementary children in our building cry during active shooter drills (which are a common and unfortunately necessary part of life nowadays because of bills like this one) is heartbreaking. I urge you to observe one of them one day to really see how you are affecting people's lives and mental health over weapons of death. The 2nd Amendment of the US Constitution does have a right to bear arms, but in a "Wellregulated militia", NOT in your basement or hoarding thousands of rounds of ammo or buying as many assault rifles as possible. Our direct service providers routinely witness the pain and suffering of crime victims, as well as their stunning resilience in surviving repeated violent acts (often over the course of months and years), inflicted on their minds and bodies by people they know and care about. ICADV urges you to oppose HSB 9, a constitutional amendment adding gun rights to the Iowa Constitution with a strict scrutiny judicial review standard. We believe this amendment undermines every existing or future sensible gun safety policy. Americas level of gun violence threatens public safety and we urge legislators to halt further efforts to advance this constitutional amendment proposal.As we become normalized to the regular pace of mass shootings and gun homicides in our communities, and come to grips with the reality that twothirds of all gun deaths are gun suicides, efforts to further expand access to guns present a false choice. Access to guns and gun rights for lawabiding citizens are not threatened in Iowa. You can be in favor of gun rights AND be in favor of reasonable policies to protect people from gun violence. Strict scrutiny is the most demanding judicial standard applied to constitutional cases. It requires judges to assume a challenged law is unconstitutional until the state proves otherwise. Only three states (Alabama, Louisiana, Missouri) include the extreme strict scrutiny language under consideration in Iowa. The experience in these states indicates a strict scrutiny standard undermines gun safety laws due to persistent legal challenges that burden the justice system and are paid for by taxpayers. Gun deaths by suicide, by intimate partners in homes, and in criminal acts occurring every day in communities across America are most common but mass shootings offer powerful illustration of the terror and toll of gun violence. The link between guns and domestic abuse homicide is so definitive that the role of domestic abusers in mass shootings is unsurprising.More men than women are killed by gun violence, except when it comes to domestic violence incidents where women and children are significantly and disproportionately terrorized and killed when guns are present. Nearly half of female firearm homicide victims were killed by an intimate partner. Access to a gun makes it five times more likely that an abusive partner will kill his female victim and when that happens guns are the cause of death for 70% of bystanders killed in domestic abuse incidents. And women in communities of color face a disproportionate share of the burden nationally, Black women are twice as likely to be fatally shot by an intimate partner compared to white women and younger Black women between ages 1834 are nearly three times more likely to be shot and killed by an intimate partner than are white women in same age group. Importantly, for every case of domestic abuse homicide, there are many more cases where women and children are held hostage and terrorized with guns. For example, the abusive partner who never fires the gun, but threatens her with it by pointing it at the children, waving it around during an argument, or shooting a family pet. Experience and research offer numerous examples of policies that work to protect people from gun violence and overwhelming majorities of Americans support these policies. We are moving in the opposite direction in Iowa. As a modern society we balance individual rights with public safety and community interest all the time. In the face of overwhelming evidence confirming Americas exceptional gun violence problem, gun rights should be no exception. The gun rights constitutional amendment proposal with strict scrutiny language advancing in Iowa would undermine all efforts to enact sensible restrictions on firearms access and could open the door for current gun safety laws to be challenged. Im writing to you today as a mom of two young children and a gun owner to express my opposition to this proposal.My growing family moved to Iowa because we felt our values would be better represented than in our former home in Missouri. Like many Iowans, I want to do all I can to keep my family safe, which is why Im deeply concerned that instead of pursuing common sense solutions to gun violence, the committee is considering an extreme attempt to amend the Iowa constitution and threaten our bedrock public safety laws. . The overwhelming number of Iowans, your constituents, support commonsense public safety laws, like the background check requirement for handgun sales.
